People don't seem to understand that if machine guns are unbanned, the pre ban ones are going to retain most of their value. There isn't going to be an influx of old m16a1s into the market, supply and demand, little supply, little demand currently. If unbanned, the supply would remain the same and demand would change little, because people still want to buy old machine guns as collectors.

Judge John Bruns said it best "possession of a machine gun is a constitutional right" period.
Don't kid yourselves, it's not the machinegun, it's who else has the machineguns. That said, if our 'paramilitary' ATF, DHS, USMS, FBI (To list a few) have machineguns, APC's, SWAT gear and weapons, so should the people.
But I will say something sweet... If it ever comes to, we have enough battle-hardened U.S Military veterans that can always bring Iraq and Afghanistan to the home front and give these bastards lessons of war.
They can take our guns away, but not without the cost of a lot of lives on both sides, especially theirs.

They have been legal but there red tape to get registered pre 86 machine guns, and there's a lot of red tape to get post 86 machine guns and dealer sample mgs. And you need super deep pockets especially for transferable MGs.

I'm not even American, but a simple look at the Constitution seems to show the Founding Fathers specifically intended for "weapons of war" to be legal, i.e. the right to bear arms was for the purpose of being able to take part in military conflict, always been confused by how they snuck a ban on automatic weapons through.

A non guilty verdict can only be appealed if a judge decides against a jury’s guilty verdict but those cases are extremely rare.

only means the government can't ban firearms, gun ranges can do whatever they want. I suspect the ones that allow full auto will be rare, including state and federal ranges owned. 50 cals are legal but almost everyone bans the use of them on the range and that hasn't been challenged.

And the 2nd Ammendment is not what grants gun rights, its only what protects it (we in France let our rights be stripped away by the 3rd republic and the Vichy régime (where you had the worst gun control in french history), aswell as the 4th and 5th republics.

Before the 1934 NFA, you could buy a Thompson Sub-machine gun for $200 and have it shipped to your home. And THAT is where the ATF came up with the $200 Tax Stamp.

I hope that we get our right to own machine guns restored in this country. I remember trying to get the adults in my family to buy machine guns before the ban took effect in 1986. They didn't because nobody wanted to listen to what a teenager was saying. I want and deserve the same opportunity to buy a machine gun that my father and grandfather had. Better yet, I want and deserve the same opportunity to buy a machine gun without an unconstitutional tax that my ancestors had before 1934.

MGs have no barrel restriction so you would get SBRs & SBS when you get MGs.

It's actually easier. If all easily converted to auto guns count, let me ask you what it takes to mod your G17 frame into an auto switch on the slide.
Oh wait, 2 minutes in the parking lot outside the pawnshop with it in your hand no frame mods and it's auto. So that makes all Glocks by definition a machine gun because it's easily converted.
Glock is one of the most common guns. Thus one of the most common guns for civilians and police, not to mention criminals and feds, IS A MACHINE PISTOL. Done. It's not to be touched by the NFA at all! No tax stamp needed.
Since it seems like this is a Post-86 MG issue I would imagine the ruling would be to vacate the Hughes Amendment. Which means that Post-86 MG's are on the menu.
And if I remember correctly the Hughes Amendment added suppressors to the NFA as well.

Hughes is a part of the broader Firearm Owners Protection Act (FOPA), hence it being called the "Hughes Amendment." And as far as suppressors go, they were already on the NFA from the very beginning. Individual parts weren't on the NFA until FOPA changed the legal definition of a silencer to include said individual parts (such as wipes).
@Expatris He's right. Silencers were a part of the original NFA 1934. The only thing the Hughes amendment did was forbid the manufacture and registration of new machine guns. Nothing to do with silencers.

Hi and thank you for your service, I can answer that question for Massachusetts it's absolutely no. We just got hit with one of the biggest gun laws in history. We're down to lever actions, bolt actions pump shotguns and a few semi auto shotguns. We are fighting back but we need a lot of help.

Though I disagree with the ban a rifle is not really the best weapon for home defense due to over penetration. I feel like pistol carbines and shotguns are better for that application. Lets be clear about one thing. This case would not touch the NFA. It would simply remove the ban on new machine guns. In my opinion that is absolutely great for a short term win. A new $300 full auto AR is a net win.

The govt needs to back off restricting any kind of firearm. They are specifically forbidden from touching the fringes of anyone's right to bear arms or access ammunition.
I don't understand when in history we forgot the second amendment. We just magically started making laws against machine guns, suppressors, "assault rifles" even though they aren't legally defined, magazines that have useful ammo capacities, and _conceal carrying_ even. When did this happen?

If you have the money you would be able to purchase and bear it. In reality this would be a terrible idea now with the way millitary tech is progressing i mean think about it, your neighbor becomes a multi billionaire and is now in possession of an apache helicopter with hellfire missles. While that would be totally badass it kinda begs the question how would we allow people to own and carry automatic firearms and not run the risk of some idiot spraying with no regard for human life. Other than lock up people who haven't done anything yet because they are in the category of people that are more likely to do so or restrict access to tools for everyone because a percent or so of the population will misuse them. Not sure you can call yourself a free society going down either path. Regardless of how many lives going down either path saves. Maybe the tradeoff is worth it but call a spade a spade as they say.

I think the 1986 act also forbids manufacturers from introducing new machineguns to market. But if possession of unregistered machineguns isn't illegal anymore, than you could turn your AR15 in to one yourself.

Brady was severely maimed during Reagan's assassination attempt. It's not just Democrats that support gun control.
Sadly there would likely be several people who own transferrables that wouldn't want to see this happen. They have a ton of money in their collection and wouldn't want to see it lose its value.

What about the glock 18c or Škorpion vz. 61 or beretta 93r? All of which I think have existing produced quantities that could support a niche consumer market.

Cautiously optimistic. We've been promised the repeal of many laws and nothing changes. One exception the sunsetting of the '94 Omnibus Crime Bill in 2004 where GWB did not reinstate it. Fingers crossed.
The ammo manufacturers should be pushing for this.

I don’t think we’re going to see machine guns at our local gun shop any time soon, but what would be nice is at least ditch the pre 86 rule and lower the tax stamp fee to something reasonable. Also have a much quicker process. Seriously they already check my criminal history when I buy a deer rifle, what more do they need to know for a machine gun? They could check my bank balance and know I am no threat because I couldn’t afford to feed a machine gun

Time will tell the outcome of the 2A debate. Our constitution has endured through out several centuries, while today's modern gun control begun with the democratic party adopting liberal progressive socialism in the 20th century. I believe the words in our second amendment "shall not be infringed" will be taken at it's face value in the near future.
To be fair, i think my capabilities are far greater with a semi auto rifle, than any loser in Chicago who has a switch on a glock. But i would love to see newly manufactured machine guns legal again. Thanks Eric great video.
