Hi everyone, thanks for watching this week's video on OSHA's new inspection rule! How do you think this will impact the dynamics of OSHA inspections?

I doubt our employees will want a representative but I think this will be a big issue in union shops.

I agree with it being big for union shops. I also think in just a random basic inspection it would be no big deal, but if you had an amputation, death in the workplace, or major 'at will' violations, it might be nice to have legal reps walking with you as you answer questions and such, which you might not have had before.... 😬🤷‍♂

      That’s a good point I hadn’t considered before…

Great explanation. Remember, you only have a reasonable amount of time for the participant to be there and actually participate. This does not allow anyone to take over the inspection, it simply allows them to be there to answer questions. This rule was already in place as you said, they have just broadened it.

I am a safety manager and we are part of the volunteer program. When TOSHA comes by, we will go out to one of our buildings. I always contact the safety rep from that building to assist in guiding us through the facility. I believe involving employees in all aspects of safety contribute to safety culture. The new rule doesn't surprise me. I would recommend using employees instead of outside third parties. Employees will give better assessment and an employee point of view which promotes overall safety.

This sounds like a really positive, collaborative approach.

You as the safety manager don't have that option. Now the employees can select a 3rd party union organizer to be their walk-around rep.

Remember when OSHA tried to mandate the covid vaccine and millions got it cause they thought they had to until the Supreme Court shot it down. How many vaccine injuries did that cause? OSHA NEEDS TO GO!!!

It depends on the course but generally it's acceptable unless it requires and in-person segment like HAZWOPER or Forklift Operator Training.

I don’t think it is a big deal. Remember the compliance officer to decide who should and should not go. If he felt someone would not be appropriate, he can dismiss the person.

I agree in most ways but I can see issues where there is an abrasive relationship between leadership and employees. The poor compliance officer could be left playing mediator and inspector.

Another reason to run a tight ship with safety, and not just because of seeing OSHA as the "boogieman" or as "laughable" - seen the two types of demeanor from employers.

I agree. The perceptions of safety can really influence an organization.
