I think what you're referring to is that the prosecution can't really get him on the payments alone. For it to be illegal, he has to have made a payoff specifically and exclusively to affect the outcome of the election.

She says she wasn't interested in money yet she signed an agreement and accepted $130K from - Cohen and Trump.
Stormy herself should have never been allowed to testify, but because she was allowed she deserves to have the defense trash her. The judge deserves to be tarred and feathered for this mockery of Justice allowing this in despite the objections and clear direction of the prosecution. She didn't give a single line of testimony relevant to the case and instead tried to humiliated the defendant in front of a jury for the Biden campaign sitting at the opposite table. Rules of evidence were supposed to prevent this but NY seems like the most corrupt place in the nation.
