    I’m confused. I was brought here as a child (3yrs old) and I signed a voluntary deportation (didn’t let me see a judge) and I came back. I have prosecutorial discretion. What type of bar do I have

    Well we need to have an attorney sue immigration and argue that even with an unlawful entry, if the applicant has lived IN THE USA for over 10 years he can file the i-130 an obtain a IV without a waiver.

    Hello I lived in nyc 24 years have two daughters 25 and 17 am in my country currently I came back because I need to see my sick dad and I was fooled into exiting nyc but I been in nyc with a actually visa I am here five years now ,so I still need to wait or get a waiver ,by the way my daughter petition for me I got through but Officer says I need a inadmissibility wsiver, my question is do I still need a waiver or is this exempted thank you please respond

      Hello,
      If you triggered a 10 year bar when you departed the USA, then you will need a waiver until 10 years have passed. The waiver requires a showing of extreme hardship to a spouse or parent who is a US Citizen or permanent resident.

      If I don't have a criminal record and the United States..but I show up at the border seeking asylum but lost the case ..sent back home for ten years..been home for five years..can I apply for the parole program..don't have a criminal record
