    My question is what happens, let’s say someone has been more than 180 days outside UK. So does it mean person will never get ILR or what will happen in that case?

      I guess This will lead to starting it from the scratch again that is... you'll have to start your 5 year period again for applying the ILR

    Hi Sharika,
    There is a direction from HMRC for all those having BRP to apply for e-Visa by December 24.
    But no clear direction on those who has stamp Visa ILR and not applied for BRP. As applying BRP for ILR holder is not mandatory, I have not applied for BRP. I'm staying overseas and do not wish to travel back to Uk before December 24 to apply BRP and e-Visa.
    Can I enter UK with my ILR next year if I have not convert to e-Visa?

      Neither, it's actually a window of 365 days, not restricted to a specific month.
      Let's say, you count from a random date last year, like 10th September, 2023. So, in this case, you should have stayed for more than 180 days in the UK until 9th September, 2024.

      Yes, I think so as long as it's certified as CEFR Level B2, it shall be perfectly fine because this is the minimum requirement that one needs to make.

      @@shahnazpushpo4557 If you switch to a different occupation code job, then your duration count will restart from the moment of switching to a new visa, any time-period which you'd have already have spent before this will be treated as null and void.

    Reg the holiday i have a indepth question.
    Is it ok to work from India for 1 or 2 weeks during summer holiday visit to India?? Because the holiday list and the days out of uk will not matching right?? Will it be problem during ILR application
    On a 5 weeks trip im planning to take 3 weeks holiday and 2 weeks work from india if my employer is ok with it.

      Recommend NOT to work remote from abroad during qualifying residence period. Else to cover all bases, you need to make sure the employer letter specifies that they approved the remote work for the dates subject to the 180 day allowance. As you rightly said the days of the leaves and the entry/exit stamps will not match. I was in the same situation where I worked remote for 1 week post the leave period due to an illness in the family. My employer letter only specified the actual sanctioned leave dates and nothing was mentioned about the 1 week remote period in the letter. It looked like a grey area to me. I kept the hospital proof ready in case it was questioned in the ILR decision making but thankfully no questions were asked, ILR was approved. But in my case the mismatch was only for 1 week or 7 days.

      @@hiteshkathuria3462 I feel that since the gap here within a year is more than 180 days, so your clock period of 10 years will restart from 2016. If there's a strongly convincing reason behind this long absence such as some unavoidable exceptional circumstances, then there might be some lineancy shown.

      You can switch employers under same code. That will NOT affect your eligibility for ILR.

      @@shanikamaturata6600 Hi, they'll get their ILR too as your dependents once they complete their 5-years of legal stay in the UK. They'll be able to submit their ILR applications along with you only when their 5-years legal stay period gets completed at the same time at which yours gets completed. So, it's better to call them right from the beginning.

      @@shanikamaturata6600 What I feel is that this shouldn't be a problem for the dependents as they can continue with or extend their dependent visas after the main applicant has been granted the ILR. Generally, an extension of 3 years is granted first in order to reach a point of obtaining ILR. Hope this helps!!

      @@WaseemShafiq-l3u I didn't know that they were in class 7 and 6, elementary classes. Student visa is issued from the Undergraduate (UG) level onwards after passing senior secondary (12th standard) examination. So, they can't be granted any visa.
