      I thought you would’ve got the sniper to take out Vidal and the wife to take out Yates. It’s not a crime because you didn’t pull the trigger or push Yates off the balcony but I liked your way too.

      There are laws that make it so that if someone stops and illegal thing from happening, they will not face penalty for stuff that would otherwise be illegal. Which basically means if you do something illegal to stop something illegal, it's becomes legal. And considering the illegal homeless person mind control stuff, that under such circumstances would allow you to commit an illegal act would that becomes legal. And for berlin, oh gee that safety stuff. A good lawyer might be able to win you a case, therefore making it effectively legal.

    Fun fact! In many U.S. states, it only counts as trespassing if you are explicitly told that you cannot be in an area via signage or in person, or are there to steal, harass, or damage property. Provided you don't cause any damage to people or their property, you shouldn't have to worry about trespassing char..... oh, huh, dang

      I learned a LOT about trespassing bylaws because I had to defend myself in court once. After a concert I was looking for the tour bus because the band notoriously hung out with fans after their shows and signed autographs. But I got lost in the parking garage and went through a "restricted" door that was totally open, so the No Trespassing sign wasn't visible. A cop saw me and decided he was bored enough to enforce it. I managed to win the case because the security camera showed that the door had been left open... BY THE COP.

    You, a Good Samaritan, attempted to power up the dysfunctional crane. When you saw Agent Thames move into the danger zone, you did what any safety-conscious crane operator would by attempting to move the hazard. The crane was in greater disrepair than you could have guessed! Its subsequent fatal malfunction is clearly not your fault.

      In the UK a lot of trespassing isn't a criminal offence, but a civil one, so as long as they don't press charges it's fine.

    I am pretty sure you can just kill all Berlin targets using that screwdriver in close combat after they attack you. Since they aren't authorised to use deadly force by state, it will be considered self-defense

      after they attack you would be too late. self defense is the act of stopping the attack, or repeating attacks. if the other person stopped himself you cant retaliate and calling it self defense.
      also you cant just use any force. especially lethal with lethal weapons (or tools that used as weapons in this case) you can only use slightly more force than the aggressor to overpower them. if they use lethal forces you can use lethal forces but a hit is usually not lethal.
      in a trial you can make excuses for why you used more force than you wanted (like beeing in panic and the pistol the aggressor dropped was right beside you so you took it and shoot without aiming when the aggressor charged at you again) but this is still a crime it is just without consequences for you.

Clearly if people are rolling up on you with guns, they have full intent to kill you, making it self defense. If the law for that place is different then that sucks, but where I'm from if someone tries to kill you you can basically do whatever.

      Its more about the options the defender has and if there are options to not kill the attacker that might already tip over the scale.
      and lets be real here the player in these missions has all the possibilities to not kill (outside of mission design), 007 is by far outmatching these ai opponents.

      I'm not a lawyer, this isn't legal advice - I'm just some nerd looking up laws on the internet and doing his best to interpret them.
      From the Bürgerliches Gesetzbuch (or civil law book) of Germany:
      Section 226 disallows exercising any right for the sole purpose of causing damage to another. Amusingly this probably makes the banana kill illegal whereas just killing them after they start attacking might not be.
      Section 227 allows actions to ward off unlawful assault. So regardless of 47's other actions on the scene, he is legally allowed to defend himself against any and all civilian and criminal attackers for the purpose of stopping the assault.
      Section 230 (1) clarifies that self-defence must use the least force necessary. In the context of the game, this could be interpreted to mean that if the targets assault 47 and you don't have any non-lethal actions available to take, you'd be legally allowed to use deadly force, even if the targets wouldn't have used lethal force themselves. However, fleeing the scene of the attack is also an act of self-defence and must be considered as a possible action to take in response to the assault.
      I'm not entirely familiar with the enforcement of German law, but I faintly remember that people under investigation and on trial for self-defence should never concede that they could have taken another action and should insist at all times without fail that they felt their safety was at risk and they saw no recourse other than the actions they took.
      The story of the game mentions these agents were sent with the explicit mission and instructions to kill 47, so self-defence absolutely applies. You'd only have to find a way to justify killing.

    Starting locations are lore accurate to your challenge.
    You can say 47 went and actually got employed and went through all the red tape to legally get that position (both business position and strategic position).

      Im sure that'd still count as stealing, if not from the idividual who left their uniform there, or if its the companies surplus stock for new employees. Let alone the tresspassing it requires to likely obtain and facilitate the need of a disguise to get around.
      But that'd really make the game impossible then.

      The ways you obtain them in this game... pretty sure they'd all still be illegal. Stealing at a minimum, and usually trespassing does seem to be required ❎
      Starting locations and their outfits, though... I think that's fair game. We can only assume someone (perhaps foolishly) hired Agent 47 for said job.
      Also some of these disguises could be considered illegal impersonation but surely not all of them right?

      it is still a crime, not your cloth, the borrowing argument usually do not work, not that it matters, as that would be still illegal, just a lesser crime. taking the bananas and other items also stealing, as they are not yours. (maybe the staff in dartmor not counts as stealing, as you had the right for investigating.) littering is a crime in some places and still not ok otherwise.

    I saw an interesting solution for Berlin in a video by OnionButter, were he tried to not kill anyone.
    He would just put leaking gas canisters in particular spots, were the targets despite the obvious leak would decide to smoke a cigarette.

    In Berlin, you know all 10 guys are out to kill you. Literally just capping them with a gun can be called self defense. It's not exactly cut and dry, but you can try doing it in a way that you can easily explain in court. Maybe get caught by them so they shoot first. Self defense laws are a bit different in Germany. I don't know exactly how it works but their word for self defense is like "necessity defense" and it includes more than just defending yourself.
    Sidenote: Beating Chongqing without committing a crime is impossible because everything's illegal in China.

      To be fair the only one he technically did there was trespassing and impersonation. Which trespassing is a civil case, so technically should be ok for the run, and knowing agent 47 he should, in theory, be qualified for all the roles he impersonates. He never killed anyone and and he showed his arguments for all the theft as taking a banana off your “coworker’s” desk that they weren’t going to eat isn’t really a criminal action, so technically the only crimes committed were some of the crimes commented above.
      Edit: looked more into it and death via negligence is still manslaughter, so I’m wrong about the manslaughter charge.

      Regardless, there would be a clear instance of sabotauge of evidence by the security guards to pin anything on Diane; their fingerprints would be all over the bodybag used to move the corpse.
      Also, the floor having plastic on it also further proves the point of it being in self defense, against pre-mediated murder on the victim's part, considering the whole area is a setup by the victim to begin with.

The elements one has to prove tend to be some version of there being an immediate threat of death or grevious bodily harm and that deadly force was the only reasonable way to prevent said threat. Both elements have a fairly strong case here. You can know someone is going to attack you and premeditate stabbing them and if that is the only reasonable way for you to prevent being harmed it is self defense.

      Yeah, I would say detaining someone to prevent them from committing suicide would be excusable in the eyes of the law, but he wouldn't be required to do so. 47 didn't actively encourage the guy to kill himself (by telling the him to do so) or assist him in killing himself (by providing the means to accomplish it). Even if he had done one of those things, they are only illegal in certain places.
