TH-cam completely disabled monetisation on it EVEN though I have exact same videos with the same cause which have monitisation on them. Never got back to me with a reason or anything. It killed my creativity and since I haven't uploaded at all. TH-cam killed my creativity.

+Amanda Tucker absolutely, just sucks to see someone I once respected talk so much shit about his former employers, especially when I assumed they have always been on good terms. Plus, the problem is that technically the nostalgia critic videos may not be covered under fair use, and thus the copyright claims against them may be completely valid. If that is the case then it makes them look bad to complain about this issue if the actions being taken against them are completely legal and monetization should not be allowed on these videos. It's a frustrating subject since I love channel awesome and want them to succeed but channel awesome needs to realize they may be in the wrong here
The problem with TH-cam's copyright system is that it is all completely automated and NOT done by actually people. If TH-cam created some jobs and hired like 1,000 people (or even more, they have the funds, they could do it) to just review the countless hours of footage being uploaded to TH-cam, we wouldn't have to deal with random strikes or copyright notices. The fact that it's automated means that we have to alter the footage, we have to be careful of what we show, even if it's under Fair Use because TH-cam's system will detect the footage AUTOMATICALLY and issue the notice. Then we have to issue the dispute which could take up to 30 days if you're lucky, meanwhile everyone's watching the video and you're missing out on revenue. You really are guilty until proven innocent because TH-cam wants to make damn sure they're not being sued by the companies that own the content. Fair enough, but this automated system has been a problem for a while now and it's just sickening what's going to other people (mostly reviewers for some reason, they're almost getting as screwed over as animators).
+blameitonjorge Hoenstly, I dont see how exactly people working to review DAYS of footage works. All kinds of things can go wrong. They can be bribed, be tired, fired for missing one single detail. Plus, DAYS of footage are uploaded in a mere hour. Its near impossible to complete so much. Therefore, the algorithm is set in place. The problem with the algorithm is that it covers so much variables are put into place that its easily abused. Unless people review the strikes, not the whole entire video library of TH-cam.

I think you refer to the method TH-cam uses as "guilty until proven innocent" because "innocent until proven guilty" means more on the lines of you need proper evidence until your channel is taken down for DMCA violations, and that is certainly something that is NOT happening. I do remember IHE's case (big fan of Alex). And Doug's case is incredibly simmilar (and to an extent, more indirect than just completely shutting down the channel due destroying 5 copies of a shit movie one could by from Poundland or Dollarama)

I was just saying this on my Facebook page but what really annoys me is that when you do get a copyright notice on your video (false or not), all the ad revenue goes to the claimant. So yeah, these big record companies and movie distributors are stealing money from TH-camrs. STEALING MONEY!! And on top of that court case you talked about where the judge ruled in favour of fair use; it makes one thing abundantly clear. Anyone who falsely flags a TH-cam video for copyright is breaking the law and needs to be punished.

What bothers me the most about this entire situation is the silence. Silence from TH-cam, silence from the copyright holders, just no communication at all. I'd have no problem with copyright strikes, content ID hits, or even disabling of monetization if we were given clear rules about them. "If you do this expect a strike!" etcetera. But none of that is happening. You can get a copyright strike because the rights holder didn't like what you said about their content, or in some cases just mentioning their content in your video's METADATA (Title, description, tags), regardless of what the content of the video actually is can also lead to a strike. The fact that they can do this with absolutely no consequences is utterly terrifying for people who rely on TH-cam for their livelihood.

They say they won't do anything to get small youtubers flagged but they have already made youtube delete another channel (Stillcosmos) that did a Seniors React videos a few days before their Elders React series went live. Its sad because I have a lot of respect for them but what they are doing is kinda unfair given the media they chose to make content for.

+MasterVegito Thats pretty cynical tbh. I think trying to perpetrate that as their main selling point to get people to like them is just flat out wrong. Id agree and say that telling subs to donate to charities does make them look good, which of course anyone wants to look good and is definitely a bonus. but they have been directly offered money/donations by multiple (probably hundreds of people knowing Channel awesomes huge sub base) people and Doug instead says "Just donate it to charity instead". That says a lot about his character, because he could have easily taken the offer and linked a patreon/paypal donate URL along with the charities. He even kept the charity names on screen, even after the video was done and it cut to a black screen, for over 30 seconds. I mean, i understand where you're coming from, but Doug ultimately gains nothing he already doesnt have from directing his subs to donate to charity instead of to him personally.
This proves TH-cam needs a competitor. So they have to actually make an effort to look after you. You can't go somewhere else at the moment. They have you over a barrel. If you had more power they'd look after you without having crowdsourcing technical support.
What pisses me off is the fact that absolute shit which goes against the rules don't get taken down. Such as those "reaction" videos where they STEAL other content creators hard work, or those "prank" channels where they group women or insult ordinary members of the public. Why don't they get any strikes? There are videos of animal cruelty, people getting tortured, raped and beheaded up there for everyone to see. Why doesn't youtube take them down???!!!!

+Channel Awesome EFF is great. But you guys probably shouldn't rely on a non-profit who has a much broader focus to help defend you in the abstract. Or rely on yourselves to fight things like this for that matter. I would be interested in seeing you guys (youtubers) unionize. Yes that would be big undertaking. But imagine if, eventually, most every youtuber with more than 100k subs (region locked to the US) started paying 20-50 bucks a month. Imagine the legal support you guys could have behind you on a consistent basis. Sure it would not be nearly enough to fight every BS claim every unionized youtuber gets. But it could be enough to cherry pick truly egregious cases and take them to court to try to set legal precedents to help define clear lines and correct youtubes/copyright holders BFG tactics in defending IP. No footage from the show or audio at all, just his face in front of the camera and he got a strike and lost all monetization and the ability to upload vids longer than 15 minutes :o As for Nicole Arbour... only the Illuminati can know these things.
This echoes what happened with IHE too. Shit taken down for no reason, TH-cam refused to explain why, so he made a video about it and then BOOM, everything is restored.
+The Ramos Online It encourages an attitude of "if you scream loud enough, you'll get your way". It's shitty that TH-cam ignored the official routes taken. It forces content producers do go public with it. Which in turn, forces TH-cam to resolve the issue. But, a result of this, are viewers thinking that this approach is more effective than any other, and be more willing to apply it in life. Given TH-cam commenters have a negative reputation, this is foolish of TH-cam.

Fantastic news! I'm so glad for you! My monetization went back up just a few days after I posted my complaint video as well. I also didn't receive any human contact, apart from the occasional "We're working on it". It just went back up. TH-cam needs to seriously work on how they work with us content creators. I'm happy we have large and dedicated enough communities to rally behind us. There are still channels that don't have happy endings, because well, they're too small. TH-cam needs to look inward on how they deal with the people, driving viewers back to their site. Thank you to all who helped and supported me. Thanks Doug for bringing even more people to rally behind us. Let's hope this situation doesn't happen again.
Glad you got you're channel back in order, and you're right. There is still the bigger communication and horrible strike rules. TH-cam has been screwing up lately. I have seen you tubers get copyright claims with no strikes (one person had FIVE claims, and no strikes), strikes with no explanation, features taking away with no explanation. It's fracking ridiculous, and SOMETHING has to be done. TH-cam - this is a critical time for you. The more you tubers that talk about this, the more people discuss and share your bullshit, the worse of a problem it becomes for you. Fix it now before it's too late, before all the content creators and us viewers find a different avenue for our content.

It's pretty clear that the problem isn't TH-cam, its whatever contractor they hired to do content moderation. That's why going public worked so quickly, because someone at TH-cam actually noticed.

Yts copyright system is broken to the point where SEGA Japan issued copyright strikes on videos mentioning one of the Shining Force games. Not because of footage or even pics. Just mentioning it's title. YT made next to no changes with their copyright system to prevent that from happening. Company are using the system to take dow videos with negative criticism of their products adn this has been happing for YEARS and YT has done nex to nothing about it. Nothing. If you have a problem with your system/contractor to the point where it is being abused to slince criticism then you HAVE to make a change ad YT has not. Thats why we're blaming the because they have doe nothing to fix the problem and putting the livelihood of the people who make YT money i danger. Do you understand now? YT could have fixed this years ago but they did nothing.

(and yes that value sounds silly - but those firms have sued sue for silly amounts before). Google is not perfect by any means, but they arnt the real problem here.

These claims are just cash grabs for companies taking advantage of TH-cam's broken system. And the creators are the ones who pay for it. Or rather, correct claims (ie, content that they own) that fall under fair use because I was using it for a short parody clip. But its not Google that decides fair use - that claim appeal form gets sent to the company making the claim and they decide. It normally takes about 2 weeks for me, and (touch wood) so far all the companies (including BBC,WB,Disney) have allowed my clips. So Ive been a lucky one. I'm not saying Google cant do better - but I dont think they legally can decide whats fair use and whats not themselves as the law stands right now. To be protected from, say, Viacom, suing them because one idiot uploads a raw unedited feature film, they need to forward everything to the rights owners. While I am in favor of more competition for TH-cam anyway, as long as its US-hosted I suspect it would need a similar thing. Maybe I am wrong on this - but its how I understand how the "safe harbor" law works in the US. I am less familiar with European laws (despite being European), but I do know DailyMotion also has a content ID system of some sort, as I have had stuff taken off their without warning.
Time for my stupid copyright story. I had claims against five of my videos for- get this- MY EFFING NAME!! I happen to share the same first and last name with some no-name English actress. Her lawyers got on TH-cam and claimed five of my videos, deleting three, simply because I had the same name as her. I fought it and got four of the claims on the videos removed, but they're still freaking fighting me. One even PM'd me and said they'd leave me alone if I changed my name. IM NOT GOING TO CHANGE MY DAMN NAME FOR THESE QUACKS!! My god this system is stupidly broken

Workers have rights, and while the whole idea of living off video-making is a very new idea, the spirit of workers' rights should be recognized as applying by the courts. When employers mess with their workers, they're made to pay when exposed. It's time for the exposing to start. This isn't a sweatshop and shouldn't be allowed to operate as one.

nakyer Not when google donates to politicians. Politicians are bought and paid for by corpate America. But TH-cam can still take down a video even if fair use is the law. They could even enact a "no fair use vids" policy if they wanted to. That would be legal of them. This is why the fix needs to come from TH-camrs and fans. But, again, if any politicians get involved then great. Why should I trust a failed 2 party system of endless lie-based war, poverty, pollution and eradication of civil liberties to fix anything?
The thing is, is that it is ILLEGAL what these companies are doing. If you had a bigger law team or the money for one, I'd say file a lawsuit against any claim that you can 100% prove is false DMCA because false DMCA claims can count as "copyfraud" which has been found to be punishable by law. These companies are making false claims and they can be punished for it. Hell, if I had my law degree I'd fight for you guys and your rights pro bono but I have yet to start on that degree. I still say make a big racket out of it though if you can't take legal action. People respect you guys (me included) and people trust you guys. If you guys can help us, we can spread awareness so that maybe we can also improve the copyright/copyfraud laws protecting you guys and your working conditions.

Personally, I feel like a lot of these problems could be alleviated if TH-cam just employed one simple policy. If they take down your video wrongfully, then they have to reimburse you for every cent you lose while it's down. There, now losing monetization has transformed from you actually losing money to a temporary inconvenience. That would take away the power of trolls who issue take down strikes out of spite, too. This isn't a complete fix mind you, but it's a damn good starting point.

I am a fairly new channel and nowhere as big as you and it terrifies me that no matter what 'fair use' implies, you can still get a lawsuit from it and keeps me scared from posting any material that can inflict that on me. It definitely feels like TH-cam is not a safe platform. Where one day you can wake up and have everything you worked so hard to achieve gone and there is nothing you can do about it. Keep fighting. I am fully with you. We need to change this!
The situation I'm facing is having a certain distribution company wrongfully claiming my videos without even watching the video. I'm protected under fair use and I win all of my claims, but they'll still claim my videos and won't get punished for doing it. Even when I expressed my concern to TH-cam and my sponsor, they just forwarded me the HOW TO FILE A CLAIM guidelines instead of addressing the harassment issues.

You are one of my favourites and I have watched your content for a while. youtube need to slow down and think about what they are doing before they change things. "do we need to inform our content creators of rule changes?" - yes "do we need to inform people before releasing changes" - yes "are we doing nough for our content creators?" - no I am glad you got your monetization back, even though it can happen to me I dont earn anything yet so im not too worried, but you and other fulltimers are in serious risk when you get hit. I hope this doesnt happen again and I also hope youtube give you info as to what happened.
It is worst then no penalty for false claims, part of the problem is people actually make money from false claims. They can make money for up to 60 days from your counter claim. 30 days before the reject your counter claim, and then another 30 days before they accept your second counter claim. They Keep that money.

TH-cam has been getting shittier lately. My comments sometimes disappear. My notifications don't always work. When I sometimes try to edit a comment, commas, quotation marks, and other characters turn into some weird "&d23sjf" code. I get unsubscribed to certain channels for some reason. And a whole bunch of other stuff. I am hoping at this point that something better than TH-cam comes along so I can jump ship.
+Cherry Pauper For the comments vanishing, that can sometimes be attributed to it being marked as spam enough times to be removed, or if it is a reply to a comment chain, deleted by the original poster (who has the ability to remove any comment so nobody can see it). That would also to an extent screw with notifications. As for the rest, the coding taking place of some puncuation is a recent update problem that Google fails to address and the random unsubscribing thing has been a problem for users for years now.
+MoonlitLycan No, my comment to other people don't disappear. I am talking about original comments. I've had comments with 100-1000+ likes all of a sudden disappear when I revisit a video to rewatch it. I am not sure about the "marked as spam" reason since even comments where I ask a simple question like "how much did x cost you?" gets deleted within a few hours. As for the notifications issue, my notifications don't work. The bell in the corner doesn't work at all anymore so when someone like you replies to my comment, I don't get notified. I tried enabling/reenabling G+, but that didn't work either.

First, Doug, this is great, and, frankly, very brave of you to do. I think this is a very important issue, and I'm so glad you're going to focus a portion of your programming on it. I very much want to be a part of this conversation in any way I can. So to start, I'd like to first say that I believe the problems begin with the way Google handles dealing with creators using their services in general. I write and publish books, and the only ebook service I have not used is Google. The reason was not because I initially had trouble setting up my books in the Google Play bookstore. I've had troubles on pretty much every platform. The difference was that in every one of those cases I was able to go to someone and get the problem resolved. Amazon not only bends over backwards to make sure my content is placed up and is easy for customers to find in a timely fashion, they follow up with surveys of how can we improve our service. They do not let the fact that they're number one in selling books cause them to go stale, which is why they continue to grow and remain number one. Google has wonderful vision. They are, frankly, a corporation that I love to see succeeding. And TH-cam, which they own, is a very important service to everyone. In particular, it is one of if not the single most important thing ever to happen to independent film and television. I spent more than 20 years in the film industry, and I traveled to film festivals and experienced the elitism of the red velvet ropes enough to see that what is happening here is extremely important. But unfortunately they have a strange hands off approach in all of their services. As you say in this video, Doug, they automate everything. I laughed really hard when I saw a scene from the movie The Internship in which two men who are interns at Google get assigned to the customer service phone line. No such thing exists, that's the problem! Man, I'd love it if an intern answered. At least someone could start the process of helping. When I did finally get hold of someone at Google Play regarding my books, (after about 3 weeks,) he said that they were just overwhelmed as it was, and opening up more communication would make it impossible to answer anyone. If this is still the problem, then it needs to be fixed. Us just yelling at TH-cam and Google is not going to get us anywhere; and them ignoring our concerns will only lead to the inevitable decay of TH-cam; and nobody who cares about independent distribution should want to see that happen. I don't know the answers yet, but I wanted to put in my two cents. I hope this will be read and, more importantly, I hope it will help in terms of guiding what direction the resolution needs to go in. I will continue to take part in the discussions as this programming continues, and hopefully we can improve matters. Thank you, Doug, for starting this.
I'm so happy for you, and everyone else at Channel Awesome. I strongly hope TH-cam or content providers directly, all start suing, anyone that gives them a false claim. The message needs to be sent around the world, this needs to fucking stop.
And the amount sued for, should be adjusted, to fairly hurt the individual or company, that makes a false claim, that abuses TH-cam's current system, to threaten, censor, or hurt an innocent TH-camr.
You know i love the end of that video, where they deflected charity to them ,as a company, to people who really need help. It goes to show that even when you make money doing something you can still be an artist and still be an all round good person.
It's almost at the point where creators need to organize some sort of protest. Get enough channels to set their channel to private for 24 hours so no one is making any money. A massive dip in revenue for a day will get a response for sure. I think most channels could afford a day of lost revenue, well it's a lot less than having your channel shut down for a few weeks or even terminated.
gloating aside, i'm glad you guys are getting your youtube money back, you all work hard and I actively await each video more than I waited for any syndication tv show. You guys are great and deserve it!

At times like this I just love Doug walker. Not only is he making sure to fully explain issues on all sides, but promotes putting a best foot forwards. This is what he has been doing for years in all his reviews, and now in one of his darkest times he still follows through. I really think we should all take this message to heart and make sure TH-cam gets fixed.
I honestly believe that this issue would be resolved entirely if TH-cam would just hire people to monitor their automated Content I.D. system, because merely having essentially robots that automatically flag videos based on a rigid algorithm is not working and it more of a detriment on TH-camrs than a benefit. Both Google and TH-cam are large enough companies that I'm sure they have the resources to hire people to monitor this; actually have real humans deal with this stuff.
They only thing is TH-cam would have to justify the cost of hiring people to monitor content. Sure they could do it, it could be one of those work at home jobs. But if it's cheaper to use an algorithm that can't tell the difference between legit violations and internet trolls then they're going with the cheaper option. But Doug is right. We need to keep TH-cam accountable so they can realize that in the long run, customer service beats automated systems and eventually saves them money.

Wait so You Tube /ISN'T/ offering to retroactively pay users for the time when no one was getting paid for their work? I'd bring that up as an issue as well, that isn't right- especially since they (TH-cam) have not told anyone why this happened, nor warned anyone about it or addressed it after the fact. I think they should have to pay retroactively for the views during that time, or else give us a really good explanation for why it was taken away without any warning.

TH-cam completely disabled monetisation on it EVEN though I have exact same videos with the same cause which have monitisation on them. Never got back to me with a reason or anything. It killed my creativity and since I haven't uploaded at all.

Plus, the problem is that technically the nostalgia critic videos may not be covered under fair use, and thus the copyright claims against them may be completely valid. If that is the case then it makes them look bad to complain about this issue if the actions being taken against them are completely legal and monetization should not be allowed on these videos. It's a frustrating subject since I love channel awesome and want them to succeed but channel awesome needs to realize they may be in the wrong here
The problem with TH-cam's copyright system is that it is all completely automated and NOT done by actually people. If TH-cam created some jobs and hired like 1,000 people (or even more, they have the funds, they could do it) to just review the countless hours of footage being uploaded to TH-cam, we wouldn't have to deal with random strikes or copyright notices.
The fact that it's automated means that we have to alter the footage, we have to be careful of what we show, even if it's under Fair Use because TH-cam's system will detect the footage AUTOMATICALLY and issue the notice. Then we have to issue the dispute which could take up to 30 days if you're lucky, meanwhile everyone's watching the video and you're missing out on revenue.
You really are guilty until proven innocent because TH-cam wants to make damn sure they're not being sued by the companies that own the content. Fair enough, but this automated system has been a problem for a while now and it's just sickening what's going to other people (mostly reviewers for some reason, they're almost getting as screwed over as animators).
+blameitonjorge Hoenstly, I dont see how exactly people working to review DAYS of footage works. All kinds of things can go wrong. They can be bribed, be tired, fired for missing one single detail. Plus, DAYS of footage are uploaded in a mere hour. Its near impossible to complete so much. Therefore, the algorithm is set in place. The problem with the algorithm is that it covers so much variables are put into place that its easily abused. Unless people review the strikes, not the whole entire video library of TH-cam.

I think you refer to the method TH-cam uses as "guilty until proven innocent" because "innocent until proven guilty" means more on the lines of you need proper evidence until your channel is taken down for DMCA violations, and that is certainly something that is NOT happening. I do remember IHE's case (big fan of Alex). And Doug's case is incredibly simmilar (and to an extent, more indirect than just completely shutting down the channel due destroying 5 copies of a shit movie one could by from Poundland or Dollarama)

I was just saying this on my Facebook page but what really annoys me is that when you do get a copyright notice on your video (false or not), all the ad revenue goes to the claimant. So yeah, these big record companies and movie distributors are stealing money from TH-camrs. STEALING MONEY!! And on top of that court case you talked about where the judge ruled in favour of fair use; it makes one thing abundantly clear. Anyone who falsely flags a TH-cam video for copyright is breaking the law and needs to be punished.
The worst part is, any old Joe off the street can flag your content and say that they own the rights to it, and then make money off of it.

What bothers me the most about this entire situation is the silence. Silence from TH-cam, silence from the copyright holders, just no communication at all.
I'd have no problem with copyright strikes, content ID hits, or even disabling of monetization if we were given clear rules about them. "If you do this expect a strike!" etcetera. But none of that is happening. You can get a copyright strike because the rights holder didn't like what you said about their content, or in some cases just mentioning their content in your video's METADATA (Title, description, tags), regardless of what the content of the video actually is can also lead to a strike.
The fact that they can do this with absolutely no consequences is utterly terrifying for people who rely on TH-cam for their livelihood.

I think trying to perpetrate that as their main selling point to get people to like them is just flat out wrong.
Id agree and say that telling subs to donate to charities does make them look good, which of course anyone wants to look good and is definitely a bonus.
but they have been directly offered money/donations by multiple (probably hundreds of people knowing Channel awesomes huge sub base) people and Doug instead says "Just donate it to charity instead". That says a lot about his character, because he could have easily taken the offer and linked a patreon/paypal donate URL along with the charities.
He even kept the charity names on screen, even after the video was done and it cut to a black screen, for over 30 seconds.
I mean, i understand where you're coming from, but Doug ultimately gains nothing he already doesnt have from directing his subs to donate to charity instead of to him personally.
This proves TH-cam needs a competitor.
So they have to actually make an effort to look after you. You can't go somewhere else at the moment.

Or rely on yourselves to fight things like this for that matter. I would be interested in seeing you guys (youtubers) unionize. Yes that would be big undertaking. But imagine if, eventually, most every youtuber with more than 100k subs (region locked to the US) started paying 20-50 bucks a month. Imagine the legal support you guys could have behind you on a consistent basis. Sure it would not be nearly enough to fight every BS claim every unionized youtuber gets. But it could be enough to cherry pick truly egregious cases and take them to court to try to set legal precedents to help define clear lines and correct youtubes/copyright holders BFG tactics in defending IP.

Fantastic news! I'm so glad for you! My monetization went back up just a few days after I posted my complaint video as well. I also didn't receive any human contact, apart from the occasional "We're working on it". It just went back up.
TH-cam needs to seriously work on how they work with us content creators. I'm happy we have large and dedicated enough communities to rally behind us. There are still channels that don't have happy endings, because well, they're too small. TH-cam needs to look inward on how they deal with the people, driving viewers back to their site.

Glad you got you're channel back in order, and you're right. There is still the bigger communication and horrible strike rules. TH-cam has been screwing up lately. I have seen you tubers get copyright claims with no strikes (one person had FIVE claims, and no strikes), strikes with no explanation, features taking away with no explanation. It's fracking ridiculous, and SOMETHING has to be done.
TH-cam - this is a critical time for you. The more you tubers that talk about this, the more people discuss and share your bullshit, the worse of a problem it becomes for you. Fix it now before it's too late, before all the content creators and us viewers find a different avenue for our content.

Just mentioning it's title. YT made next to no changes with their copyright system to prevent that from happening. Company are using the system to take dow videos with negative criticism of their products adn this has been happing for YEARS and YT has done nex to nothing about it. Nothing. If you have a problem with your system/contractor to the point where it is being abused to slince criticism then you HAVE to make a change ad YT has not. So have I. Or rather, correct claims (ie, content that they own) that fall under fair use because I was using it for a short parody clip.
But its not Google that decides fair use - that claim appeal form gets sent to the company making the claim and they decide.
It normally takes about 2 weeks for me, and (touch wood) so far all the companies (including BBC,WB,Disney) have allowed my clips. So Ive been a lucky one.
I'm not saying Google cant do better - but I dont think they legally can decide whats fair use and whats not themselves as the law stands right now.
To be protected from, say, Viacom, suing them because one idiot uploads a raw unedited feature film, they need to forward everything to the rights owners.
While I am in favor of more competition for TH-cam anyway, as long as its US-hosted I suspect it would need a similar thing.
Maybe I am wrong on this - but its how I understand how the "safe harbor" law works in the US.
I am less familiar with European laws (despite being European), but I do know DailyMotion also has a content ID system of some sort, as I have had stuff taken off their without warning.
Time for my stupid copyright story. I had claims against five of my videos for- get this- MY EFFING NAME!! I happen to share the same first and last name with some no-name English actress. Her lawyers got on TH-cam and claimed five of my videos, deleting three, simply because I had the same name as her. I fought it and got four of the claims on the videos removed, but they're still freaking fighting me. One even PM'd me and said they'd leave me alone if I changed my name. IM NOT GOING TO CHANGE MY DAMN NAME FOR THESE QUACKS!! My god this system is stupidly broken

I think what's needed is for the law to get into this. Workers have rights, and while the whole idea of living off video-making is a very new idea, the spirit of workers' rights should be recognized as applying by the courts.
When employers mess with their workers, they're made to pay when exposed.

nakyer Not when google donates to politicians. Politicians are bought and paid for by corpate America. But TH-cam can still take down a video even if fair use is the law. They could even enact a "no fair use vids" policy if they wanted to. That would be legal of them. This is why the fix needs to come from TH-camrs and fans. But, again, if any politicians get involved then great. Why should I trust a failed 2 party system of endless lie-based war, poverty, pollution and eradication of civil liberties to fix anything?
The thing is, is that it is ILLEGAL what these companies are doing. If you had a bigger law team or the money for one, I'd say file a lawsuit against any claim that you can 100% prove is false DMCA because false DMCA claims can count as "copyfraud" which has been found to be punishable by law. These companies are making false claims and they can be punished for it. Hell, if I had my law degree I'd fight for you guys and your rights pro bono but I have yet to start on that degree. I still say make a big racket out of it though if you can't take legal action. People respect you guys (me included) and people trust you guys. If you guys can help us, we can spread awareness so that maybe we can also improve the copyright/copyfraud laws protecting you guys and your working conditions.
Thank you for this. It is very nice to see a larger channel talking about the wrongs of TH-cam. It seems like I only see a few smaller guys that bring it up. Personally, I feel like a lot of these problems could be alleviated if TH-cam just employed one simple policy. If they take down your video wrongfully, then they have to reimburse you for every cent you lose while it's down. There, now losing monetization has transformed from you actually losing money to a temporary inconvenience. That would take away the power of trolls who issue take down strikes out of spite, too.
This isn't a complete fix mind you, but it's a damn good starting point.

I am a fairly new channel and nowhere as big as you and it terrifies me that no matter what 'fair use' implies, you can still get a lawsuit from it and keeps me scared from posting any material that can inflict that on me. It definitely feels like TH-cam is not a safe platform. Where one day you can wake up and have everything you worked so hard to achieve gone and there is nothing you can do about it. Keep fighting. The situation I'm facing is having a certain distribution company wrongfully claiming my videos without even watching the video. I'm protected under fair use and I win all of my claims, but they'll still claim my videos and won't get punished for doing it. Even when I expressed my concern to TH-cam and my sponsor, they just forwarded me the HOW TO FILE A CLAIM guidelines instead of addressing the harassment issues.

It is worst then no penalty for false claims, part of the problem is people actually make money from false claims. They can make money for up to 60 days from your counter claim. 30 days before the reject your counter claim, and then another 30 days before they accept your second counter claim. They Keep that money.

TH-cam has been getting shittier lately. My comments sometimes disappear. My notifications don't always work. When I sometimes try to edit a comment, commas, quotation marks, and other characters turn into some weird "&d23sjf" code. I get unsubscribed to certain channels for some reason. And a whole bunch of other stuff. I am hoping at this point that something better than TH-cam comes along so I can jump ship.
+Cherry Pauper For the comments vanishing, that can sometimes be attributed to it being marked as spam enough times to be removed, or if it is a reply to a comment chain, deleted by the original poster (who has the ability to remove any comment so nobody can see it). That would also to an extent screw with notifications. As for the rest, the coding taking place of some puncuation is a recent update problem that Google fails to address and the random unsubscribing thing has been a problem for users for years now.

No, my comment to other people don't disappear. I am talking about original comments. I've had comments with 100-1000+ likes all of a sudden disappear when I revisit a video to rewatch it. I am not sure about the "marked as spam" reason since even comments where I ask a simple question like "how much did x cost you?" gets deleted within a few hours. As for the notifications issue, my notifications don't work. The bell in the corner doesn't work at all anymore so when someone like you replies to my comment, I don't get notified. I tried enabling/reenabling G+, but that didn't work either.
So there is a picture that perfectly encapsulates this problem. It is a screenshot of a Ubisoft UK video, that was taken down because it had copyright notice by Ubisoft.
First, Doug, this is great, and, frankly, very brave of you to do. I think this is a very important issue, and I'm so glad you're going to focus a portion of your programming on it. I very much want to be a part of this conversation in any way I can.
So to start, I'd like to first say that I believe the problems begin with the way Google handles dealing with creators using their services in general. I write and publish books, and the only ebook service I have not used is Google. The reason was not because I initially had trouble setting up my books in the Google Play bookstore. I've had troubles on pretty much every platform. The difference was that in every one of those cases I was able to go to someone and get the problem resolved. Amazon not only bends over backwards to make sure my content is placed up and is easy for customers to find in a timely fashion, they follow up with surveys of how can we improve our service. They do not let the fact that they're number one in selling books cause them to go stale, which is why they continue to grow and remain number one.
Google has wonderful vision. They are, frankly, a corporation that I love to see succeeding. And TH-cam, which they own, is a very important service to everyone. In particular, it is one of if not the single most important thing ever to happen to independent film and television. I spent more than 20 years in the film industry, and I traveled to film festivals and experienced the elitism of the red velvet ropes enough to see that what is happening here is extremely important.
But unfortunately they have a strange hands off approach in all of their services. As you say in this video, Doug, they automate everything. I laughed really hard when I saw a scene from the movie The Internship in which two men who are interns at Google get assigned to the customer service phone line. No such thing exists, that's the problem! Man, I'd love it if an intern answered. At least someone could start the process of helping.
When I did finally get hold of someone at Google Play regarding my books, (after about 3 weeks,) he said that they were just overwhelmed as it was, and opening up more communication would make it impossible to answer anyone. If this is still the problem, then it needs to be fixed. Us just yelling at TH-cam and Google is not going to get us anywhere; and them ignoring our concerns will only lead to the inevitable decay of TH-cam; and nobody who cares about independent distribution should want to see that happen.
I don't know the answers yet, but I wanted to put in my two cents. I hope this will be read and, more importantly, I hope it will help in terms of guiding what direction the resolution needs to go in. I will continue to take part in the discussions as this programming continues, and hopefully we can improve matters.

I'm so happy for you, and everyone else at Channel Awesome. I strongly hope TH-cam or content providers directly, all start suing, anyone that gives them a false claim. The message needs to be sent around the world, this needs to fucking stop.
It needs to stop, and will no longer be tolerated.
And the amount sued for, should be adjusted, to fairly hurt the individual or company, that makes a false claim, that abuses TH-cam's current system, to threaten, censor, or hurt an innocent TH-camr.
You know i love the end of that video, where they deflected charity to them ,as a company, to people who really need help. It goes to show that even when you make money doing something you can still be an artist and still be an all round good person.
It's almost at the point where creators need to organize some sort of protest. Get enough channels to set their channel to private for 24 hours so no one is making any money. A massive dip in revenue for a day will get a response for sure. I think most channels could afford a day of lost revenue, well it's a lot less than having your channel shut down for a few weeks or even terminated.

At times like this I just love Doug walker. Not only is he making sure to fully explain issues on all sides, but promotes putting a best foot forwards. This is what he has been doing for years in all his reviews, and now in one of his darkest times he still follows through. I really think we should all take this message to heart and make sure TH-cam gets fixed.
I honestly believe that this issue would be resolved entirely if TH-cam would just hire people to monitor their automated Content I.D. system, because merely having essentially robots that automatically flag videos based on a rigid algorithm is not working and it more of a detriment on TH-camrs than a benefit.
Both Google and TH-cam are large enough companies that I'm sure they have the resources to hire people to monitor this; actually have real humans deal with this stuff.

They only thing is TH-cam would have to justify the cost of hiring people to monitor content. Sure they could do it, it could be one of those work at home jobs. But if it's cheaper to use an algorithm that can't tell the difference between legit violations and internet trolls then they're going with the cheaper option. But Doug is right. We need to keep TH-cam accountable so they can realize that in the long run, customer service beats automated systems and eventually saves them money.

He's really made wonderful, insightful videos (and all of the other actors who do the videos with him, of course are amazing as well).
Maybe TH-camrs should unionize. This mistreatment is the reason unions are supposed to exist.
Wait so You Tube /ISN'T/ offering to retroactively pay users for the time when no one was getting paid for their work? I'd bring that up as an issue as well, that isn't right- especially since they (TH-cam) have not told anyone why this happened, nor warned anyone about it or addressed it after the fact. I think they should have to pay retroactively for the views during that time, or else give us a really good explanation for why it was taken away without any warning.
