The sentence does seem excessive, however, I was not present and therefore did not see exactly what he did or did not do. The short video clips that I have seen showed him arguing with the police and failing to move on when instructed to do so. He was in the middle of a riot. What would you do in such a situation? Personally, my action would have been to get out of there as fast as possible. He didn't do that and therefore it can be assumed that he was taking part in the riot. You don't have to be the one actually damaging property to be part of any criminal action. (In the same way, if a gang harasses someone and one member shoots that person dead, ALL of those taking part would be charged with murder, rather than just the one that pulled the trigger.) He was convicted of taking part in a riot as opposed to the lesser offence of disorderly conduct. My understanding of the law (I'm not a lawyer) is that a prison sentence is mandatory for a conviction of rioting. So, was the sentence excessive? Probably, but it was in line with other recent public disorder offences. This brings us onto the next point about his death. Well, it's very sad, but he did take his own life for some reason. Maybe he had undiagnosed mental problems or maybe he reckoned that, given his age, he would die in prison anyway, so better sooner, rather than later. We'll never know. But you can't pin the blame for that on the Government or the justice system.

A few years ago - I was involved in a case brought against a total of 4 coppers involved in the arrest of a white gangster. One copper was charged with manslaughter and the other 3 who organised the operation to make the arrest were charged with misfeasance in public office. All were cleared after 3 days on PII grounds - Like Kaba - the state has to be seen to be acting in a way that appeases public concern - the CPS can claim that they have done all they can and then blame the judge and/or the jury for what happens next. Because Kaba is black, the case was always going to go down to the jury in the knowledge they would find him not guilty. The state will always make sure they cant be blamed - its all corrupt

Chris Kaba was trying to evade capture, using a car as a potentially lethal weapon, the police had to stop him. What the guy had done previously, is irrelevant, he was quickly found guilty, by the jury, based on this event alone.
Paul Britten, defence solicitor, talks about shooting to wound. This is nonsense. You shoot to immobilise not to wing. You always aim at the largest part to ensure a hit. Body or head does the job. Otherwise you’ll miss and the car will continue as a lethal weapon. That’s why police are armed in the first place.
If you want the police to stand trial and not keep there identities secret you should definitely change the law so all the world should be told of criminals past before any court hearing
I see Nigel's point but it lacks understanding of the legal complexities of the case. It was entirely correct that the case was brought as it called for a thorough examination of the evidence in public. Imagine if the decision had been not to prosecute. It would have given the Kaba family all the ammunition they needed to say the system looks after itself, and there is a cover-up. It is not the Prosecution Service to express sympathy or take a side. It looks at the evidence and brings a case and the jury decide. That was done.
I’m undecided on this one. Seemed like the gunshot was a little premature imo, they had good sight on him and blocked the car in - hands were on the wheel or there abouts. Just wonder if every opportunity was given to preserve life while effectively carrying out a police stop/arrest. If more time had been given it may have been the same outcome but just makes you wonder. Incredibly tough call for armed police and would not like to do their job.
It was OTT and brutal. 17 seconds after the start of the incident and car moving to firing and the fact the car was stuck, with officers out of the way too, before shot fired, changed the game. The decision by officer Blake wasn’t to preserve life and he should have reassessed the situation….Likelihood is they pull Kaba out of the car and hello prison cell. The issue is the jury, public, media and politicians are unsympathetic to prioritising the rule of law and use of lethal force of firearms officers beyond the right to preserve criminal life when Kaba showed no respect for others. If the driver shot was not involved in the shooting the day before (remember police didn’t know it was Kaba driving), and the driver attempted to flee unexpectedly and were shot, all four unsympathetic groups I mentioned would be of the view the force was excessive and Martyn Blake would have been convicted.

I am incensed at this parsimonious lawers reasoning that in the name of transparency, a fireams officer should be identified after carrying out his or her lawful duty. He maintains that giving anonymity to "certain professions " would set a dangerous president. You can not compare this to any other civilian action. As a former AFO back in the 80s, I can assure you that no armed officer goes out with the intention of taking a life. It is a huge responsibility to carry a firearm and one not taken lightly. He or she should be afforded every protection in the event of having to lawfully discharge a firearm. Instead Sargent Blake and his family have been sacrificed and thrown to the wolves just as others have been. It is regrettable that Kaba lost his life, but all he had to do was switch the engine off and get out of the car. These days he would have probably have been given bail and be at home with his family.

All were cleared after 3 days on PII grounds - Like Kaba - the state has to be seen to be acting in a way that appeases public concern - the CPS can claim that they have done all they can and then blame the judge and/or the jury for what happens next.
Because Kaba is black, the case was always going to go down to the jury in the knowledge they would find him not guilty. The state will always make sure they cant be blamed - its all corrupt

Chris Kaba was trying to evade capture, using a car as a potentially lethal weapon, the police had to stop him. What the guy had done previously, is irrelevant, he was quickly found guilty, by the jury, based on this event alone.

The question is are these judges suitable for role. Currently it appears the CPS and many judges are NOT.

Paul Britten, defence solicitor, talks about shooting to wound. This is nonsense. You shoot to immobilise not to wing. You always aim at the largest part to ensure a hit. Body or head does the job. Otherwise you’ll miss and the car will continue as a lethal weapon. That’s why police are armed in the first place.

I was a criminal barrister for many years. Britton is talking out of his arse. Anonymity is not that unusual. We already do it.
If you want the police to stand trial and not keep there identities secret you should definitely change the law so all the world should be told of criminals past before any court hearing
I see Nigel's point but it lacks understanding of the legal complexities of the case. It was entirely correct that the case was brought as it called for a thorough examination of the evidence in public. Imagine if the decision had been not to prosecute. It would have given the Kaba family all the ammunition they needed to say the system looks after itself, and there is a cover-up. It is not the Prosecution Service to express sympathy or take a side. It looks at the evidence and brings a case and the jury decide. That was done.

I’m undecided on this one. Seemed like the gunshot was a little premature imo, they had good sight on him and blocked the car in - hands were on the wheel or there abouts. Just wonder if every opportunity was given to preserve life while effectively carrying out a police stop/arrest. If more time had been given it may have been the same outcome but just makes you wonder. Incredibly tough call for armed police and would not like to do their job.
It was OTT and brutal. 17 seconds after the start of the incident and car moving to firing and the fact the car was stuck, with officers out of the way too, before shot fired, changed the game. The decision by officer Blake wasn’t to preserve life and he should have reassessed the situation….Likelihood is they pull Kaba out of the car and hello prison cell.
The issue is the jury, public, media and politicians are unsympathetic to prioritising the rule of law and use of lethal force of firearms officers beyond the right to preserve criminal life when Kaba showed no respect for others. If the driver shot was not involved in the shooting the day before (remember police didn’t know it was Kaba driving), and the driver attempted to flee unexpectedly and were shot, all four unsympathetic groups I mentioned would be of the view the force was excessive and Martyn Blake would have been convicted.

I am incensed at this parsimonious lawers reasoning that in the name of transparency, a fireams officer should be identified after carrying out his or her lawful duty. He maintains that giving anonymity to "certain professions " would set a dangerous president. You can not compare this to any other civilian action. As a former AFO back in the 80s, I can assure you that no armed officer goes out with the intention of taking a life. It is a huge responsibility to carry a firearm and one not taken lightly. He or she should be afforded every protection in the event of having to lawfully discharge a firearm.
Instead Sargent Blake and his family have been sacrificed and thrown to the wolves just as others have been. It is regrettable that Kaba lost his life, but all he had to do was switch the engine off and get out of the car. These days he would have probably have been given bail and be at home with his family.

Why does every discussion about policing become about how badly done by black people are. Many black people commented that the police were right to use fire arms in this instance as the man in question was a career criminal who was no loss to the black community .
