Liam Allan & Hannah Arkwright: False Allegations and Miscarriages of Justice

  • Liam Allan and Hannah Arkwright both faced false allegations. In Liam's case the police investigation led, after over a year, to trial for rape and sexual assaults. It was only on the second day of the trial that the police revealed that they had all the data from the complainant's phone and were relying on a small number of text messages which they had disclosed. They resisted disclosure of any of the other information found on the complainant's phone, assuring Liam and the court that there was nothing of relevance. The judge ordered disclosure but gave only 24 hours for Liam and his defence to review the thousands of text messages. In the short time allowed they found enough to show that the allegations had been without any foundation. The case was immediately dropped by the prosecution. Liam has no doubt that the police knew about the texts which proved his innocence but had persisted with the prosecution and non-disclosure.
    Liam and Hannah have set up a thedefendant.org.uk as a website, with a helpline, to offer support to people involved criminal proceedings. It is the only support service in the UK.

    What an appalling abhorrent thing to do to this young man and any man. This system is totally unacceptable.

    My name is Silbya and i am from Louisiana I have a true Domestic abuse case and he used criminal charges to help him get ahead in family court. I had both of the criminal charges dropped because they had nothing of any value to support the story. However the damage has been done in my Family court case. They had no desire to listen to the truth and ignored it. So in a criminal courtroom i was given more fair treatment than in Family Court. Luckily for me, i started to record everything after the 3rd false arrest even the family court trial. I was in that courtroom alone and knew i should make sure i had a true record of what was said. I am now getting ready to sue the men and women involved in this situation because i have no confidence in going back into a courtroom with people that have no value in morals or in doing their duty as a public servant.

    It’s so scary how false allegations are so easily used by women. Why isn’t it illegal to make false allegations?

      There is legislation but it doesn’t get used much. I don’t know why, although I am aware of a couple of cases which are awaiting trial. Jill

      Wasting Police time is actually a crime, but only when THEY say so. The system is rigged and rotten to the core.

      It is illegal to make false allegations it's just rarely enforced to prevent real victims from being scared of coming forward plus prosecutors don't want to lose Federal funding

    You didn't really give the full introduction to this.
    Liam was waiting for "2 years" for the case... and he was facing "12 years" in prison, and would have been on the 'sex offenders' register for the rest of his life!
    It was only her phone which cleared him because she fantasised of rape and in reality sexually harassed Liam.
    Now by all accounts friend knew all of this, and knew she was 'lying' but "none" of them came forward to tell the truth.

    "If hes innocent the Jury will decide" . What a criminal way of handling a case. The state knows full well they need no corroborating evidence and in a he said, she said argument the she said will be listened to at least 50% of the time.

    May I make a suggestion? When the lady started asking Liam questions, it took just thirty seconds before she got to asking him how he "feels".
    Subjects like this require an adult audience, at least if you want public sympathy. I don't think that childish questions are the way to achieve this. They just give the impression that you have no respect for your audience.

    I am NOT a fan of the Police and their practices; one should record everything they say and NEVER speak to them Rice vs Connolly 1966.

    How do we know that he didn’t do something? Incredibly hard to prove rape. Got to ask yourself, why would a girl put herself through one of the most harrowing an humiliating possible trials just to make something up? Maybe he doesn’t think he did anything wrong - but that doesn’t necessarily mean he didn’t. The CPS obviously felt there was enough evidence to take it to court (even though it was thrown out). If there were no grounds whatsoever it wouldn’t even have got that far….

      You know nothing. There's nothing harrowing about it She's a liar who gets a mountain of supporters behind her and access to all kinds of services she could just not show up at trial and he still went through hell for two years of his life. The only evidence needed to charge prosecute and convict is her word and her word alone Far Cry from overwhelming evidence

      You don’t know how malicious some people can be. Some lie they have been raped by their side lover when they have been caught by their own lover. Some have underlying mental illnesses who will try to destroy lives when things don’t go their way. There are of course many other possible reasons. For Liam, the police held evidence that proves his innocence. Why would the accuser ask for more sex after the incident, told her friends how nice the sex was and how nice of a person he is? Even if it’s incredibly hard to prove rape, remember INNOCENT UNTIL PROVEN GUILTY.
