i once found an entire railroad spike just on the ground near some old track. it sounds like common sense but i'd just ever seen one in person before. i was so tempted to take it home.

In the situation you just described, you can absolutely take that home. Especially because it seems like old or disused track. I took two spikes from that crossing that day. You won’t get in any trouble, it’s basically trash to the railroad - if anything you’re cleaning it up for them. What’s the railroad gonna do with a rusty spike? There are three on my windowsill right now.
