Hi Valeria, I have received a job offer for a 3-year duration programme at a large audit corporate. As the new rule announced in April states that new entrants discount lasts for 4 years (including graduate visa route duration), I was suddenly withdrawn for my past offer. This is because by the time I start and end the programme, the wage discount service is short for about 1.5 months as my graduate route visa finishes on 7th, August while the programme ends on 27th, September. Me and the company were announced with the news far after the offer was made, which the contract has been signed but it's now officially illegal. I am here to ask for help with your expertise, to seek for ways that the company (the employer) could protect me (the employee) from this rule and avoid withdrawing the offer. This legal change, I concern, is not fair for some offer-holders that have signed the contract before the change had been made. International students have obtained graduate route visa to work for an employment, to refuse all the other offers for single company decision. As I will be able to discuss with the programme manager during the future call, I would like to research any possible methods to keep the offer as planned, as much as I could.

Sadly, i hate to be the debby downer but 30,960£ is definitely much higher than the junior level salary for a lot of fields… I have been deep in applications for a few months now for software roles and even for a high qualification field like mine the starting pay is usually 25-27k£. This has effectively killed the market for entry level jobs for internationals in my field as employers will have to pay a higher salary than non internationals to get us a visa… what a mess😢

As per my understanding, there is no such cases, they made sure that in the table there are no values below 30,960 unless it is a job in healthcare or education

I believe you will need to be paid the going rate, you can change employers on a skilled worker visa, but would need to change visas as you will have a new sponsor. please note that I am not an immigration advisor

What will happen when people come to renew their visas? These new policies will not be applied retrospectively and until the Immigration Rules are amended the salary threshold will remain the same. Job started in feb 2023 with a F1 company and getting paid 35000£ but still on a graduate/psw visa. the company is sponsoring me for next three years getting me a skilled worker status, my question would be. what will the situation be if I do the application post 4th April 2024 as I still have my psw expiry set to 30th June 2024? Would the company be required to pay me new minimum salary i.e., 37,38K? Hello! I am not an immigration advisor, but from 30th June 2022, for 4 years, you will be considered a new entrant. So Let's say you switch this June 2024, until June 2026 you can be paid below 37,8k or whatever is the 70% of the going rate, but after June 2026 they will need to apply for another skilled worker visa and pay you above 37,8k most likely ! but they might have an immigration team that will help you in the process
@@MindTheGrad Hi Apologies for late replying soo updates from my end just thought to add in my scenario so that people might have more clarity about New Entrant: my case: student from 2021-2022, on psw visa from 2022-2024, makes my current years of total in the UK to 3 years. Now I started job with a company in early 2023, still on PSW, march 2024 company sponsored me for skilled worker for another 3 years, BUT I don’t fall under new entrant category because there is a sub section of rule in the New Entrant category saying that a person is considered a new entrant only for 4 years since he/she came to the UK AND if any company is sponsoring for the job the company SHALL NOT give less length of work contract or issue less years of CoS to the employee just to make him eligible as a new entrant. So, for me in my CoS it says N as in not a new entrant in this category, hope this helps in clearing out new entrant category. To summarise what I believe is no company will hire you or give you CoS for a smaller number of years (They would want same employee for longer term). B). 90% of us wouldn’t be considered as a new Entrant. Even if we would be under 26 or qualify for other points as a new entrant just because of this sub section rule we will not be a new entrant, HOPE this helps everyone. There is one scenario which can make us fall under entrant category If you get a skilled worker job directly after you finish your degree ie not go for PSW (i.e waste a year or few months on PSW), then if we calculate the number of years for new entrant AND the company gives you a skilled worker for lets say 2 years to make you fall under new Entrant category, then only its a possibility of you being a New entrant, hence I said 90% of us wont be considered as a new entrant.

Hi, I am not an immigration advisor, I can only tell you what I think based on my experience and what I have read. 1 - You can be a new entrant since you will complete your master's in the UK. 2- £30,960 can be sufficient for some jobs, but other roles might have a higher going rate (70%). 3 - I think that there can't be discounts on salary for this position if you have PhD, but this one I am not sure 4. No, you can be a new entrant for 4 years only as I said in this video, this also includes any years spent on graduate visa. So you will need to apply for a new visa and meet the full salary requirement after that

@@muheshvaran4381 I think so... I did not see the rule, that you can't switch jobs as a new entrant, but note that you will need to update your visa if you switch employers or your switch occupation code which might mean higher salary level

Hey Valeria, there is another table from page 123 in the document you linked that has different salaries and rates compared to the first table for the same occupations. Could you please give us some clarity on what the difference between both tables is?

I'm a graduate civil engineer and on table 1 option E the table specifies that I need to get paid £31,850 but on table Table 2 option J £24,710.

Job started in feb 2023 with a F1 company and getting paid 35000£ but still on a graduate/psw visa.
the company is sponsoring me for next three years getting me a skilled worker status, my question would be.
what will the situation be if I do the application post 4th April 2024 as I still have my psw expiry set to 30th June 2024?
Would the company be required to pay me new minimum salary i.e., 37,38K? (whatever the amount is) the job role is graduate controls engineer and I am not sure under which occupation list this position falls. could anyone advice comment on this as well. Thank you!
Hello! I am not an immigration advisor, but from 30th June 2022, for 4 years, you will be considered a new entrant. So Let's say you switch this June 2024, until June 2026 you can be paid below 37,8k or whatever is the 70% of the going rate, but after June 2026 they will need to apply for another skilled worker visa and pay you above 37,8k most likely ! but they might have an immigration team that will help you in the process
@@MindTheGrad Hi Apologies for late replying soo updates from my end just thought to add in my scenario so that people might have more clarity about New Entrant: my case: student from 2021-2022, on psw visa from 2022-2024, makes my current years of total in the UK to 3 years. Now I started job with a company in early 2023, still on PSW, march 2024 company sponsored me for skilled worker for another 3 years, BUT I don’t fall under new entrant category because there is a sub section of rule in the New Entrant category saying that a person is considered a new entrant only for 4 years since he/she came to the UK AND if any company is sponsoring for the job the company SHALL NOT give less length of work contract or issue less years of CoS to the employee just to make him eligible as a new entrant. So, for me in my CoS it says N as in not a new entrant in this category, hope this helps in clearing out new entrant category. To summarise what I believe is no company will hire you or give you CoS for a smaller number of years (They would want same employee for longer term). B). 90% of us wouldn’t be considered as a new Entrant. Even if we would be under 26 or qualify for other points as a new entrant just because of this sub section rule we will not be a new entrant, HOPE this helps everyone. There is one scenario which can make us fall under entrant category If you get a skilled worker job directly after you finish your degree ie not go for PSW (i.e waste a year or few months on PSW), then if we calculate the number of years for new entrant AND the company gives you a skilled worker for lets say 2 years to make you fall under new Entrant category, then only its a possibility of you being a New entrant, hence I said 90% of us wont be considered as a new entrant.

I honestly don't know, the employer decides your role code and then you can check what is the going rate on gov.uk website

I previously worked in Srilanka almost ten years in the same job as kitchen designer.

2. If I find a job paying £30,960 only , will it be sufficient to apply under Skilled worked visa?

Hi, I am not an immigration advisor, I can only tell you what I think based on my experience and what I have read. 1 - You can be a new entrant since you will complete your master's in the UK. 2- £30,960 can be sufficient for some jobs, but other roles might have a higher going rate (70%). 3 - I think that there can't be discounts on salary for this position if you have PhD, but this one I am not sure 4. No, you can be a new entrant for 4 years only as I said in this video, this also includes any years spent on graduate visa. So you will need to apply for a new visa and meet the full salary requirement after that
