Finally got the battle to pop. Max out the 40 weapons chapter select to play as 9 ch 16-01 which starts you at CITY RUINS NEAR TOWER. The sub mission marker will now be present inside the mall ruins. Speak to Emil and you know what to do from there.
I know I'm late, but just to clear stuff out, it has nothing to do with a chapter or who you play with, you get to start the mission once you fully upgrade all weapons.

i think whenever you can control 9s right before going into the final tower

did you make sure to find and fully upgrade every weapon in the game cus this is the second e;il fight and that is required in order to unlock it
I have all 40 weapons all 3 pods maxed out and it won't trigger for me
