    I was all about the Smb3 rom hacking scene back in these days. Kind of remember this one…we didn’t really have playtesters back then because all the playtesters were also creators & we didn’t want ppl to steal our ideas. We typically posted updates one world at a time and that’s how it was tested-through feedback on the forum. Hardly anyone ever actually ‘finished’ a hack, though. If it’s 1999 then the levels were probably edited with m3i, which was VERY primitive & you could not add or delete sprites or enemies to a level; you could only rearrange the existing sprites. So in a level like 5-9 for example, there’s not much that could be done with a level like that because there’s barely any sprites at all (the moving platforms are classified as enemies). So, level design was an extremely tedious process that often ended in sacrifice and compromise & most romhacks back then were just hammer Bro/flying fish takeovers of minimally altered existing Smb3 levels, while doing stuff like 2 or 3 boom booms in forts to make it more ‘challenging’. The graphics are phenomenal here at least. The frog suit level was great but I suspect he got frustrated with the amount of labor required to make a good level and his interest dwindled from there.

      Man, I just missed stumbling on that scene by inches. I was into emulation and I was checking out hacks but I never found a community. I would have been hooked!

    Also, with the overworld, we had to preserve all the spaces you could access in the original game because the airship would fly to spaces based on the original map and if there wasn’t a path to those spaces, you couldn’t continue. That’s why there’s that dead end/cul de sac area in the south end of the W1 map. It literally took years for anyone to figure out that you don’t actually need to have an airship at all!

    "Boring difficulty" was the trend back then. I'm guilty of it myself, and I'll make fun of myself for it. At least this one looked nicer than a lot of other, similar "boring difficulty" hacks from hack in the day.

  • @GTA2SWcity
    @GTA2SWcity 2 ปีที่แล้ว +7

    Yep, VERY reminiscent of the time period. I remember I saw this one available on a rom site back in the day but it got taken down before I could DL it. 20 years ago haters and Nintendo were very trigger happy about firing off DMCA or whatever copyright complaints so ROM host sites were very hit or miss. Same with vidya music host sites.

    • @T3n50r
      @T3n50r 3 หลายเดือนก่อน +1

      I think the only reason romhacks still exist online is because of laws regarding copyright. As long as hacks etc. isn't for profit and original systems are used (like NES etc.) you're free to modify what you've bought. It just can't be done for piracy reasons, and Nintendo can't exactly tell who owns SMB3 and a NES and who don't. I'm not sure about the US but EU is pretty strict when it comes to consumer rights. Romhacks is in a strange grey area but legally nothing wrong is being done as long as it's only shared among people that also owns a NES (but how do you check for that?). Music sites is a different matter tho, that shit can get taken down way faster for legal reasons etc.

    • @GTA2SWcity
      @GTA2SWcity 3 หลายเดือนก่อน

      @@T3n50r In USA there's a limit on copyright. I think it's about 25yrs. Unless you pay the renewal fee for retention of the intellectual property, it goes public.
      But even if renewed (which most haven't been) it's still kind of superfluous.
      So checking for "who owns what?" is almost nigh impossible. Because it's from an entirely different era where you actually owned the hardware. While they still own the i.p. trademark rights, there's no registry and no record of who has what. Only maybe record of sale.
      With things being what they are today, trying to obsolete anything using analog RF coaxial cable and/or digital RCA cable, what have you, ownership is being limited to a very niche segment of the population. So the only reason the government would come after you for this is if they have other reasons for coming after you. To help kind of tack-on charges for putting you away. You'd have to be really notorious for that, or have other charges. (At which point it becomes obvious that commerce laws for the commerce types NOT covered under contracts is just a government revenue racket).
      Plus the "reproduction" game crowds of retro console systems is a thing because we want to play some ROMhack masterpieces on genuine hardware. (I can point you in the direction of the programmer to do that and resources).
      Plus you are allowed to make an archival backup copy of your own games from that era--but they don't tell you exactly how you can do that. Hence ROMs of the games exist. The hardware is nothing too special--as I have figured out.
      In repro circles the only thing you can charge for is the service of converting donor cartridges or buying homebrew. And sometimes repro refers to reprogrammed cartridges and not just reproduction of the old games.
      So basically that's where this situation comes from. How else do you play your game archive copy besides genuine hardware? Emulators.
      Nintendo doesn't have a budget for litigious harassment of people like taxpayer funded government agencies can. And even only then it has to be _worth_ trying to ruin you legally.
      Hacks are a legal grey area for sure. But the moderators and admin don't know what extent it is or is *not* valid. Hoping to just avoid the trouble they comply with takedown requests. Unfortunately the onus is on the uploader to "prove" their innocence to company policies enforcement.
      If you're like I am, then you get doggedly possessed to clarify it and drive it into the ground. Bureaucracy hates me because I bust their butts.

      @@GTA2SWcityYe, but that's the US. Super Mario and Nintendo is owned by Japan, and they have to follow EU laws and regulation for distribution and legal matters. They can't close down or legally go after a site that bases itself on modifications of hardware owned by people in the same way Converse can't go after people painting on their shoes and willing to paint other peoples shoes the same way free of charge since no profit is gained from it. It's creative commons law and freedom to do what you please with a product you own at this point, and not redistribution or similar.
      Romhacks site isn't US based either as servers are based elsewhere if I'm not mistaken unless the same goes for the US as well, so to go after them they have to follow the laws regarding that region. 25 years or not, romhack sites were up and legally ran 20 years ago as well. Nintendo 100% have the budget and go after anyone they can if they're able to, people have been shut off from Etsy and whatnot. Japan is pretty strict and litigious about their products and will protect it to its hardest degree if they can, just look at Pokemon. No doubt in my mind Nintendo LOATHE SMW Central but can't do anything about it because laws and consumer rights.
      Or am I wrong about something here? Feel free to correct me and direct me towards sources if I'm wrong, but this is what I've been told.

    • @GTA2SWcity
      @GTA2SWcity 3 หลายเดือนก่อน +1

      @@T3n50r I was just clarifying.
      Probably best to look into the laws, you don't want to leave it to chance.
      Yes actually that is correct about romhacks being under creative commons AFAIK internationally. Nationally it's the same thing here in USA. So long as there isn't a charge for _the rom itself_ then even on repro sites it isn't really breaking any laws. So anyone doesn't like it, romhacks on repro carts, they can kick rocks.
      Now if it's an original ROM and the IP owner still has the copyright license that's another thing (usually because of a desire to sell it again digitally on current gen consoles). In which case Nintendo does very much have the power to pursue trademark infringement. That's explicit violations.
      However the archiving issue (where this all comes from) was for compliance with consumer protection here in the USA at least. I can't personally speak to whether that's true anywhere else but I would presume the same thing.
      That's kind of where the whole "don't download it if you don't own it" cane from but unless you are going to use digital forensics on everyone who ever downloaded it when they technically have some right to do it, that's not going anywhere, hacked rom or not.
      How are they going to prove whether or not you own it? Short answer: they can't.
      I think people getting shut down on etsy either aren't differentiating their product enough (like selling repros of original games), or it's frivolous petty reporting. As much as I'm sure people want to shut down mousebite labs, you can't shut down a guy selling printed circuit boards for repro. Nintendo already knows that is a losing fight because if they are going to hunt down people selling electronics components to create allegedly "counterfeit" or ,"derivative" product, the judge would laugh them out of court for two reasons:
      -Their own A203 is a generic version of the processor 6502 with some copyrighted features disabled in order to avoid having to make royalty payments to Yamaha.
      -components sold alone do not comprise the whole thing; so their argument of counterfeits would require proof of harm just like downloading roms when you can't verify game non-ownership, their arguments of derivative works falls flat if it isn't for profit.

      @@GTA2SWcity I see, I now understand the whole thing a lot better now thanks to your informative reply. I appreciate it a lot that you took time out of your day to write this down and explain it to me :)
      I find all of this very interesting tbh. Especially in terms of laws and where servers are located, how each country got to navigate through that + selling products in a digital age where it can be abused and whatever else consumers and pirates alike use these intricacies for themselves.
      Have an amazing week, and thank you once again for explaining it to me in detail how it works in the US and in relation to Japan/Nintendo.

    The idea of Peach saving the kingdom while Mario is on vacation is kind of adorable. Shame about the...everything else. My favorite kind of game design, making everything dark so the enemies are barely visible.

    When it started I thought it was going to be really cool, then the first cheep cheep and hammer bro level started and I thought it was just hot garbage, but then, when I saw there are not more than three worlds modified... This is just an unfinished project, probably the first world was the only one tested and there's a high chance that a lot graphics and colors where just placeholders.
    If I knew how to mod Mario 3, I would definitely pick it up and finish it, because I like the concept.

    I was on board with this hack up until the hammer bro spam, and then I was just laughing from WAY off the board when I saw the laser coming from thin air.
    It's a bit mystifying, if you're going to go through the effort to make new and interesting sprite changes, which could NOT have been easy in 1999, why did they stop giving a crap about good level design so quickly? (I do see AlligatorArms' comments, those are helpful.)
    In some areas this hack seems well ahead of its time, but in the stuff that matters, it's just garden variety, early cheap difficulty spikes.
