    13:45 Would the defendant have any recourse against the city/state for wrongful arrest / false imprisonment/ etc.? Seems like there should be some recourse for upending someone's life and reputation simply because the officers refuse to update their systems to modern technology. Guarantee there is some money in the budget for it that was spent on less-critical items.

      I agree. And hate that there was no apology for the mixup but a suggestion to take steps to avoid this from happening again in the future… for him to take. Total lack of accountability

      Unfortunately there isn't. You would have to prove malicious intent which is virtually impossible.

      @ I guess I’m not following the logic. If something rarely occurs then it’s no big deal? I mean I agree that it’s not something I concern myself with on a daily basis due to the rarity of occurrence, but I imagine it’s a pretty big deal to the people it happens to.

    I feel sorry for what happened. But, why didn't he say he had purchased a gun safe, maybe donated to a charity for people who have gone through a child loss, etc, etc. All things that show he gets it.

      The judge ordered his guns to be removed in his first court appearance with Judge Fleischer. It is on another video awhile back. He can no longer own any weapons. plus since his original appearance the judge also ordered other things for him to do. CPS has been active with him and his family from day one.

    My heart breaks 💔 😢 for this family. I pray for him and his family and may hid daughter 🙏 RIP🕊...This father will forever in prison in his mind for the negligence of his actions. Judge Flieisher made the right decision and show mercy to this father. His lawyer is a great man. Thank God for Judge Flieisher and this loving lawyer.

    My kids had a Snow day today so that means they are home... I'm standing here in my kitchen making them french toast watching this video... I remember watching him the first time when he appeared for prelim, thinking...,Oh my God, wow, unimaginable.... Today, I'm watching this video, The chills and the tears that I feel....no words. The judge is 1000% correct, there's no other punishment worse than having to live without your child due to the negligence that was avoidable.... My heart goes out to them. Hugs

    49:00 you know what it would definitely still be in his system lol the judge is pissed. I do think it’s kind of funny because it happens to me as a mom too when you’re ready to lay down, but you realize it hasn’t been long enough.😂😂😂😂

      From what I’ve seen in other videos, my understanding is that one child shot the other while handling the gun. The child died.

      Guns aren't the issue, they NEVER are & never will be. What it actually is bad parenting & not teaching proper gun safety to the kids. I grew up around guns since I was born, my dad drilled it into my head how dangerous they are since I can remember. He also took me out back & let me shoot watermelons & he said "it will do the same thing to a human body". That visual of seeing the watermelon exploding & imagining it was a person instead of a melon really drove the message home. If more parents would take the time to do what my dad did with me. Shit like this would happen once in a blue moon hopefully. Now I understand kids will be kids & want to show off to their friends. But at least with them being taught proper gun safety & how to check if it's loaded or not. Then at least every parents worst nightmare wouldn't happen.

      Why do you have a doggo in your profile pic? Doesn't seem overly professional... More seriously, the person isn't in front of the judge during that case, aren't disrupting court ,and appear to be comforting the dog. So it doesn't appear to really be an issue

    For any people that question the judges decision...
    Ask yourself, if that child was on an ATV, bicycle, amusement ride, etc
    Would you call for throwing this man in prison or look at what this tragically is..an accident that could have been prevented???
    If you think he should lock him up, then why haven't i heatd anything on the multiple ATV "accidents" in Harris county just in a 3 month period in Harris county???

      Maybe those cases go through other courts within Harris County. This judge has specific areas he covers, theft, drugs, alcohol (DWI) domestic violence. I believe Judge Fleischer was asked to preside over this case of the father who's child died with his getting ahold of his loaded gun. It was mentioned in his first appearance before with Judge Fleischer.

      Theoretically it could, but it's kind of grasping at straws.
      Unless you're actively exercising while focusing on a small area at a time, you're not likely to burn localized fat fast enough for it to release a similar amount as if you smoked the day before... but a cheap and quick test that's too sensitive, could still come up positive.
      She asked for metabolites, which would reveal whether there was a plausible correlation between fat burning, and THC release/breakup.

      It was a Hail Mary his lawyer tried to throw. He tested at over 2000ng/ml on the wiz quiz. The National Highway Traffic and Safety Administration says 100-200ng/ml is routine after smoking and it quickly dissipates. Bro was over 2000 ⬆ That's like daily heavy user levels. 😵‍💫 Then it drops to 125 which means he's not using and his system is flushing. Then it goes up to 350 which means he smoked, not exercised. When it goes back to 2000 that ain't the gym, that's because he back to heavy daily use. He's using and he doesn't care.

    Its a horrible accident and I do feel for the family but the only thing they keep bringing up is that he is the sole supporter not that he did something that resulted in a terrible accident. I don't know but I would have gotten rid of the guns after that. I also don't know if he said something about what I brought up. I am just talking about what I see here.

      This judge always has to tell the defendant if you are here illegally, you will need to talk with a Immigration Attorney. His attorney has been helping him. I believe he and his family are here legally.

      The reason the defendant had to have his guns taken away was because a crime has occurred in the home with children involved and a death of one of those children.
