If I was a jury member in this PD's area I'd be very skeptical of their testimony in court. We just watched them gin this whole situation up out of basically nothing, and the tone of voice was crystal clear...they desperately wanted to screw this guy. He was obviously making up the weed smell, he was maximally antagonizing the guy and he illegally searched this guy's private property after having not observed a crime being committed. It's just a perfect storm of don't trust these guys, they escalate and create illegal situations.

Ya I usually have a sort of rule that if I can’t find a safe spot within 30 seconds I’ll just stop wherever.Pulling over in 30 seconds or less is more than reasonable and that’s pretty much how long this guy drove before stopping.

Miranda warnings and being under arrest are mutually exclusive. There are times people are under arrest and Miranda warnings are not needed and there are times people are not under arrest and Miranda warnings are required.

My father was a top criminal defense Lawyer in Dallas, Texas from 1950-1988 when he passed away and he was saying in 1986 that we are becoming a Police State and for us kids to do our best to stay off there radars, he was exactly right, he would tell us horror stories about the Police he estimated that 30 % of the prison populations was actually innocent and they abused people and this was before people had cameras on a phone, I hate think of how they abused citizens without cameras. AND WE PAY THEM it’s insane and I have been going to city counsel meetings to try to hold them accountable, unfortunately I we have passed a point of no return.

Decades past, I was berated by a cop for not getting off my motorcycle and not removing my helmet when stopped. A couple years after that, I was stopped and remembered that previous stop. So I got off my motorcycle and removed my helmet. BUT then this cop drew his weapon, ducked behind his cruiser, and began yelling at me to put on my helmet and get back on my motorcycle. Hence, following one cops instructions will potentially get you murdered by another cop.
virtually everything you do is wrong - i moved to the states a few years ago from the UK - i had never been stopped in the UK after 17 years of driving - never even spoke to a cop - and to be honest UK policing is far from ideal. After 2 years in the US i had been stopped 8 times . Interestingly i was stopped for going 5 miles under the speed limit - 5 miles over the speed limit and interestingly for driving exactly on the speed limit which is was told was ultra suspicious becase thats what drunk drivers do.

It's a clear violation of his fourth amendment. They searched him AND his car without legal reasons. It was a traffic stop for tint. To search his car it would have to be an inventory search after arrest or have probably cause. Neither exist. I think a jury would come to the same conclusion.

Simply not true. They had reasonable suspicion to stop him with the windows and probable cause to detain him for the failure to stop. They conducted an investigation and ultimately let him go. The issue is with the dept in the way the spoke to him and the lack of professionalism. But, legally they were not clearly breaking the law or violating civil rights.

When I was a truck driver I was heading home bobtailed. As I made a left turn a state trooper lit me up. I drove nearly a half mile until I found a place to stop that was safe and the cop never said a freaking thing about it.

If I was a jury member in this PD's area I'd be very skeptical of their testimony in court. We just watched them gin this whole situation up out of basically nothing, and the tone of voice was crystal clear...they desperately wanted to screw this guy. He was obviously making up the weed smell, he was maximally antagonizing the guy and he illegally searched this guy's private property after having not observed a crime being committed. It's just a perfect storm of don't trust these guys, they escalate and create illegal situations.

I guess you should immediately stop then have the officer tell you to move to a safer location. Years ago I was with a friend who got pulled over and the cop chewed him out for not stopping immediately even though it was a freeway with no shoulder at that spot. My father was a top criminal defense Lawyer in Dallas, Texas from 1950-1988 when he passed away and he was saying in 1986 that we are becoming a Police State and for us kids to do our best to stay off there radars, he was exactly right, he would tell us horror stories about the Police he estimated that 30 % of the prison populations was actually innocent and they abused people and this was before people had cameras on a phone, I hate think of how they abused citizens without cameras. AND WE PAY THEM it’s insane and I have been going to city counsel meetings to try to hold them accountable, unfortunately I we have passed a point of no return.

Decades past, I was berated by a cop for not getting off my motorcycle and not removing my helmet when stopped.
A couple years after that, I was stopped and remembered that previous stop. So I got off my motorcycle and removed my helmet.
BUT then this cop drew his weapon, ducked behind his cruiser, and began yelling at me to put on my helmet and get back on my motorcycle.
Hence, following one cops instructions will potentially get you murdered by another cop.
virtually everything you do is wrong - i moved to the states a few years ago from the UK - i had never been stopped in the UK after 17 years of driving - never even spoke to a cop - and to be honest UK policing is far from ideal. After 2 years in the US i had been stopped 8 times . Interestingly i was stopped for going 5 miles under the speed limit - 5 miles over the speed limit and interestingly for driving exactly on the speed limit which is was told was ultra suspicious becase thats what drunk drivers do.

It's a clear violation of his fourth amendment. They searched him AND his car without legal reasons. It was a traffic stop for tint. To search his car it would have to be an inventory search after arrest or have probably cause. Neither exist. I think a jury would come to the same conclusion.

With concealed carry now, cops are more leery going up to cars. I get it. Absolutely. But this law has put non-gun owners at risk. There is no way to tell if someone has a gun until the cop actually goes up to the car. It creates an adrenaline rush environment that is dangerous for driver and cops.

Simply not true. They had reasonable suspicion to stop him with the windows and probable cause to detain him for the failure to stop. They conducted an investigation and ultimately let him go. The issue is with the dept in the way the spoke to him and the lack of professionalism. But, legally they were not clearly breaking the law or violating civil rights.

Also, they did an illegal search on the car and his person. To be searched, they have to be arrested for a crime, which wasn’t the case here, and if they have consent, which he didn’t give. They violated his 4th amendment for sure, used excessive force once the stop took place even though he complied with everything that they said.

@@Tilt168 They can only do a patdown of the driver only if they have articulable, reasonable suspicion that he is armed. They can't legally reach inside the vehicle either without a warrant unless the suspect is under arrest.
He absolutely has the right to pull over where he feels safe. And he has the right to speak to explain his position.

When I was a truck driver I was heading home bobtailed. As I made a left turn a state trooper lit me up. I drove nearly a half mile until I found a place to stop that was safe and the cop never said a freaking thing about it.
People of color are not allowed to drive to a "Safe Place" or not pull over immediately and fall on their knees, drop their skivvies and lube up. Anything other than that is a reason to justifiably send them to the coroner's office. You are Blessed, enjoy it.

Also in that 10 seconds he undid his seat belt, climbed into the back seat, pulled it down, pull his legal firearm there, put the seat back up, climbed back into the driver's seat, put his seat belt on, rolled down his windows, got out his license, registration and insurance.... All with the officer seeing it. But the officer stated he saw him moving around then stated he couldn't see because of the window tint
