Thanks for raising this issue...In 2019 when i was looking over internet for laws of domestic violence for men, i had this frustrating laugh on how broken our system is that inspite of having video evidence of the domestic violence, a guy got no legal protection against his wife...somehow came out of that relationship...keep making such videos till government dont make gender-neutral laws...

It is about biased one sided matrimonial laws that almost exclusively favor women. That when mixed with a corrupt judicial system becomes a literal hell for middle/upper middle class salaried professionals. The ultra rich and lower income groups are much more insulated from legal trauma

Proposed amendment to 498A is urgently needed:
1. Allow case transfer to the man’s city of residence.
2. Permit brain mapping, polygraph, or narco tests.
3. Deny maintenance to wives who alienate husbands and are educated or employed.
4. Introduce strict penalties for misuse of the law.

As a psychologist practicing in the United States with roots in India and over 25 years of experience, I am deeply disturbed by this situation. It’s evident that the individual was battling trauma and depression, yet no measures were taken to prioritize their mental health. The judiciary’s first responsibility should have been to ensure their well-being, offering treatment and family support.
Instead, the individual is left to perceive the system as complicit in their suffering-a failure not only of the judicial process but also of basic human rights. This incident underscores the urgent need for reforms to integrate mental health evaluations into legal proceedings. Protecting the right to live a healthy life should never be secondary to procedural formalities.
It is high time we wake up and demand a system that values human dignity above all

As a victim of false 498 A myself , i am facing same issues. The lower courts are especially one sided towards women.
I'm not an Indian but a request to all the indian men, please protest to legalize and normalize pren-ups. I hope that you may never need it but still it would scare the woman to weaponize marriages against men.

No, prenup won't work in India because Supreme Court of India has guidelines that whatever a woman claims (without evidence) against a Hindu man, that will be believed by the court. As a result, numerous Hindu men are rotting in jail with false grape charges (in some cases the man did not even contact the woman outside whatsapp; in numerous the men are separated husbands; in most cases it is pure extortion). Numerous (hundreds of thousands) Hindu men have self-offed themselves to the extortions from the separated wives. These men had to sell their kidneys to pay for alimony and still could not avoid their fate.

My close one is suffering from this law since 2009 & he couldn't get justice yet. He is still paying maintenance without getting divorce. He wanted to divorce his wife bt his wife didn't give yet. It's brutally depressing. He can't move on without divorce, his whole life is ruining. He has no money now, what should he do now?
He should get married. Just not legally, do not take marriage photos. If wife files case on him for marrying again without divorce, he can always say in court that he is in live in relationship and it's not illegal.

@@rajesh_624 Pre Nups shouldn't be introduced in India atleast with the current patriarchal society because many woman in India directly depend on their husband for income and many woman in India are forced to marry in many cases and this means they cannot have say in the terms of the prenuptual agreement and if they don't marry then the society and their parents will look down on them even stop providing them financial support so a woman may marry someone even with a prenup agreement that is totally against her interest.

Reforms in judiciary is the first step to be taken. There is no practical mechanisms in India to pull the plug on judges and this gives them the audacity to abuse their discretionary power. HC and SC judges can only be impeached by the parliament and this has to change. No action will be taken against judges even if a complaint is registered against them before the concerned court. Majority of judges are biased when it comes to matrimonial litigation. Judiciary is trapped in conventional beliefs and wisdom.

If government does below amendments on priority then it will greatly reduce false cases.
1. Registration of 498A FIR only after verification/submission of proofs, bailable etc.
2. No interim maintenance at all OR interim maintenance to be refunded if allegations proved false.
3. Alimony calculation basis of duration of marriage.
4. Strict punishment once allegations proved false

I watched Wire video by Karan Thapar few weeks back focusing on additional 76 lakh votes getting added after Maharashtra assembly election closed between 5.30pm to 11.30 pm on the election day. Is it possible to explore this further?

while this could be possible - the opposition needs to do a better job in finding out the truth

I've experienced and am still experiencing the harsh reality of the judiciary system in India, which is not as per the expectation and biased towards a gender. I've seen how the laws have been misused and jeopardize the faith in the institute of marriage for so many people. Hoping that our judiciary system considers gender equality in the future.

I have watched several videos of Atul Subhash so far, but the truth has not come out in front of anyone yet. The fault does not lie with the girls; behind them, there is a 'Ravan' whom we know as a lawyer. Most girls are not aware of the law, and these lawyers instigate them and take money. If a lawyer knows the truth, they should not take such cases. Instead, a case should be filed against the girl herself. A criminal is never inherently a criminal; they are turned into one by influencing them to commit a crime. Lawyers who take such cases should have their licenses revoked and should face strict punishment, regardless of whether the lawyer is a man or a woman.
