My employer has been advised that a similar role within the NHS is paid at band 6, which means my salary needs to reflect band 6 and not band 5. This seems very odd to me. The minimum salary of £29000 only applies to someone who is on a Skilled Worker visa with CoS assigned on or before 3 April 2024. Then when they extend or change employer or file ILR, they should be paid at least £29000. So someone whose CoS was assigned on or before 3 April 2024 and they applied for the SW visa on or after 4 April, they still come under the old rules and minimum £29000 would apply to them when they extend or change employer or file ILR.

1. Yes, you can apply as a New Entrant, however, your work end date on the CoS can be latest till 4.2026 2. You cannot do part time work with your current employer, unless your current employer has reported through the Sponsor Management system the reduction in hours and after the reduction, your Salary should still meet the Salary thresholds for your sponsorship to continue. This would be very difficult to achieve in most cases.

My employer has been advised that a similar role within the NHS is paid at band 6, which means my salary needs to reflect band 6 and not band 5. This seems very odd to me. Your salary should be based on the job description of the role. If you will be doing the day to day work of a band 6, then you should be paid the Salary for a Band 6. Your employer should be able to justify this to UKVI.

Then when they extend or change employer or file ILR, they should be paid at least £29000.
So someone whose CoS was assigned on or before 3 April 2024 and they applied for the SW visa on or after 4 April, they still come under the old rules and minimum £29000 would apply to them when they extend or change employer or file ILR.

1. Yes, you can apply as a New Entrant, however, your work end date on the CoS can be latest till 4.2026
2. You cannot do part time work with your current employer, unless your current employer has reported through the Sponsor Management system the reduction in hours and after the reduction, your Salary should still meet the Salary thresholds for your sponsorship to continue. This would be very difficult to achieve in most cases.
