      we studied contract law and promissory estoppel in business law in undergrad accounting minor classes. And finding a way around things to enforce or make new contracts. And verbal agreements are fine as long as there are witnesses (like Mark zuckerberg and his college roommates for helping zuck in exchange for stock)

    She should have asked Luis to confirm the deal in writing rather than talk hypothetically about someone else. Luis may have just confirmed that is what he promised. Then the "new deal" wouldn't have been necessary.

Rachel 100% drop the ball there, sure 65k is a lot of money for most people, but if you are making like 10 millions a year in salary (not to mention the way higher budget he manages inside the firm).... 65k is a drop in the bucket and not something that would stress him out.

    So there's a lot of laymen lawyers in the comments so settle some things.
    1) Verbal contracts are just as legit as written ones.
    2) HOWEVER, if a contract falls under one of Statute of Frauds categories, it needs to be written down (Marriage, Year, Land, Executor, Goods, and Surety). In this scene, you see Lewis asking how long it and Rachel answers three years. That falls under one of the categories (Year), as contracts lasting over a year must be written
    3) there are exceptions to these rules. One exception is if a person detrimentally relies on the contract and meets the criteria of promissory estoppel (i.e., reasonably relied on that promise to their own detriment) That's why Rachel responds to Lewis by saying she made major decisions on that promise.
    And Lewis is right about winning. At the end of the day, Rachel should've known better. A court takes that into account. If she were to go to trial, the cost of litigation would be more than what she could afford.

    idk why they never did a flashback scene of the time jessica decided to pick harvey out of the mail room. what led to it, what was harvey's life like before then, it would've been really interesting

    All she had to do was kindly remind Louis of the arrangement and I'm sure he would've honored it. He loves Rachel as if she were his daughter.
    Also, if I recall correctly, she got Louis to agree to that by threatening to expose his misdeeds after he fired her, but she probably doesn't want to reveal that little piece to Jessica.

    as ruthless and cutthroat as everyone in this show tends to be, one thing that I really like is how if someone actually wins a conflict with them, they tend to respect and congratulate the person behind
    From Louis twisting their arms to (spoiler) make named partner, to Mike's various issues with everyone, and to this episode
    It makes sense in universe since to be a lawyer would mean not taking every win/loss personally, but it also is great writing since it allows for continued internal conflict/drama without the audience disliking one character or another. It also saves the audience from feeling like the characters react on the writers' whims but actually hold true to their character & personality

    I would have wrote that storyline as, Rachel forgot about her Tuition fee and she thought it was being paid. When Rachel challenges why her fee was never paid, the firm tells her it was not paid because she was fired which in in the clause, but when Rachel goes over her contract she finds that in the case of being wrongfully fired the fee should still be paid, however, the firm challenges that clause and interprets it slightly different, but over time human resources (or whatever it is) agrees to pay, she just needs to chase them up for the payments or reimbursements.

    Weil it happened to me the same, just that the one that promised me to pay my tuition was my dad, and at the age I entered to University I was 17 years old. I ended up paying everything. Sadly I didn’t have any witness. I keep asking to my self if could have done anything in my case :/

      Your dad reneged on a gift. It wasn’t a contract or a settlement. Here, Rachel was wrongfully accused, terminated, and could have sued. The raise and tuition agreement were compensation.

      From what I understand they do but I think the repayments are a lot higher than in the uk that’s why, I don’t think they have the same conditions of repayment as we do.
      It could also be a lesson on money, if you pay for college yourself then you appreciate the value of it more rather than get it for free or something. Idk. 🤷🏽‍♂️
