    I have a neighbor who lived three houses away and has so many cars every time when I come back after 14 hours working my driveway is always blacked. I don't want to call police I was always talking to them and asked to move the vehicles.Every day. Finally I went to township and I find out you can't park 5 ft from apron each side of a driveway. I also ask public work to install do not park anytime sign. When my neighbor was still parking this time I can call police and towed their vehicles. After that get quiet but my neighbor never talk to me and I really don't care.

Like dope dealers on one side of me, and an obese fourteen year old on the other side, who pounds up their wooden stairs like a water buffalo.     I don't understand why the plaintiff continued to park in that spot knowing she had issues with the defendant that resulted in mutual police calls. Continuing to park there seems like antagonism. Can't be too upset she did it again and got towed.

She was trying to prove she was the better person by saying I have to be at work and not moving the car well the defendant had things that she needed to do and the plaintiff's car was blocking her so I say then defending keeps calling the police until something is finally done to stop the plaintiff from doing that

      that old street smart lady knew that all she had to do was tell the cops she lives there and its a driveway and the cops would not argue and agree with her and just issue the ticket so they could move on with their busy day . plaintiff should have easily won this case and its a shame that judges are so conditioned to by default go with whatever the cops write down even if its legally incorrect . the street wise defendant knew how the system worked and she uses it to her advantage

    Plaintiffs attitude is horrid, belligerent, and arrogant. Defendant needs to go to get a “legal law description” Title Search 11:39 at the courthouse of the county, from the date of house built. Defendant was nice enough to ask her please not to park there, she needed to go out for the day. Plaintiff was very contrary therefore, she got a tow.

      LMFAO....Did we just watch the same case? You obviously do not live in NYC or Northern NJ where you have to drive around for HOURS looking for parking. You can't make up a driveway that does not legally exist. Going into that woman's car and her neighbor's reaction tells me who the defendant is. What kind of car is she parking in her "driveway"? She can fit a motorcycle in that space at best. Also cars were only bigger years ago. When you have a life people have no time for this type of nonsense. I bet she puts a chair in the street when it snows to save her spot which is also a big no-no.

      So what? It's not a legal spot! I'm sure if there was plenty of parking by the school, they would park somewhere else. But would you choose to park close to the school in that spot or walk a couple of blocks because somebody has a gate there and decided to make their own driveway? Clearly, instead of actually doing his job properly, the cop just blindly believed this woman. He clearly didn't even look for a driveway cut in the curb. The judge made a wrong choice here and in an identical cases later, she corrects that choice and finds for the plaintiff (different litgants, same situation). Tickets were given in those cases too, also by lazy cops not doing their job properly.

    Legal driveway or not, you’re blocking someone’s gate that they use to park their car off the street so I can get why the cops ticketed her. If I’m parking anywhere I’m always mindful of parking in front of a gate whether the sidewalk is cut out or not because what if there is an emergency and someone has to go in and out?

    Okay…the plaintiff didn’t win because the cops were too obtuse to really notice the ‘Karen’ DIDN’T HAVE A DRIVEWAY. The defendant ‘Karen’ realized though (she was bright enough😲) she DIDN’T HAVE A DRIVEWAY and had NO GROUND to act the way she did. I feel very sorry for the plaintiff to have dealt with inept cops.

      I think that the issue lies with the ticket being dismissed but not by merit. Even though I DISLIKE it, a judge shouldn’t just so easily subvert law enforcement decisions. And had that ticket been dismissed with merit then I think that JM would have done right by the plaintiff.

    I'm SOOO happy with this ruling. The Plaintiff is a nightmare- seriously, "she interrupted 1200 students"... whatever. If someone tells me I can't park in front of their house- even if I think they are wrong- I won't park there. I wouldn't want to leave my vehicle in front of someone's house who is angry with me! And the Plaintiff trying to sue for damages to her car the towing company allegedly did?! What a joke. This Plaintiff is a nightmare.

    The Judge got this one wrong. That was obviously an illegal driveway and the fact that cops issued the ticket proves nothing. You have to to remember the Cops do not check city records to see if its legal or not. IF it halfway looks like a drive way cops will issue the ticket. They do not check city records to see if its legal. They are strictly going by what the home owner told them. so the responsibilty should fall on the defendant for calling the cops and telling them that someone was parked in her illegal driveway

      @@SilverSergeant Not in the city in this scenario. The defendant even said it wasn't a concrete driveway until her father paved it over after removing bushes. They needed permission from the city to do that properly, otherwise her father inherently paved a way to the sidewalk.

    I 1000% disagree with her ruling!! This one actually really bothers me, usually even if I don't agree with JM I can still see where she's coming from. This time I think she's dead wrong and being hypocritical! She has stated MANY times that she does not have to rule based off of the police actions or their conclusions and has disagreed with police findings in the past.. furthermore police make mistakes all the time, thats why we have a judicial system! The only job the police have is to charge someone the court decides if it's going to stick, whether or not a law was actually broken, and if a person is responsible. Some of the plaintiffs best evidence was that she got her ticket dismissed and couldn't she argue that the police never would have been there or ticketed her if the defendant didn't call them to come because even the judge said she doesn't think it's a driveway.. so knowing all this I can pretty much guarantee if a cop was driving through and saw her car, they would not have given her that ticket. She only got that ticket because the defendant told the police it was a driveway!! So I 100% believe the defendant is responsible here especially because you can tell from her testimony that SHE KNOWS she doesn't have a legal driveway!! She literally said her dad just decided to put down cement there with no authority from the town, she knows the curb is there and should be cut, she has gone to the town to "try and get paperwork" is her story yet never got anything but the plaintiff has PROOF they applied for a driveway and were DENIED! So yeah she straight up knew it wasn't a legal driveway and called the cops and tow truck anyways! Not to mention the defendant was a little sketchy when testifying.. JM caught her in a lie about the driveway "always being there since the 20's", she said she didn't remember on things she thought might work against her so she didn't want to admit to it until she realized it would have been in her favor and she suddenly starts remembering stuff, also she was kind of dodgy on answering some of JM's questions. And I thought the plaintiff came well prepared with plenty of proof, that normally JM would be super happy about, but it's like she just felt bad for the defendant or something and just disregarded all the evidence and found an excuse to rule against her because at first she said she only needs to determine ONE thing, whether or not it's a driveway, which she AGREED it wasn't! Then at the end she did a complete 180 and said she needs TWO answers all of a sudden, whether it's a driveway AND did the cop ticket.. which we already know shouldn't even be relevant.. I just don't get it!

    Judges are not obligated to agree with the varying biases of police. If the cop was unaware of permits and laws to the degree that the existence of a driveway comes down to opinion, that cop seems very under qualified to issue a ticket. The plaintiff should have won. At the very least dismiss the case without prejudice until they determine the official status of the driveway.
    Plus, people are shocked at how rude the plaintiff was for parking in front of someone's house, but what about the defendant rummaging through the plaintiff's car? I don't buy that her car was unlocked, open and happened to have her own phone number on a paper on the seat. That's absolutely ridiculous!

      Now genius, how could the plaintiff have won this case when all she did was call the cops and the cops decided to give a ticket and tow the car that the city thought was illegally parked? are you that nuts or dumb!
      So what you are saying is that, if someone thought a person was breaking the law , called the cops , then the cops show up, use excessive force and violated that person civil rights, when the victim is suing the city, they should also sue the person for making the call because if the call wasnt made, then the cops wouldnt have violated that person civil rights. ?     A lot of people in these comments seem to misunderstand the difference between whether someone should be considerate to someone else, vs what is legal or illegal. Would it be nice if the plaintiff took into consideration that the defendant used that area as a driveway? Yeah. But is the plaintiff wrong in a legal sense? No. Technically the defendant should be looking for parking on the street the same as everyone else.
    That defendant stated her father decided to remove bushes and connect the house to the street by paving over. There are lots of houses in cities that don't have driveways because they are all meant to park on the street (or pay to park in lots). Especially since many were built prior to cars being so prolific. All he did was connect the house to the sidewalk and call it a "driveway" while attempting to enforce it with a store-bought sign. In order for it to be official the city needs to grant permission. Just because the defendant is willing to constantly jump the curb that doesn't mean the cops should have issued a ticket. The plaintiff really lost because the police didn't pay attention, they probably also looked at the "no parking" sign, shrugged, and went with it since that's easier that trying to argue with a woman who's lived in that house her entire life and honestly doesn't seem understand why she's wrong.

    I’m just assuming that the house was there before the sidewalk and a “real” road and people would just drive/walk up in the yard. It had a gate and other things that would make a driveway and they just never cut the side walk for said driveway and wasn’t thinking about it. Just my guess. Since there is a gate I wouldn’t have parked right there either tho. But that lady may want to get the city to get it right so there won’t be any future issues

      No, the verdict is 100% wrong. And in later cases, with different litigants but the exact same situation, she decided against the person with the illegal driveway. They got a parking ticket by a cop not doing his job properly then too. They need to teach the cops a lot better how to do their jobs properly.

    The defendant 🤡besides having a case of convenient amnesia is incredibly rude, the way she dismissed and walked away at the end. Nevertheless I can see a valid case on both sides, but anyone looking at the gate/driveway could assume this is a driveway or I should say have common sense not to block it (judging from the pics) not like anyone driving around will know if you have the city permit or not, but the defendant knew that permit was refused smh.

      NO, it's an illegal spot, that never should have got a ticket in the first place. You can't just make your own driveway, an illegal driveway, and tell people they can't park in perfectly legal spots on the street. If that driveway was denied, it's probably because the street parking is so packed there, and it's needed. If the cop would have done his job PROPERLY and looked to see if there was a cut on the curb, she wouldn't have got a ticket. In later cases, the judge decides against the defendant (different litigants, exact same situation). And they got tickets from lazy cops not doing their job properly then too.

    This parking situation is ridiculous! In Texas most schools have a reasonable amount of parking, so it kind of blows my mind how often I see parking cases, especially when there's extremely limited parking for teachers and staff like what does someone do if they literally can't find parking near their job? It also blows my mind that anyone would knowingly leave their vehicle unlocked in this day and time, lol!

      The defendants family was selfish in creating an illegal driveway that only benefits themselves. It not only takes away public parking for the community but they also didn't pay for proper permits which is essentially stealing from the state of NY. Being decent isn't the LAW. There's plenty of examples (like while driving.) If we're driving in opposite directions & you need to turn left (in front of me) I COULD be a decent person & slow down & signal to you to go ahead but I still have the right of way under the law. If you just assume I was going to be decent & let you go, but I hit your vehicle it's YOUR fault for not yielding. The plaintiff definitely shouldn't be out the money & since she lost this case, I'd be filing against the police department.

      I think the house was there long before. Everything popped up around them. I hope the defendant gets it regulated. I'd park on either side of the opening but I wouldn't block it, smh

    I am happy the plaintiff lost. Who tf are you? Let that homeowner have her illegal driveway you never know a persons situation. If it says don’t park there then don’t. Walk a little further it’s not the end of the world. Now it cost you $500

    Who blocks someone's driveway, even if you think it is not a legal driveway?
    At a minimum, you are keeping someone leaving their home, so you are putting your vehicle at risk.

    Why would you park in a spot that looks like a driveway even if it isn't. my driveway doesn't have a curb and it's a legit driveway. I think the Judge ruled correctly on this one

    Police can give you a ticket but it’s the judges job to look further into the truth. I think the judge got this wrong. Facts are facts. Innocent until proven guilty?

What if your neighbor called and said you left a child in your car alone all night. What really happened is you had a birthday gift doll in your car all night so your niece wouldn't see it. The cops come do no investigation and just arrest you. Who's wrong?

    I am very appalled the teacher investigated this woman's house information. If this older woman needs a space to park her car in her yard, the teacher needs to respect that. This poor old woman is supposed to go find parking and be unable to park at her own house. The homeowner should hire the correct professional (architect) or construction company, it will properly file all paperwork to have your curb cut. If you use land for a driveway more than 10 years, it has to be acknowledged as a driveway. The proper paperwork needs to be filed only and cut the curb.

    I don't understand why the police ticketed the teacher when there is clearly not a curb cut. No red, yellow, or other color on curb. To me, she should never have been ticketed it's public parking. That would bother me

    The plaintiff is rude and self entitled and i'm glad she lost the case, shes one of those "the rules dont apply to me, only the rest of the world"! And constantly inconvenieces others by being inconsiderate. HaHa.

    The defendant doesn't seem to be able to recall anything about the incident and, even though her father bought the house in 1972, she says she doesn't own it. Sibling maybe or other relative, but if so, why wouldn't she know about a request by the owner to put in a curb cut? I think she's lying about not owning the place and knows damn well she put in a request, it was denied and now she's just acting as if.

      The defendants family was selfish in creating an illegal driveway that only benefits themselves. It not only takes away public parking for the community but they also didn't pay for proper permits which is essentially stealing from the state of NY. Sure it's nice to be considerate of others. Being decent isn't the LAW. There's plenty of examples (like while driving.) If we're driving in opposite directions & you need to turn left (in front of me) I COULD be a decent person & slow down & signal to you to go ahead but I still have the right of way under the law. If you just assume I was going to be decent & let you go, but I hit your vehicle it's YOUR fault for not yielding. The plaintiff definitely shouldn't be out the money & since she lost this case, she better be filing against the police department.

      @@brandinelson7941 The pavement they put in was probably on their property, so no public detriment there. What they, or the defendant, at least, did try to steal was the parking spot on the street in front of the pavement.
      A private driveway is, by definition, not public.

    The police officer gave the woman a ticket for parking illegally because there was a sign put up by the defendant not the city... so just anybody can decide that this is part of their property and as long as you fool one police officer you can get away with it? That doesn't seem right

    Obviously I have no legal training, this is the first time I've disagreed with judge Milian. That isn't a driveway, the defendant knows it isn't a driveway, and she called cops in bad faith to have someone towed. It's freaking NYC.....EVERYTHING has to be codified. She convinced some dumb cop that there was a driveway, he/she probably just wrote the ticket to be done with her. Defendant is entitled and feels she is above the rules because her family has lived there for a time.
