The problem is Both sides are wrong to some degree. The tenants wanted the report on the roof. The company in this story would only release this to the landlord. The tenants could have called another roofing company to get the report. Additionally they were warned that the company may file a lawsuit. The tenants did Not value the time, stress, and potential costs this could cause them. The business has low ethics and willingness to cooperate with tenants who are concerned about the roof over their heads they are renting.
I love the fact that this is also against Google's Terms of Service, because a business cannot request or force a user to remove a review, or alter their review in any way.

They misrepresented themselves as customers. You should be rude to people that harass you into giving them things they are not entitled to, like dates and reports. Only the CUSTOMER is entitled to such things. They had no business relationship with the company. They were just using up the companies time.
You don’t have to be a customer to leave a review. If you have a bad interaction with a company or representative, you should ABSOLUTELY share it in a review. That’s EXACTLY what reviews are for. They may not have been paying the bill, but they certainly are the recipient of services, and have a stake in the quality of those services.
If they are willing to sue over a one star review. Imagine if you had quality issue with their work or some disagreement. Definitely will stay away from them.

I agree. Before doing business with any company, I always look at reviews. All this couple was asking for was an estimate on when the work would be done. I really don't see the harm in giving that to them. This company is shady.

If you don't want poor reviews, properly vet and train your employees and don't hire sociopaths for a customer-facing position. You're not entitled to good ratings when your staff treat customers like shit.

If you stay professional, people are a lot less likely to get irate. Also, she could have told them she would look into it and get back to them, and find out what information the landlord was ok with telling them, like HOW LONG it would take.

I think you are probably right, since both person called the company and both complained that they are getting yelled at and then the guy admitted that “who wouldn’t raise their voice when they try to give them attitude”. The couple are probably bending the truth by saying real things that happened but is in incomplete. Either way if a company would sue someone just for false accusations. You’ll double check your mind if whether you want to get involved with their service. A very very big mistake that they could have ever done.

The business would have done so much better if they responded to the 1 star review by saying, we apologize for any rude comments made by our employee but our policy is to not give out information to anyone but the owner of the property and could not provide you with information. And then leave it at that. Something sounds fishy though. If the landlord set this up, why would the tenants call about an estimate? Is the landlord charging the tenants? Or did the landlord ask them to call on the estimate? I think the business owner is a bully and possibly the office manager, his bully wife. My opinion, as afforded by my right of free speech. Nothing malicious or false but my honest opinion.
I honestly think it's just a situation that could've been avoided to begin with. I've leased a house before (and I'll never do it again), and a tenant has no legal right to demand timeframes from a contractor the landlord contracts for repairs. It's the responsibility of the landlord to give you that timeframe, or at least keep you updated. I also think the employee that came out to inspect the roof may have incidentally helped exacerbate the situation either because what he said was either misconstrued as call ERS, rather than their landlord, or he thought the tenants were his company's client, rather than a landlord. In the latter case, it's easy for a lower end employee to not know who is the client when it involves a house. They may not have known at the time it was being leased. Then again, not enough information is given in the video alone for me to make a judgement on that either way. It just sounds to me like a situation that could've easily been avoided.

I am a single mom. I don't make much but I make a living selling online. I have people who don't read and then leave a 1 star review which is EXTREMELY damaging to my livelihood. I just got a 1 star review bc the woman didn't read the selection was for a 2" wide or 1" wide bracelet. She thought it meant wrist circumference!? I lost my star seller status and am already not making very much. I have an overall 5 star rating but it still will cost me a lot of money. People need to be more CAREFUL and take reviews more seriously. They are hurting REAL people.

The rep for ERS made no sense. Even if the customer’s intent is to affect business, if what they say is true, customers should have no fear of repercussions. We consumers have the right to know when a company does shoddy work, when their staff are rude or unhelpful. I hope this case impacts the company. They are acting like bullies. Shame on them.
What I found dumbfounding was when you look up what a motion is vs a lawsuit what you learn is that a motion leads to a lawsuit. So at 5:34 the lawyer effectively said was this isn't a slapp anymore because it became they made good on the threat and filed a lawsuit. I also really like how long the lawyer has to pause at 6:10 as he tries to come up with a way to say it's not a slapp suit without perjuring himself. There are many personal Hells, for me my personal Hell is being stuck in a room with a lawyer who keeps arguing with pedantic points because he's full of it.

If a business doesn't want bad reviews they shouldn't post their business on websites that allow reviews. They could also try giving good customer service. I realize there are always some customers who cannot be satisfied no matter what, but anyone reading reviews knows that and takes every review into consideration. This business is way too thin-skinned.

@@stripedtigress well the company may not have to disclose the specific work that’s being done or the cost of the work, they do have to disclose timelines for access to the property as this involves any tenants on the premises at that time. Aside from that, all the receptionist or project manager, whoever had to do was to provide them that explanation and still provide a timeline. Dealt with companies like this in the past, where they feel rudeness is the best way to deal with a customer or anyone who calls in for that matter. If anyone in the business that I work in or my past businesses had spoken to anyone calling even if they were belligerent on the phone they would be reprimanded.
If they lied about a fact within the review it's libel. There are exceptions to freedom of speech, including defamation (libel/slander), yelling fire in a crowded theater, inciting violence, etc. If they didn't lie, the burden of proof is on the plaintiff to prove that they did, so hopefully they will win this suit. Mostly the roofer is just getting themselves a buttload of bad publicity.

When you pick up the telephone, your conduct is a reflection of the business, even if the person on the other end is not a customer. You're subject to review at "Hello."
I'm not a Lawyer, but I am a paralegal, and I know a lot of judges would throw a case like that out in a summary judgment and tell the plaintiff that when you ask for reviews on the internet, you have to take the good with the bad. Also, those type of cases are difficult to prove what the extent of damages are due to one bad review!
The funny thing is that the company got hundreds of one star reviews as a result and the couple received hundreds of thousands of funds for the lawsuit, as well as the law protecting them has gone into effect. That company is doomed.

When choosing a company for services, I am trying to decide how trustworthy the business is, and the best way to make that decision is by understanding how their employees treat people, in general. An ethical business doesn't discriminate when it comes to ethics and respect; they would treat all people equally with the exception that direct customers would be prioritized. But a trustworthy company certainly wouldn't behave unethically towards anyone.

The lawyer is correct. The couple were not the customer to the roofing company, the landlord was. It is possible in that state it would be illegal to disclose any information to an outside party.
Its ironic that the one star review was because of an office worker, not workmanship. Instead of just appologizing on the review and saying we will coach our employees they paid a lawyer to harass someone. That was the dumbest move ever and that guy is someone you wont want to do business with.
The business has a good case on this one. If people start putting false bad reviews on, this couple will find themselves even more liable for damages. I'd suggest not getting involved and making this a worse situation.

The estimate and any subsequent contract was with the owner and landlord. This isn't the first time this couple has tried to get pity for something they brought on themselves. These reviews do effect small family owned businesses and this internet dependent, whiny, entitled generation knows it. They use reviews like a cudgel for payback. It's honestly disgusting. Sadly that is most companies.. HR isn't your friend and they only exist really to mitigate damages to the company. In fact a lot of companies make it where you can't sue them in the public court system and they hide it in fine print or the employee handbook. You won't get hired if you don't agree to it so there's not much you can do about it. It's crazy shit I've just started learning about and it brings light to so many instances I've seen personally with coworkers.
Update: The lawsuit was dropped and the website's reviews were temporarily stopped and the owner told this to a news station "The owner of Executive Roof Services said he has received a slew of one-star reviews after the company's lawsuit against a Vancouver couple who left it a bad review."

You can if it's from someone you never did business with. It's slander. People's Court episode "Ducking Out On A Repair" is a similar case. It's highly unlikely a judge would award the business $112K. The company would have to prove such a loss and it'd be difficult to do.

However, it is typically difficult to find competent or even sub par attorney's who would take a stupid case like this. As you can see though, this attorney is challenged in many ways, so its no wonder he took this case. I would never do business with a company that would sue over a review, even if they felt the review wasn't accurate. Work with the reviewer to make it right! Customers don't leave bad reviews without reason. The only way a company should sue over a review is if they are certain it's a competitor, an ex-employee spreading false information because they were fired, etc. People trying to deliberately harm them by leaving obviously fake reviews should be sued. Not people sharing real experiences!

The coupled threatened legal action first (even claimed to have started the process in his review). They also weren’t customers of the business and wouldn’t at least change the reviews to not claim that they were.

The importance of being polite to ALL people a business interacts with can not be overstated. The 'I'll show them' attitude backfired in their face. She was told to call the office by the estimator. Therefore since a representative of the company told her to call the office, she had every right to call the office. Therefore she had every right to leave a negative review with regards to the rude secretary. Case dismissed.

As a roofing company owner (not in that area), I advise that being a good poker player and using that skill to read reviews of contractors is going to help you a lot. Some reviews are bull. Some are great. Some are even fake. Beyond that, seeing how long they haver had an ACTIVE and valid license to operate, and seeing if they have workman's comp insurance that actually covers employees (some companies if you check them out, typically on the state license board website, you'll see a notation that they claim they have no employees, that is false 90% of the time, 10% of the time or so, it is true that it's a lone guy). If you still are on the fence, ask for contact info of customers who you can reach out to to ask how it went. How long someone has been in business can be helpful but isn't proof of a great contractor.

The problem is Both sides are wrong to some degree. The tenants wanted the report on the roof. The company in this story would only release this to the landlord. The tenants could have called another roofing company to get the report. Additionally they were warned that the company may file a lawsuit. The tenants did Not value the time, stress, and potential costs this could cause them. The business has low ethics and willingness to cooperate with tenants who are concerned about the roof over their heads they are renting.

If you stay professional, people are a lot less likely to get irate. Also, she could have told them she would look into it and get back to them, and find out what information the landlord was ok with telling them, like HOW LONG it would take.

I think you are probably right, since both person called the company and both complained that they are getting yelled at and then the guy admitted that “who wouldn’t raise their voice when they try to give them attitude”. The couple are probably bending the truth by saying real things that happened but is in incomplete.
Either way if a company would sue someone just for false accusations. You’ll double check your mind if whether you want to get involved with their service. A very very big mistake that they could have ever done.

The business would have done so much better if they responded to the 1 star review by saying, we apologize for any rude comments made by our employee but our policy is to not give out information to anyone but the owner of the property and could not provide you with information. And then leave it at that. Something sounds fishy though. If the landlord set this up, why would the tenants call about an estimate? Is the landlord charging the tenants? Or did the landlord ask them to call on the estimate? I think the business owner is a bully and possibly the office manager, his bully wife. My opinion, as afforded by my right of free speech. Nothing malicious or false but my honest opinion.
I honestly think it's just a situation that could've been avoided to begin with. I've leased a house before (and I'll never do it again), and a tenant has no legal right to demand timeframes from a contractor the landlord contracts for repairs. It's the responsibility of the landlord to give you that timeframe, or at least keep you updated. I also think the employee that came out to inspect the roof may have incidentally helped exacerbate the situation either because what he said was either misconstrued as call ERS, rather than their landlord, or he thought the tenants were his company's client, rather than a landlord. In the latter case, it's easy for a lower end employee to not know who is the client when it involves a house. They may not have known at the time it was being leased.
Then again, not enough information is given in the video alone for me to make a judgement on that either way. It just sounds to me like a situation that could've easily been avoided.

I am a single mom. I don't make much but I make a living selling online. I have people who don't read and then leave a 1 star review which is EXTREMELY damaging to my livelihood. I just got a 1 star review bc the woman didn't read the selection was for a 2" wide or 1" wide bracelet. She thought it meant wrist circumference!? I lost my star seller status and am already not making very much. I have an overall 5 star rating but it still will cost me a lot of money. People need to be more CAREFUL and take reviews more seriously. They are hurting REAL people.

The rep for ERS made no sense. Even if the customer’s intent is to affect business, if what they say is true, customers should have no fear of repercussions. This is called a frivolous SLAPP lawsuit and it should be banned in total, with severe penalties for those plaintiffs who file them.
What I found dumbfounding was when you look up what a motion is vs a lawsuit what you learn is that a motion leads to a lawsuit.
So at 5:34 the lawyer effectively said was this isn't a slapp anymore because it became they made good on the threat and filed a lawsuit.
I also really like how long the lawyer has to pause at 6:10 as he tries to come up with a way to say it's not a slapp suit without perjuring himself.

Aside from that, all the receptionist or project manager, whoever had to do was to provide them that explanation and still provide a timeline. Dealt with companies like this in the past, where they feel rudeness is the best way to deal with a customer or anyone who calls in for that matter. If anyone in the business that I work in or my past businesses had spoken to anyone calling even if they were belligerent on the phone they would be reprimanded.

If they lied about a fact within the review it's libel. There are exceptions to freedom of speech, including defamation (libel/slander), yelling fire in a crowded theater, inciting violence, etc. If they didn't lie, the burden of proof is on the plaintiff to prove that they did, so hopefully they will win this suit. Mostly the roofer is just getting themselves a buttload of bad publicity.

I'm not a Lawyer, but I am a paralegal, and I know a lot of judges would throw a case like that out in a summary judgment and tell the plaintiff that when you ask for reviews on the internet, you have to take the good with the bad. Also, those type of cases are difficult to prove what the extent of damages are due to one bad review!
The funny thing is that the company got hundreds of one star reviews as a result and the couple received hundreds of thousands of funds for the lawsuit, as well as the law protecting them has gone into effect. That company is doomed.

When choosing a company for services, I am trying to decide how trustworthy the business is, and the best way to make that decision is by understanding how their employees treat people, in general. An ethical business doesn't discriminate when it comes to ethics and respect; they would treat all people equally with the exception that direct customers would be prioritized. But a trustworthy company certainly wouldn't behave unethically towards anyone.

The truth is these people were not entitled to any information or any report from this small roofing company. They were hired by the owner/landlord to come and do an estimate for the work. The contract is with the owners/landlord...not the renters. Legally, the roofing company, ERS, can not give out ANY information concerning the repairs...to anyone except the people with whom they have the existing contract. These people lied in their review by claiming that THEY requested the estimate. They did NOT. The first they knew of ERS was when the guy came to do the inspection for the estimate. The estimate and any subsequent contract was with the owner and landlord. This isn't the first time this couple has tried to get pity for something they brought on themselves. These reviews do effect small family owned businesses and this internet dependent, whiny, entitled generation knows it. They use reviews like a cudgel for payback. It's honestly disgusting. This woman whined and claimed a receptionist was "rude" to her. So what. She wasn't paying for a service from them. She had no right to demand to speak to her manager. This Business is small and family owned. hey don't have a "manager" or a receptionist. Most likely she wears many different hats and was probably laughing over that fact. I might laugh too. This woman acted like a total Karen with her privilege and entitlement...calling and threatening her with a Better Business Bureau complaint...as if she was actually the one paying for the repairs.🙄😵💫...launching an attack against a family owned business that she didn't even have any business dealings with. Sadly that is most companies.. HR isn't your friend and they only exist really to mitigate damages to the company. In fact a lot of companies make it where you can't sue them in the public court system and they hide it in fine print or the employee handbook. You won't get hired if you don't agree to it so there's not much you can do about it. It's crazy shit I've just started learning about and it brings light to so many instances I've seen personally with coworkers.

You can if it's from someone you never did business with. It's slander. People's Court episode "Ducking Out On A Repair" is a similar case. It's highly unlikely a judge would award the business $112K. The company would have to prove such a loss and it'd be difficult to do.

However, it is typically difficult to find competent or even sub par attorney's who would take a stupid case like this. As you can see though, this attorney is challenged in many ways, so its no wonder he took this case. But judges don't fuck around, and if you waste their time with a stupid lawsuit, they'll dismiss with prejudice. So there is some pressure pushing back on stupid lawsuits. The fact that the timeline of service directly impacts the couple’s life, means they are customers, regardless of whether they are paying or not. This is why it was relevant for them to ask for that information.

I would never do business with a company that would sue over a review, even if they felt the review wasn't accurate. Work with the reviewer to make it right! Customers don't leave bad reviews without reason. The only way a company should sue over a review is if they are certain it's a competitor, an ex-employee spreading false information because they were fired, etc. People trying to deliberately harm them by leaving obviously fake reviews should be sued. Not people sharing real experiences!

The coupled threatened legal action first (even claimed to have started the process in his review). They also weren’t customers of the business and wouldn’t at least change the reviews to not claim that they were.

She was told to call the office by the estimator. Therefore since a representative of the company told her to call the office, she had every right to call the office. Therefore she had every right to leave a negative review with regards to the rude secretary. Case dismissed.

Yup. The reviews probably did no actual harm. The lawsuit and subsequent news coverage absolutely has. I will never do business with this roofer. And that lawyer is the kind of lawyer that lawyer jokes are about.
As a roofing company owner (not in that area), I advise that being a good poker player and using that skill to read reviews of contractors is going to help you a lot. Some reviews are bull. Some are great. Some are even fake.
Beyond that, seeing how long they haver had an ACTIVE and valid license to operate, and seeing if they have workman's comp insurance that actually covers employees (some companies if you check them out, typically on the state license board website, you'll see a notation that they claim they have no employees, that is false 90% of the time, 10% of the time or so, it is true that it's a lone guy).
If you still are on the fence, ask for contact info of customers who you can reach out to to ask how it went.
How long someone has been in business can be helpful but isn't proof of a great contractor.
