There is nothing hard here - ya'll are too nice. You have no boundaries - everything goes. First of all we should have laws on how folks behave in our country being considerate of the countries laws and communities. Youth - young man and woman of the future where are you - where are leaders of the future - we have experts and highly educated folks - coz SA is an educated state but we are complaining about dudes that didnt even finish sub B like we don't have a democratic state.
Bruh the law allows us to form new parties, canvasss and take control of government. What's this state of hopelessness culture that SA has. We need to go back to our roots coz we are strong principled folks and our country will not be ran down by these crooks. They will not be in power forever and we will prosecute each and everyone of them. 5 years is around the corner. Our fight in 1993 was against colonialism and our fight now is against corruption and self serving lazy uncaring individuals who do not take pride in their country groomed in the ANC and all our political parties. Bruh all these parties are corrupt. DA in the Western Cape - they are the worst they still award contracts to their white counter parts, also ask yourself what has the DA done for colored, black folks in the Western Cape, even their internship opportunities classify taking 5 blacks out of 200 posts just to meet their monitoring and evaluation, just visit their departments. while ensuring they still prioritize their race. All these old parties are mostly self serving and they have ties to the old system. The country has never belonged to its people. Ask yourself why is the land still with white folks if we are a democratic country.

      Is it though?
Few countries where a child get a social grant, certainly not many countries in Africa do that
Few countries in Africa enjoy political and economical stability South Africans enjoy
South Africans are among the economical wealthier than many other African countries (am talking about black people)
We enjoy RAF when we are involved in car accidents
I mean I can go on, it is a blessing to be born in South Africa and you see this by how much we celebrate on weekly basis (weekends) we braai have alcohol and etc
Let’s just appreciate being South Africans and it wasn’t your willpower that you were born here it was just by luck/blessing you could be a Mozambican dodging bullets and bombs

This is going to blow up in the government's face. South Africans aren't xenophobic. The main issue is that we don't have the financial and infrastructural capacity to take in and process foreign nationals before South Africans. And honestly, whose South African child must not be educated in their own country? Education can't afford to have budget cuts and it must be South African admission first. Sorry but this is the truth.

South Africans are seriously not xenophobic I agree. We welcome these folks and accommodate them then when we want them to abide by the law they call us xenophobic😂. These folks are not even nice to us hey, they pee on the street, most of them litter, they dont shower some of them stink - they dont consider other folks they take taxis with, they use muthis - they are just aggressive and they doo as they like - look at uber drivers. Inconsiderate to other drivers. Most of these folks must be taught how to serve the rest of the community they are just not disciplined and groomed properly from the countries they come from - then they dilute our state with lawlessness and self serving inconsiderate attitudes and behaviors.

ANC when they create policy do not think within the parameters of their own law!!! Illegal migration is a criminal offence, with the penalty of deportation!!!. A government who works within their own law and respects the Law would have in a policy that children of documented migrants needs to have a place in school, that makes perfect legal sense. What country says we need to ensure children of illegal migrants are educated, should they not be deporting these people. It is in direct conflict with the country's Immigration law. Its also time we relook this constitution because it really fits a country that is wealthy and we cannot afford to be father Christmas to the world.

      @itumelengseeco2844 12 ชั่วโมงที่ผ่านมา +3

Your argument assumes that laws should be applied in isolation, but legal frameworks, including immigration and constitutional law, are interconnected. South Africa’s Constitution prioritizes human rights, which is why policies like the BELA Act had to be worded the way they were. Denying children access to education based on their parents' immigration status would violate the constitutional principles of dignity and equality. That’s why any attempt to exclude them would face legal challenges-not just from the Helen Suzman Foundation but from various human rights organizations.
Regarding deportation, immigration law does indeed classify illegal entry as an offence, but deportation is a process, not an automatic consequence. It requires due process, resources, and cooperation between countries. Many undocumented migrants remain in South Africa for years, often because their home countries do not accept them back or because they fall through bureaucratic cracks. In the meantime, their children exist within our society, and denying them education would not solve illegal migration-it would only create a generation of uneducated, marginalized individuals, which would have long-term social and economic consequences.
Having said all that, I agree with you, it is time we relook this constitution.

Parents should embark on a national strike. Never, I'm a teacher having sleepless nights because what is happening in WC might also happen in GP. Just imagine 2500 teachers jobs are at risk while undocumented kids get access to schools. In GP I teach 7 classes, the min number of learners is 46 and the max 54. Wow 👏👏👏👏👏👏👏👏👏👏👏👏👏👏👏👏 This country is slowly slipping away from our hands. Soon we'll be like Zimbabwe watch the space🤞. I feel sorry for our future generations😭😭😭😭😭😭😭

And yes I contacted the educational department continuously, they told me they couldn't help me unless he was enrolled in an actually school, but yet no school would accept him. Plus this was happening during covid so everything was shut down.

🇿🇦Dept of Education is a broken sector and not taking education seriously 📖 📚
The law is the law drafted by who, against who, voted by who? for who? and measured against what?
This particular clause in the law, to have an open door policy is good when and if implemented in the private schools not the public schools. If it goes broadly to an already broken public school then the disregard for quality education widens, inequalities, but was there ever a consultation?
I foresee another e-toll gate saga system
It was an illegal mining and then the courts said, protect the criminals because its stiulated in the law to protect their rights.
It is illegal parents in the country to admit their kids and with the incapacitated schools, already unturnable, unmanageable then the court disrupts it further and says documented or undocumented the Dept must not discriminate anyone.

No immigrant child should get admission first before a South African child. ANC is trying to protect illegal immigrants from deportation.

Wht is happening in public schools is academic genocide. Overcrowding, no teacher learner ratio ,no effective teaching and learning. Is so cumbersome to the educators,.I believe to be a south African citizen is so painful becuz yiu must share everything wth Africa, There are people who are receiving money and benefiting on the expense of we ordinary citizens. I wish tht there can be change of roles ,for a month Ramaphosa must go to limpopo and teach those learners in those overcrowded classes.see if he can cope

A good classroom must be 1:25 teacher pupil ratio. When we trained as teacher is was supposed to 1:25, this 1:40 is nonsensical as no effective teaching is happening there. Currently with the 1:40 primary school cannot read for meaning, cannot write and there is no effective teaching and learning as we speak, especially among schools found in black poor communities. These are communities that are subjected to all sorts of social ills. It is not possible to take on an added burden of children of illegal children. The South African tax base is not large enough to absorb the added burden

It had to happen, too many militant minded unions giving self enriching decisions, making schools a place of chaos, teaching is a love, a calling, a special person becomes a teacher, others abuse their humanity with greediness, dont expect blanket sympathy

So, i must take care of my neighbours children even if my don't have enough for my own? Make is make sense. The constitution and law doesn't have provisions in cases where South Africa cannot fulfill certain "nice to haves"?
