There is no such thing as “abortion up until birth.” That is nonsense. It’s really more like a “c-section” at that point. No doctor would ever not attempt to save the fetus at that point, but sometimes a fetus has such catastrophic defects that it is just not possible and it is better to do whatever is safest for the mother. I don’t get what is so hard to understand about that.

I don't think it matters how far into pregnancy the bill extends -- the Constitution overrides it. According to Planned Parenthood v. Casey, the cutoff is viability; if the baby can be delivered, it must be. If it can't be delivered, then what's the argument even about?
A woman dilating and being in need of an abortion is not an absurd situation. Savita Halapanvar died in Ireland because of an incomplete miscarriage, because of Irish law at the time, which outlawed abortion, the doctors were waiting for the miscarriage to complete unassisted, and this is why Savita died, she was in need of an evacuation but the fetus still had a heart beat, the doctors wouldn't perform the evacuation while the fetus still had a heart beat, by the time they could it was too late to save Savita's life. Savita was a dentist, someone who had medical knowledge, she begged for an abortion, she knew why she was dying. So, even at full term, an abortion may be necessary to save the life of the woman, the other option being both dying, as was the case with Savita.
The example the unseen guy made against the bill was insane. "Say there's a woman dilated and 40 weeks pregnant. Would your bill allow the doctor to abort?" Like WTF!? I would have said "Allow the doctor to do what? Like refuse to deliver? Drown the baby? Does the bill allow the doctor to do what exactly, as in what are you trying to say?" After 30 weeks give or take, the baby is going to try to live (and will) as soon as you pull the exit shoot (unless that fetus wasn't going to survive anyways). The bill in question allows for late term abortions that can be dangerous for the mother (or the baby could have serious defects that would make the child unable to survive for long without serious care (possibly life long). Abortion in this case purely means that we as physicians can chemically induce a natural process. If the child lives, we cannot take that life, but this is why the physician certifies the pregnancy as a candidate (so healthy fetuses aren't terminated incidentally).

Thank you Jamie!!! I have two friends who lost three children due to complications at the end of their pregnancies. One woman was having an ultrasound and watched as the cord warped around the neck of the baby. So to put it nicely, heart breaking does not begin to explain what these families felt. And then to get the abortion they needed to travel out of state. Where they were whisked away in a cab (that was pro-choice) with two preteen girls to a hotel (that was pro-choice) so as to avoid the crowd of demonstrators, who know these women were arriving. Jamie you are right to say no one understands why these families feel when they make the decision to end their pregnancies so late.
Yes people have mis read the law. It strictly says that the abortion is done if there is a danger to the life of the mother or child. A woman cant just come in as a third trimester and say I want an abortion. As a matter a fact at that point if you are smart you would just have the baby and give them up for abortion. I've read liberal articles on this issue and they said that this bill specifically takes out the "serious physical/mental health" part so now it's just any physical or mental health issues at all. The main reason why the mental health of the woman would be included? Because if she has a mental condition that requires certain medications, a hell of a lot of those medications are known to be damaging to fetuses - to the point of causing disabilities and theoretical death. A very common medication for women with epilepsy is known to cause miscarriages. There's many many more meds like that.

I was just about to comment, but then Jamie made the point I was going to make at the very end of this clip. I think that's the most important thing to remember about "late-term" abortions. These aren't people who just couldn't decide whether or not they wanted a baby until the last moments of pregnancy. These are people trying to have kids who only abort as a last resort because something has gone horribly wrong with the pregnancy. Often, the fetus is already dead or dying and sapping the life of the would-be mother. It's a heartbreaking decision to save the life of the mother, and it doesn't need to be any more difficult than it already is.

I find it extra interesting that the guy asking the questions is only interested in whether such a decision would be allowed to be made in the case where a pregnancy and birth would effect the *mental* health of the mother. You can see in the video that she corrects him, saying that it is both the mental *and* physical health which is taken into consideration. He does this on the basis that it better makes his point- that a triviality like the mental health of the woman could trump the well-being of the child. The idea being that mental health is itself trivial or (in the most charitable interpretation) significantly more trivial than physical well-being.
I don't care for abortion but I understand this is necessary for the protection of the mother and I also understand it's NOT my place to tell woman what to do with their bodies. 9:45 Thing about raccoons is they are mostly nocturnal but they have really bad night vision, so they basically have to use their paws and nose to find food, in fairness they are pretty damn good at solving problems when they can see. Returning to a spot where you found food makes sense too, if there was food there once then there is a reasonable chance there could be again, this is essentially what we would have done when foraging, you go back every so often to see if you can harvest more from the vicinity, even hunting you would follow certain trails and check certain locations, like a water source, perhaps even backtracking multiple times.

K I honestly do not understand what I am missing. Rubin has an issue with the bill potentially allowing abortions in the 3rd trimester if the woman's mental health is impaired. I think it is a very fair position to hold. What is the problem with Rubin disliking a bill that would potentially allow an abortion in the 3rd trimester if the woman's mental health is impaired?
And what's the deal with the negative implications of changing your views on certain matters? Are we supposed to just be static with your world views? I use to believe in a God that i would pray to, but as I grew older I realized that there was not much evidence to prove of a God's existence so I quit believing. Is there something wrong with that?

Like, realistically speaking, unless the mother, the doctor, and the hospital medical board board are monsters, a late term abortion would basically just be a c-section. The point of an abortion is basically to remove the fetus from the woman's body. Plus, there's medical boards and regulations whose purpose is basically to make sure doctors don't go full Mengele, and to remove those who do.
Personally I think that objection could be fully fixed by just adding a little amendment onto the law, like "don't do any fucked up shit, also let it live if it's capable of surviving outside the womb." I mean, I understand that they probably didn't think of it, or that it would be necessary, but at the same time A) they should've realized how the bill would be painted by opponents, and B) admittedly, you never know, maybe there possibly end up being a case of some doctor going leatherface on a baby at some point in the future, I mean a lot of doctors are gigantic assholes.

I don't think it matters how far into pregnancy the bill extends -- the Constitution overrides it. According to Planned Parenthood v. Casey, the cutoff is viability; if the baby can be delivered, it must be. If it can't be delivered, then what's the argument even about?

A woman dilating and being in need of an abortion is not an absurd situation. Savita Halapanvar died in Ireland because of an incomplete miscarriage, because of Irish law at the time, which outlawed abortion, the doctors were waiting for the miscarriage to complete unassisted, and this is why Savita died, she was in need of an evacuation but the fetus still had a heart beat, the doctors wouldn't perform the evacuation while the fetus still had a heart beat, by the time they could it was too late to save Savita's life. Savita was a dentist, someone who had medical knowledge, she begged for an abortion, she knew why she was dying. So, even at full term, an abortion may be necessary to save the life of the woman, the other option being both dying, as was the case with Savita.

The example the unseen guy made against the bill was insane. "Say there's a woman dilated and 40 weeks pregnant. Would your bill allow the doctor to abort?" Like WTF!? I would have said "Allow the doctor to do what? Like refuse to deliver? Drown the baby? Does the bill allow the doctor to do what exactly, as in what are you trying to say?" After 30 weeks give or take, the baby is going to try to live (and will) as soon as you pull the exit shoot (unless that fetus wasn't going to survive anyways).
The bill in question allows for late term abortions that can be dangerous for the mother (or the baby could have serious defects that would make the child unable to survive for long without serious care (possibly life long). Abortion in this case purely means that we as physicians can chemically induce a natural process. If the child lives, we cannot take that life, but this is why the physician certifies the pregnancy as a candidate (so healthy fetuses aren't terminated incidentally).

Thank you Jamie!!! I have two friends who lost three children due to complications at the end of their pregnancies. One woman was having an ultrasound and watched as the cord warped around the neck of the baby. So to put it nicely, heart breaking does not begin to explain what these families felt. And then to get the abortion they needed to travel out of state. Where they were whisked away in a cab (that was pro-choice) with two preteen girls to a hotel (that was pro-choice) so as to avoid the crowd of demonstrators, who know these women were arriving. Jamie you are right to say no one understands why these families feel when they make the decision to end their pregnancies so late.
Yes people have mis read the law. It strictly says that the abortion is done if there is a danger to the life of the mother or child. A woman cant just come in as a third trimester and say I want an abortion. As a matter a fact at that point if you are smart you would just have the baby and give them up for abortion. This is honestly insane. People should actually sit down and read the bill and get properly educated on this.

I've read liberal articles on this issue and they said that this bill specifically takes out the "serious physical/mental health" part so now it's just any physical or mental health issues at all. It doesn't even have to be serious anymore and you only need one doctor.

The main reason why the mental health of the woman would be included? Because if she has a mental condition that requires certain medications, a hell of a lot of those medications are known to be damaging to fetuses - to the point of causing disabilities and theoretical death. A very common medication for women with epilepsy is known to cause miscarriages. There's many many more meds like that.

I was just about to comment, but then Jamie made the point I was going to make at the very end of this clip. I think that's the most important thing to remember about "late-term" abortions. These aren't people who just couldn't decide whether or not they wanted a baby until the last moments of pregnancy. These are people trying to have kids who only abort as a last resort because something has gone horribly wrong with the pregnancy. Often, the fetus is already dead or dying and sapping the life of the would-be mother. It's a heartbreaking decision to save the life of the mother, and it doesn't need to be any more difficult than it already is.

It's more than medically clear that a woman about to give birth or close to giving birth could indeed have a C-section to deliver a baby in an emergency situation. I find it hard to believe that a doctor would choose to abort a baby that could and likely would survive outside the womb even if premature.

I find it extra interesting that the guy asking the questions is only interested in whether such a decision would be allowed to be made in the case where a pregnancy and birth would effect the *mental* health of the mother. You can see in the video that she corrects him, saying that it is both the mental *and* physical health which is taken into consideration. He does this on the basis that it better makes his point- that a triviality like the mental health of the woman could trump the well-being of the child. The idea being that mental health is itself trivial or (in the most charitable interpretation) significantly more trivial than physical well-being.

You could do that "extreme situation" bullshit with nearly any law, and it's one of the reasons why the judiciary is there to *interpret* laws. Because the alternative is to write into every single law the consequences of every single extreme situation that could possibly (though never once in history ever has or conceivably would ever in the future) happen.
A very tragic scenario. I hope that no woman has to go through that. I also think that personal medical problems should be between the patient and physician. I don't see any reason why I should be involved in that decision, considering I am not the patient or physician.

9:45 Thing about raccoons is they are mostly nocturnal but they have really bad night vision, so they basically have to use their paws and nose to find food, in fairness they are pretty damn good at solving problems when they can see. Returning to a spot where you found food makes sense too, if there was food there once then there is a reasonable chance there could be again, this is essentially what we would have done when foraging, you go back every so often to see if you can harvest more from the vicinity, even hunting you would follow certain trails and check certain locations, like a water source, perhaps even backtracking multiple times.
