I remember the fight with Viacom. They were the most hated company around TH-cam back in 2007-2012. Every single creator had stuff being taken down for the smallest thing. there should be a certain amount of bans u can take, like 3 bans no matter how long they are will result in say a 2 week ban or month or smth, so then streamers will actually be scared of getting banned like they should be

The biggest problem with big streamers like this completely just breaking clear and obvious copyright law is that they know they will not suffer major consequences. They know they are the big moneymakers on twitch and they want them to stay on their platform. The only people that are going to be harmed by their actions are the small streamers who are going to be affected by whatever rule changes twitch puts through because of this.

And big hedge funds, and financiers exist *outside of the system* in regards to trading laws, with the exception only being for obvious fraudsters they can't get away with ignoring. And twitch will absolutely pass new rules for the platform which they will only enforce for the majority of small streamers, then ignore for the big ones.
I've noticed a lot of v-tubers do this as well but as watch-a-longs. Basically, they'll let the audience know what movie they plan to watch(and where it can be bought) so everyone can get it, then they start the movie at specific time and watch it together. You can't see or hear the movie on their streams, it's just pure reaction and it makes a lot of sense, it's as legally transformative as it gets when it comes to "reaction" type content. Not sure why people on twitch can't just do something like that, seems like an obvious thing to do.

IIRC Pekora is currently the second highest-viewed female streamer in the world. Some of the ones who do this sort of content semi-regularly are also among the most popular.

Video game companies technically could sue MANY let's-players and streamers on TH-cam/Twitch/etc. because the videos/streams aren't considered parody/criticism/transformative of the game, and they most likely don't have a licence to use it. For whatever reason, it just doesn't happen to video games as it does to movies/music/etc. you COULD say that under some video games, a creator could produce an original work within the game, idk not a lawyer EDIT: not to mention the horrible PR disaster and backlash video game companies would get if they did do that. I reckon video games get a lot more marketing/publicity from social media than any other type of creative work (movies,music)

A lot of review channels don't do this and show a lot of unnecessary stuff, use the OST as background music etc. Still, a lot more integrity than these reaction streamers just redistributing entire movies
A 2 day ban for this is questionable, it should be atleast a week. They're being too greedy trying to keep Pokimane on their platform, they're scared of giving her too huge of a punishment that she'd make it as an excuse to backlash on twitch and probably switch to TH-cam.

I’ve seen streamers like Hololive get around the problem in a smart way. They only stream their reaction, with no audio or video of what they’re watching being present. Instead they require the viewer to also watch the movie, show, etc on their end, synchronized with the streamer’s reaction. They call it a watchalong, and I’m like 99% sure it’s completely legal to do it.

In all fairness, she was streaming an entire show that's locked behind paid subscription services. She should've known the risk of streaming an entire show on twitch, even though a lot of other people get away with it.

What can help this situation a bit for twitch is for twitch themselves including the streamers started a movement. Make streaming events, especially dedicated to gather supports and donations or contributions to license popular contents officially. If it became a prominent movement, streamers that have invested in the movement might be interested more in "officialness". When they were successful at one, that's a dopamine rush for everybody to reap more and more and more and became stronger as a community. Show the world that they are elite
Uh no. That’s still copyright. Forcing someone to give their content to another person who has had no contributions to your creations and is showing your content for free to millions is not making something official. It’s called being a bully. Millionaire or not, corporate or not, it’s their content that these streamers are showing illegally. And what’s more if it was to be agreed to let streamers show this content, it would certainly be behind a paywall.
I've seen streamers do watchalongs for shows/movies, but they don't stream the actual material. They just provide a timestamp for where they are at, and it's up to the viewer to get their own source and sync up. The stream is basically just the streamer's reactions and they might respond to comments. I'm not familiar with the Twitch space but I always thought this was the norm for stuff like that. Didn't realize people were just straight rebroadcasting stuff.
I'm actually with Twitch when it comes to this, and they shouldn't have allowed it to get that trendy to begin with. This sounds like a fair punishment. You don't stream an entire show that isn't free. And hasn't she vocally condemned such behavior in the past?
The ironic thing is that she has striked people who has made negative yt videos of her with completely fair-use which is kinda basis of why this is so stupid of her. There is videos about the completely no ground strikes since youtube commentators take strikes pretty seriously since it's 3 and you are out and the appeal system is moronic. It's kinda something like you take the strike or appeal and wait for some period of time and when it ends if they don't sue you it dissappears. Bigger youtubers get them handled manually by having to many times reach out thru twitter to youtube (if they aren't so big that they got like a yt representive as a contact).. aka it's so scary for the channel because say you have made 3 videos of pokimane and she strikes all of them then it's 3 strikes and you have to work thru to get them removed because the system is broken. And I think your channel would be down in that case for the waiting period if you don't get it handled before that. So nobody likes people who abuse the system like she blatantly did and at the time read on the law and now is watching movies on stream while eating.

Very true and this is gonna push a lot of people out of streaming. Many depend on reaction and or movie/show content to keep themselves relevant. Me personally if Twitch does that, I feel it’s justified because Twitch has been VERY leeeeeway with things and even some music played on my Streams never get strikes. There are pros and cons to this, this will truly come to show if people are real “content creators” without other peoples content. I feel people milk others videos for their personal gain, lot are praised over another persons work. Either way I can work with it some or most can’t.

a fantastic idea i thought of that could be really good is for twitch to partner with anime sites like crunchiroll so a streamer can fully stream their reactions to anime episodes on twitch but to join the stream it would require you to also have a crunchiroll subscription so they know everyone there has paid for it. Then no one gets banned, everyone pays for content they watch and everyone wins.
Copyright laws are messy and everyone would just like to chill about it and whatever but you still have to be responsible and follow the rules. Its so hypocritical of these streamers, who would be malding if someone did this to their content or I have seen people defending it who also say to "support artists" and whatnot, You can't have one without the other, either you are for piracy or against it.
copyright laws are outdated and meant for the late 90's the scene's around media have changed drastically and they need to update the laws accordingly, of course its a mess right now.
The only major dilemma I still fight back against is being DMCA'd for music FEATURED IN THE GAME/MEDIA you are streaming. That is still ridiculous and shouldn't be the case. Especially for games. There shouldn't be the need for a streamer mode. No one. Absolutely NO ONE is watching xQc shrieking over the games he's playing to get a chance to listen to the music for free lmao That ain't how it works, chief. Too be fair in regards for fair use having lost its meaning. That applies for both sides as review type channels are basically harassed by the youtube bots and claims from false sources with their applicable defense of fair use now basically being invalidated. It's not just streamers and youtubers who have taken away its meaning, but the companies who ignore the true acts of fair use.
If Twitch actually pulled through with all the bans and stuff, the most popular streamer roster would be so much different than it is, most streamers that people watch and those who are the most popular, have already been banned a couple of times, some of them even passing that 3 ban limit. Having influential streamers see "how far they can get with abusing DMCA" and not coming through with actual bans just shows how greedy Twitch actually is, because everyone knows if the top earner gets banned, they lose money. I've always been annoyed with the internet's understanding of fair use. There is zero consistency to what they think is fair use beyond "I liked the thing," and apparently writing "no copyright infringement intended, I own nothing" is all they think they need to do. I remember Legal Eagle explaining fair use and the DMCA in a Lindsay Ellis video, and if it wasn't just a small part of a long video, I'd link it to so many people.

Yeah like, my problem with it isn't that I'm against piracy or I'm defending big studios, this is just going to kill so much of twitch like it did with youtube, and it's going to hurt A LOT of streamers. I do hope both fair use and music copyrighting improves on Twitch and TH-cam because I do feel they're missing a chance to set a precedent. A lot of music is in a grey area and being punished for using it 3 to 6 years ago isn't logical. I'm grateful It's not as absurd as Japan's system where I have to swim through the deep web of Japan to hear a song cause they can't be bothered to let you buy it easily. Fair use needs a better understanding as well and be done in a way that does away with some of the many grey areas with TH-cam and twitch. I can't say exactly what should and should not be fair use, but I feel right now it's an issue that'll grow and grow until it bursts into a major custerfuck

Well yes but it's still comparing garbage with hot garbage. TH-cam's copyright system has some severe prejudice for "companies". You probably know this already but pewdipie's own songs got claimed by "pewdipie the company" and even now he's got no say in when or if it'll go away.
The biggest difference here to the TH-cam case back in 2014 is that for the TH-cam case, there were too many individuals and none of them were worth suing, so Viacom took the suit to TH-cam themselves. For this particular case, Viacom could probably sue Pokimane and actually recover damages, based on public information about what she earns. It would probably be the best outcome, because it wouldn't significantly affect Twitch as a platform, and would properly put the fear of legal action into big-name streamers that are DMCA-baiting.

Her infractions of over 30+ will result in them targeting her for nearly the full charge of the strike which is 1.8 billion (or million can't remember which it was). I actually work for Viacom (indirectly through an agency, its complicated) but anyway when it comes to protecting their IP I have heard from their side through friend when this topic com es up, that its not necessarily the company being overly litigious but basically if you don't 'make an attempt to protect your IP by going after offenders' then you can lose your copyright. Basically you cant pick and choose when you defend your IP you have to go after all cases you are aware of. Hope this helps clarify for ppl. Also did I mention my dad is LITERALLY Elon Musk

Twitch could be linked to TH-cam. And have all twitch revenue from adds etc go to the owner of the TH-cam vid being watched by a streamer. Same for music. Issues solved and all will make money but the streamers will make a little less save donations
IMO twitch and YT are missing out BIG TIME on this. They could literally AND EASILY implement a "watchalong" button where the content creator can link legitimate places to watch the content along with them. It could have timestamp integration and everything, and I bet amazon, netflix etc would love it since it drives sales for them.
Amazon prime video already has something like that on the platform but the streamer only broadcasts their reaction and their timestamp and everybody else is responsible for having prime video and to sync it up with the stream but that way you can see the streamers reaction to what you're all essentially watching together
Unfortunately the process for setting up a big collaboration like that is slow and tedious for big companies. Twitch is literally owned by amazon and it still took them a while to implement amazon watch parties. You're right that it's a good idea and it will probably come eventually.

That last omnibus bill from 2020 made "streaming" music and movies federally illegal, I think it's up to 10 years in fed prison with fines, that doesn't include possible lawsuits toward twitch and the streamer. Tough, DMCA needs to be updated and loosened even slightly
A good way to counter this would be to get in touch with the current owners of a certain anime and make an agreement that you are allowed to watch one pilot episode to promote it.
Viacom sucks but I really don’t see what they did wrong in this case. Even if copyright law was massively reformed it’s not like this is some 70 year old show that’s teethering on the public domain. You’re not criticizing it, you’re hardly adding anything transformative to it (which is already a tenous excuse to begin with), you’re simply stealing content and restreaming it for free to thousands. It’s like the straight-up textbook definition of a copyright violation, short of literally ripping a dvd and selling it there’s next to no way this could be any more clear cut. TH-cam’s «ad-claim» feature is a gesture of kindness, not something that is specified in law anywhere. Companies can and likely will sue people and companies who attempt this, and they’re no doubt going to have a slam dunk in court.
The problem here isn't that they violated the law. Yeah they did. It's that copyright is a horrible law. It's essentially just NFTs but they actually do something. It gets even worse when it comes to inventions because now people can't take other people's design and implament it into their own invention because that piece is copyrighted. It's just anti-art, anti-tech, and protects the interests of big buisnesses.
I mean, I've actually seen 24 hour streams where they straight up marathon entire series' like Spongebob or Family Guy not just on twitch, but here on TH-cam as well. I've even gotten a few of them on my recommended from time to time.

If twitch was smart about this I feel like they could leverage a lot of opportunity out of it. People clearly want to have watch parties with their favourite streamers, I feel like it would be possible to strike a deal with streaming services like netflix into integrating the actual streaming service itself into the platform. I have no idea how the technical specifications of this would work but if viewers could link their paid netflix account with their twitch account and then gain access to the integrated stream with the netflix stream synced up with the twitch content creator's netflix stream, only users who have paid for the service already could watch and the streamer isn't actually streaming the movie/tv show, they're essentially a second video overlayed over the netflix stream. There would be an issue arise when there are geolocational blockers, in which case those viewers wouldn't be able to access the integrated stream without a vpn. This could be taken a step further with netflix acting as a sponsor for streamers who use their platform for watch parties and providing streamers with sponsorship codes and benefits to make up for the streamer having a smaller audience due to (whether or not viewer has a paid netflix account linked), since this would undoubtedly bring more customers to netflix because they don't want to miss out on these watch parties with their favourite streamers. Seems like everybody wins in this scenario. I'm sure similar things could be achieved with watch parties for youtube videos.

The biggest problem with big streamers like this completely just breaking clear and obvious copyright law is that they know they will not suffer major consequences. They know they are the big moneymakers on twitch and they want them to stay on their platform. I've noticed a lot of v-tubers do this as well but as watch-a-longs. Basically, they'll let the audience know what movie they plan to watch(and where it can be bought) so everyone can get it, then they start the movie at specific time and watch it together. You can't see or hear the movie on their streams, it's just pure reaction and it makes a lot of sense, it's as legally transformative as it gets when it comes to "reaction" type content. Not sure why people on twitch can't just do something like that, seems like an obvious thing to do.

I’ve seen streamers like Hololive get around the problem in a smart way.
They only stream their reaction, with no audio or video of what they’re watching being present.
Instead they require the viewer to also watch the movie, show, etc on their end, synchronized with the streamer’s reaction.

I agree with you said but streamers need to eat. Do you look at a wall while eating, they have the right to entertain themselves, even if their streaming. A lot of people watch TV/YT while eating.
What can help this situation a bit for twitch is for twitch themselves including the streamers started a movement.
Make streaming events, especially dedicated to gather supports and donations or contributions to license popular contents officially.
If it became a prominent movement, streamers that have invested in the movement might be interested more in "officialness". When they were successful at one, that's a dopamine rush for everybody to reap more and more and more and became stronger as a community.

I've seen streamers do watchalongs for shows/movies, but they don't stream the actual material. They just provide a timestamp for where they are at, and it's up to the viewer to get their own source and sync up. The stream is basically just the streamer's reactions and they might respond to comments.

The ironic thing is that she has striked people who has made negative yt videos of her with completely fair-use which is kinda basis of why this is so stupid of her. There is videos about the completely no ground strikes since youtube commentators take strikes pretty seriously since it's 3 and you are out and the appeal system is moronic. Very true and this is gonna push a lot of people out of streaming. Many depend on reaction and or movie/show content to keep themselves relevant. Me personally if Twitch does that, I feel it’s justified because Twitch has been VERY leeeeeway with things and even some music played on my Streams never get strikes. There are pros and cons to this, this will truly come to show if people are real “content creators” without other peoples content. I feel people milk others videos for their personal gain, lot are praised over another persons work. Either way I can work with it some or most can’t.

a fantastic idea i thought of that could be really good is for twitch to partner with anime sites like crunchiroll so a streamer can fully stream their reactions to anime episodes on twitch but to join the stream it would require you to also have a crunchiroll subscription so they know everyone there has paid for it. Then no one gets banned, everyone pays for content they watch and everyone wins.
Copyright laws are messy and everyone would just like to chill about it and whatever but you still have to be responsible and follow the rules. Too be fair in regards for fair use having lost its meaning. That applies for both sides as review type channels are basically harassed by the youtube bots and claims from false sources with their applicable defense of fair use now basically being invalidated. It's not just streamers and youtubers who have taken away its meaning, but the companies who ignore the true acts of fair use.
If Twitch actually pulled through with all the bans and stuff, the most popular streamer roster would be so much different than it is, most streamers that people watch and those who are the most popular, have already been banned a couple of times, some of them even passing that 3 ban limit. Having influential streamers see "how far they can get with abusing DMCA" and not coming through with actual bans just shows how greedy Twitch actually is, because everyone knows if the top earner gets banned, they lose money.

I've always been annoyed with the internet's understanding of fair use. There is zero consistency to what they think is fair use beyond "I liked the thing," and apparently writing "no copyright infringement intended, I own nothing" is all they think they need to do.

I do hope both fair use and music copyrighting improves on Twitch and TH-cam because I do feel they're missing a chance to set a precedent. A lot of music is in a grey area and being punished for using it 3 to 6 years ago isn't logical. I'm grateful It's not as absurd as Japan's system where I have to swim through the deep web of Japan to hear a song cause they can't be bothered to let you buy it easily.
Fair use needs a better understanding as well and be done in a way that does away with some of the many grey areas with TH-cam and twitch. I can't say exactly what should and should not be fair use, but I feel right now it's an issue that'll grow and grow until it bursts into a major custerfuck

The biggest difference here to the TH-cam case back in 2014 is that for the TH-cam case, there were too many individuals and none of them were worth suing, so Viacom took the suit to TH-cam themselves.
For this particular case, Viacom could probably sue Pokimane and actually recover damages, based on public information about what she earns. It would probably be the best outcome, because it wouldn't significantly affect Twitch as a platform, and would properly put the fear of legal action into big-name streamers that are DMCA-baiting.

I actually work for Viacom (indirectly through an agency, its complicated) but anyway when it comes to protecting their IP I have heard from their side through friend when this topic com es up, that its not necessarily the company being overly litigious but basically if you don't 'make an attempt to protect your IP by going after offenders' then you can lose your copyright. Basically you cant pick and choose when you defend your IP you have to go after all cases you are aware of.

IMO twitch and YT are missing out BIG TIME on this. They could literally AND EASILY implement a "watchalong" button where the content creator can link legitimate places to watch the content along with them. It could have timestamp integration and everything, and I bet amazon, netflix etc would love it since it drives sales for them.
Amazon prime video already has something like that on the platform but the streamer only broadcasts their reaction and their timestamp and everybody else is responsible for having prime video and to sync it up with the stream but that way you can see the streamers reaction to what you're all essentially watching together
Unfortunately the process for setting up a big collaboration like that is slow and tedious for big companies.
Twitch is literally owned by amazon and it still took them a while to implement amazon watch parties.

That last omnibus bill from 2020 made "streaming" music and movies federally illegal, I think it's up to 10 years in fed prison with fines, that doesn't include possible lawsuits toward twitch and the streamer. Tough, DMCA needs to be updated and loosened even slightly
A good way to counter this would be to get in touch with the current owners of a certain anime and make an agreement that you are allowed to watch one pilot episode to promote it.
Viacom sucks but I really don’t see what they did wrong in this case. Even if copyright law was massively reformed it’s not like this is some 70 year old show that’s teethering on the public domain. You’re not criticizing it, you’re hardly adding anything transformative to it (which is already a tenous excuse to begin with), you’re simply stealing content and restreaming it for free to thousands. It’s like the straight-up textbook definition of a copyright violation, short of literally ripping a dvd and selling it there’s next to no way this could be any more clear cut. TH-cam’s «ad-claim» feature is a gesture of kindness, not something that is specified in law anywhere. Companies can and likely will sue people and companies who attempt this, and they’re no doubt going to have a slam dunk in court.

I mean, I've actually seen 24 hour streams where they straight up marathon entire series' like Spongebob or Family Guy not just on twitch, but here on TH-cam as well. I've even gotten a few of them on my recommended from time to time.

In my defense I didn't know the context, I just saw the title and wondered what was going on.
If twitch was smart about this I feel like they could leverage a lot of opportunity out of it. People clearly want to have watch parties with their favourite streamers, I feel like it would be possible to strike a deal with streaming services like netflix into integrating the actual streaming service itself into the platform. I have no idea how the technical specifications of this would work but if viewers could link their paid netflix account with their twitch account and then gain access to the integrated stream with the netflix stream synced up with the twitch content creator's netflix stream, only users who have paid for the service already could watch and the streamer isn't actually streaming the movie/tv show, they're essentially a second video overlayed over the netflix stream. There would be an issue arise when there are geolocational blockers, in which case those viewers wouldn't be able to access the integrated stream without a vpn. This could be taken a step further with netflix acting as a sponsor for streamers who use their platform for watch parties and providing streamers with sponsorship codes and benefits to make up for the streamer having a smaller audience due to (whether or not viewer has a paid netflix account linked), since this would undoubtedly bring more customers to netflix because they don't want to miss out on these watch parties with their favourite streamers. Seems like everybody wins in this scenario. I'm sure similar things could be achieved with watch parties for youtube videos.

I dont think most companies mind if you watch 1 or 2 episodes. It brings an audience to the show, potential revenue, that might not have been there before. Tv compains, websites, netflix pay these people to broadcast their shows, why shouldnt streamers, its the same thing.
