At 1:38 the Blue Flare could have sent the lvl 3 to bottom deck. It sends a lvl 3 always, *if* it has Cyberdramon in sources sends a lvl 4.

You can still activate delay effects even if Shiva is live, I believe because it is activating an effect and not using the card
