The Post Office Scandal: An Absolute Catastrophe in Litigation: Richard Moorhead
How were the Post Office lawyers managed and how did they, in turn, manage the civil litigation? Who was making what decisions and what was the responsibility of the lawyers to act ethically? On what basis was the conduct of the litigation roundly criticised by Mr Justice Fraser? Some fierce criticisms were voiced by the Court of Appeal. There are many aspects of the criminal proceedings which are equally of great concern, one example being witnesses who did not appear to know what was in their statements.
There is a striking mismatch between legal practice and legal ethics.
Professor Richard Moorhead at the School of Law at the University of Exeter is an empirical legal scholar who has worked on lawyers’ ethics and regulation, the courts and legal services, and access to justice.
He is part of the Evidence Based Justice Lab at the Faculty of Laws

Falling Foul of the Disclosure Rules: The Post Office: Chris Daw QC
มุมมอง 8472 ปีที่แล้ว
Here is the best summary of how to comply with the disclosure rules in criminal cases if you are a prosecutor. Chris talks about the ways in which a prosecutor should ensure that the disclosure he/she is allowing the defence is complete and true and the consequences of falling foul of the rules. Autonomy Denied: The Pressure To Plead Guilty: Rebecca Helm

There are many unfair incentives that create pressure for people, including innocent people, to plead guilty. The Post Office scandal has thrown up many examples. Dr Rebecca Helm explains the current false assumptions relating to choice in the guilty plea system, the inadequacy of assuming that defendants have autonomy when deciding to plead guilty and suggests ways of improving the situation. ...
The Law Should Not Presume Computers Are Reliable: Stephen Mason
มุมมอง 5232 ปีที่แล้ว
Lawyers seem determined not to want to know about the reliability of electronic (computer) evidence, despite our all-pervasive dependence on information technology in daily life. The presumption, applied in the courts of England and Wales, that computers are reliable, has facilitated the appalling miscarriages of justice in the Post Office Scandal, in banking and in many other areas of civil li...
The Post Office Scandal: The Naive Faith in Computers: Steven Murdoch

The courts have a naive faith in computer evidence, based in ignorance. Since the repeal of the section of the Police and Criminal Evidence Act which required certification that computer systems were functioning correctly, a presumption has been adopted by the courts of England and Wales that they simply do, without the need for any certification to confirm it and is therefore admissible as evi...

This is gobsmacking. The unbelievable torment these lovely people have been put through by others who I could honestly believe would have signed up for Hitler’s SS in a heartbeat. I've been watching the Inquiry and it is infuriating watching those responsible saying over and over “I don't recall” or “I didn't ask questions”. TV is lucky not to have a hole in the screen! I sincerely hope Gary and Maureen are royally compensated for their financial losses, but I know that will never make up for the inhumane treatment they have suffered at the hands of Vennells et Al. Bless them both.

Thank you for uploading this video. The truth is both men and women can be violent. But the truth is both need help. Therapy is only part of the solution, understanding why violence happens and why people stay in these relationship needs to be explored. The circle of abuse begins with trauma. Trauma needs specialised support.

If you're a lifelong atheist like I was and are just now discovering this stuff. And wondering why it's so widespread and nobody stops it. You have to understand that the world is biblical. Lucifer is the "god of this world." Child Sexual abuse and sacrifice of children/babies is a form of worship for them in their rituals. Lucifer gives them power, positions, wealth and status in this world. In exchange for their worship/souls. Jesus Christ is the only way to escape this Luciferian system and see the truth. It's all clearly laid out in the Bible.

Its true. Even in a gang, there's no real loyalty. Its just jockeying for position and power. If that means shooting your boy in the back of the head, well, it just had to be done. Wow. I had no idea the deluth model was feminist driven. I dated a true narcissist for 4 years. I sought help. They were more concerned about her. Sure I had the nuclear option, but that's inert if its never used. She could manipulate and twist me into 1000 different ways, then still have everything she did be my fault. She was ivy league with years of national debate awards. I had no chance. She could manipulate me into doing whatever she wanted. Impossible. Complete isolation.

A message to all abusers of children and other wicked Godless people, rich or poor. There is a God, and He is a God to be"feared", and one day they will find out why. Be not deceived; He will not be mocked: for whatsoever a man sows, that shall he also reap (Galatians 6:7 KJV)" . Every one has to die, but after death, when the soul and spirit leave the body, they go to the final judgment", and there will be no turning back from it (Hebrews 9:27 KJV), it will be final. Eternity is a very long time to spend in Hell, and so many are blindly going there believing that this short life is all that there is. How wrong they are. As Jesus Christ Himself stated: "There shall be weeping and gnashing of teeth, when ye shall see Abraham, and Isaac, and Jacob, and all the prophets, in the kingdom of God, and you yourselves thrust out" (Luke 12:38 KJV). "Wherefore, my beloved, as ye have always obeyed, not as in my presence only (Paul's), but now much more in my absence, work out your own salvation with fear and trembling". (Philippians 2:12 KJV).

They just don't care about men in prison! Another example - male rapists in female prisons has been in the headlines over the last few years. Many oppose this - but why? The women in prison need to be protected from these men is their assertion! So the male rapists are sent to male prisons instead, where the other male prisoners are at risk of being victimised too! Why don't these other male prisons get the same level of concern and implied protection that the female prisoners were given? But what about equality or Equal protection I hear you ask? Women are protected by excluding the perpetrator from their establishment. Men are not and receive much lesser protection, if any at all, as a result. Is this the equality that women demanded? How to resolve it? However you slice and dice the prison populations there will always be some subgroup who is at risk from these offenders. So to achieve equality either you don't jail these offenders or have completely unsegregated prisons. Which option will be acceptable to women do we think? Or perhaps they don't want equality, when it is bad for women? Rape in prison has been in headlibes

Underrepresention! Odd how the femunists don't mind being underrepresented in this area? The femunists are usually dead set against women being less than 50% in any area! Same with homelessness (80% male), a victim of murder (75% male), a victim of assault (~80% male), suicide (80% male), military conscription into the trenches of Ukraine (100% male), work place death and injury to,(95%+ male) etc etc Odd how women don't mind being underrepresented in the bad side of life, but demand it so vociferously in the good! Almost as though equality is not really what they want!

Here is the thing, apart from all the other aspects of this affair the role of Lord Neuberger in the Recusal seems to have escaped attention. I have therefore pasted the following ‘The role of Lord Neuberger in the recusal fiasco (Justice Fraser) should be investigated’ on as many TH-cam articles as I could, about ten, but when I checked to see if there was any response I discovered they had all been taken down. This Kafkaesque episode staggers one at every turn, even when Big brother has been outed he seems to be still working away! I really want to know why Lord Neuberger interfered , if the recusal had succeeded the whole noble attempt at taking on the stinking system would have failed.

I was very fortunate to have liaised with American Dr Judith Reisman before she died. History is important! She witnessed Paed*phile Information Exchange promoting child abuse in a British University. She sent me her Witness Statement, which she copied to the press who of course ignored it! Approximately 94 Elite Academics voted for PIE to speak and promote child abuse. Alfred Kinsey's S-x Education is in every school. Dr Judith Reisman proved Kinsey was a monster in a Croatian Court. And she won a Court case against Playboy proving they promoted child abuse. If people in power cared about children they would have put Playboy in Jail and fined the company to reimburse all the victims. Also Kinsey's work would be deleted from all schools. Victims of abuse are told the abusers are protected by LAW by bad Police. Thank you Maggie Oliver for supporting the survivors of child abuse and rape. Your Grandchild died, you lost your husband and had to resign from your job because Tax Payers money is being wasted on a system that protects Abusers! I admire you for your courage and loyalty to those that need you. I have witnessed so much pain and suffering by victims of abuse that I know, it is heartbreaking. Many never get over the trauma of abuse. They end up on Mental Health drugs. Another system that is not working. You said a lot of victims put their trauma in a box to cope. That is what a good Hypnotherapists does. It works! God bless and keep everyone safe. 🙏

I can vouch even here in Australia, a remote Catholic (a common denominator for many of these horror stories) town called, "New Norcia" was literally built on the backs of underprivileged children shipped over here from England. They were tortured, starved, abused and like this story here, both the police and the govt knew about it but did NOTHING, preferring to turn a blind eye instead. Today, New Norcia is a 'cute' little tourist destination with an award-winning bakery. BTW, I find your frequent LAUGHTER very annoying and disrespectful to a very dire situation.
