how specifically different is Texas Real Estate from California Real Estate? im taking my exam prep and i sleep through it all due to the fact that they are sooooo DAM BORING, but i love how you are high energy and how you explain things and it seems all very the same so im wondering if i could take your exam prep class online or would it be very different?

We are unfamiliar with what is covered on the Texas State Exam so we can't say if our California based State Exam Prep will give you sufficient study material.

Memorandum of Encumbrance is a charge registered over a property's certificate of title which creates a security interest over that property in favor of a third party for the performance of an obligation. In other words, the person who is given the property will also encumber any encumbrances on the property. Hope this helps answer your question and please let me know if you have any others.

Thanks for asking this question. A homeowner can clear some encumbrances on their property. Not every encumbrance is permanent. Knowing this, some people might be interested in a property with an encumbrance because they could use it as a leveraging strategy to buy the property at a lower price. That being said, some people seek out houses with encumbrances on them because they want a property that is encumbered. For example, some people will seek out a property with Deed Restrictions on it because they want that uniform suburban look in their home. They wan to move to a neighborhood where homeowners have restrictions so they can't modify their houses. Awesome video! The definition of Encumbrance is a lot clearer after viewing this video. I'm currently studying for my NYC Real Estate Cert. if you don't mind, i have a question for you. My book defines Encumbrance as an interest in and the right to real property that limits the legal owners freehold interest, which i now know is ownership of property for an unlimited period. so my question to you is, Does the Encumbrance allow an entity to take possession of an individuals property?
They tend to be. But in some cases people like it. For example, Deed Restrictions are liked by some people because they enjoy the cookie cutter suburban life.
The property owner does not wish to sell property to the state. The state wants the property in order to build a straight road. If the owner and the state cannot come to an agreement, the state may acquire the property through A) eminent domain. B) police power. C) escheat. D) condemnation. Why the correct answer is not A) eminent domain ????
