Nintendo may be using the time to collect evidence and form proper evidence. Nintendo are very strict about there older games even to the extent of suing mutiple rom hosting sites for disturbing their roms so yeah hopefully he does get sued.

Honestly, when I first saw the Soulja-Console, I thought, _There's no way this shit can be real, right?_ Sure enough... it was a THING. You are not as informed as some of others on the matter about how he is selling it. It is called “Drop shipping” and he is solely buying from a chinese website. People are confident it is called AllieExpress. He is not buying it from eBay or Amazon or whatever. This is not to say that you cannot make a video criticizing the moron, but there could have been some more research done on your part.
My bad, every article I read about it and the way it looks on his website led me to believe he himself was selling them. Regardless, probably illegal to promote illegal products.

My guess is they will handle it like someone importing or acting as a proxy for any other counterfeit good. Purses and shoes and all sorts of other accessory brands are counterfeited in China all the time and american importers have been charged with that numerous times - granted they actually were holding the merchandise themselves here to sell in person though. Likely if these machines didn't come with roms he would be safe because at that point he's just acting as a proxy to sell hardware(although emulators have cause legal issues as well see Connectix VGS or Bleem) but those roms are painted a target on him. Nintendo just sued people over that haha.

Though Fanta, I'm pretty sure he can't be sued or at least Nintendo is having a hard time finding a legal case to go off as Soulja Boy is merely drop-shipping the products which are being developed overseas in China, whom of which cannot be sued. If he does get hit, it may be by a fine but nothing for jail/prison time.
He is still the one selling them through his website. If he was just promoting it he might be legally fine. Either way, he deserves the full extent of the law after all his shitty behavior.
