It's like the ugly oak cabinets, had to be painted white. Now white is out of style - time to repaint! It never ends...

I don't get how the Plaintiff can be a general contractor, licensed, insured and bonded but failed to get a contract and receipts he paid for materials and bring it to court when hes the one suing. 🤦♂

Depends where he is. I've been a licensed contractor in several different states and municipalities... Some have stringent requirements and testing to get licensed, while others not so much. I don't remember where, but one state only required you to register as a handyman to call yourself 'licensed'.

Someone goofy as hell. Those are the worst! Now the standard is just texturing the ceiling and walls because it’s easier than making it work flat. Which sucks, I hate textured walls especially.

She screwed him by forcing him to answer yes or no instead of asking how much of each item was completed. If he installed, taped and mudded the drywall and only lacked paint and texture, the binary (yes/no) answer is "no" even though that portion of the job was 95% complete. It's an injustice to make him swear to tell "the truth, the WHOLE truth, and nothing but the truth" then only allowing him to tell part of the truth. He didn't do himself any favors by leaving receipts at home.
In civil trials and those before mediators or arbitrators, the person officiating the trial will often ask questions that are focused on getting to the point of the complaint or forcing the respondent to answer 'yes or no questions. This is done to 'cut through the BS"....Each litigant is afforded the opportunity to present a written statement of complaint or defense pretrial. The court official is able to review the statements long before the trial or hearing begins.
FYI... Because of the oath you just quoated, you never only have to answer yes or no in court no matter what question is asked. They can't force you to only answer yes or no.
He asked if he could make a statement and she said sure. So she heard those points and still made her decision.

She wasn't asking him if he completed each project so he could have answered that he partially completed certain jobs.

Well if client agrees on the price of the materials and materials were bought than it doesn't matter if you as a contractor paid for it 1000$ and agreed ammount was 500$ (in that case you lost money) or you bought it for 500$ and agreed amount was 1000$ (in that case you earned money). Contractor f*cked up but judge was shit in this situation too. With her logic if there was a point: "Builds house, builds roof, etc. and installs front door". and he didn't install the door than it would mean he was not 99% ready. She literally stole from him all the work he did on the ceiling (because it was not painted not due to his fault) and one wall because there was no texture on it yet (not due to his fault).

@@sawyer4981 I bring mateiral costs because contractor said price was agreed upon and he has messages. So judge shouldn't care about real price he paid. And she did fuck him over. She deducted 100% for 2 iteams even though it was almost done.
Had a similar experience. Was hired to repaint kitchen cupboards from brown to white. Worked 2 days sanding, priming and removing paint from cabinet hardware and hinges. Came back the third day and customers husband had painted the cabinets and doors.... About 4 hours work. They completely stiffed me on the job. So, when I left I drove through their front yard and trenched it!!
I am a cabinet refinished if a customer touches the cabinets after I start, the price goes up. I take the doors to my shop to be worked on and they just won't get back.
They wanted the prep work (the hard part) done for free. They stole your time and your labor. I wish you had sued them.

I've learned from watching Judy for years: be prepared, take pictures, have a (legit) contract, have a lease, and go to the doctor if hurt by person, item or animal (so you have a hospital record).
Don’t pay cash for anything without a signed receipt.
23 is pretty young for a GC. It's possible the guy started really young in a family of GCs, but I'd pass on a GC that young. Admittedly, the job seemed pretty minor, so he was operating more like a handyman.

This guy does a TERRIBLE job defending himself. His primary argument is that most of the items were partially-finished, but he doesn't challenge her at all when she asks for yes/no answers. He spent time and materials to get those items partially finished. And then to show up without receipts and totally unprepared? As a contractor, I see this a lot. A lot of guys are just really bad on the business side of things. No clear written contracts, lack of organization, progress photos, expense tracking, etc. It usually shows in the work as well.
Agreed. This is one of the biggest issues with contractors. They're usually trades people with zero business sense. Even getting them to just show up when they say they will is a challenge.

I've been watching Judge Judy and other courtroom shows since the 80's. It was interesting how text messages were once never considered valid proof of evidence, but they started to be admissable as time went on and they became commonplace. Some judges at one point refused to accept text messages from plaintiff or defendant.

@Craig Dendy Correct...And this is quite easy. The judge simply has to ask each litigant to see the messages memorialized on their devices or allow a time stamped printed copy ot texts, emails or other electronic communications
@Craig Dendy JJ stated very clearly that had he produced evidence of time an materials, he would have been awarded a higher amount.
The plaintiff DID NOT come to court with the evidence required to prove his case. The operative being PROOF.....Just remember, in civil litigation, there is no such thing as "deserve"....It doesn't matter what the plaintiff believes or claims. The only thing that matters is what the plaintiff can prove.

@@rmp7400 I know people that are tight on money. It's not that it's a lot of money. It's more that they can't afford to pay that type of money most the time. Though ironically a lot of those same people only throw that excuse around when it comes to things that they actually need to pay versus luxury thing, but that's another story about misplaced priorities.
Now the fact that he sued was because he was hoping to come out with a lot more and by submitting his case to judge judy he already got paid for embarrassing himself. However if he had won his law suit he would have made more, I think that's how the deal goes on that show.

Judge Judy deducted the full amount for the ceiling, but he told her he had installed the drywall on the ceiling and it was mudded, just waiting for the texture. That's most of the work. In that instance Judge Judy cheated him. But I hope he learned his lesson and is operating under contracts now.

JJ definitely got this one wrong. I would say if he resheetrocked, taped and muddied the ceiling he had the job probably at least 80% finished. Also I give quotes but I don’t ever get a “contract.” Unless it’s a big remodel job or a new build I don’t see the point of it. He should have got half his money up front, 25% mid way through and the rest at the end.
Yes, but you need to keep a paper trail of them agreeing to or accepting the estimate or quote before you start work. Easiest way is to do it is through E-mail. You send the quote, they respond and say “looks good let’s get started blah blah blah” and then that is considered them “signing” a contract. Always communicate through email, or memorialize verbal agreements through email. It’s the easiest way to maintain a paper trail. If you’re working in paper always have them sign a copy of the estimate before starting work. It protects you. The point of it is to keep

They take the effort to write up an itemized contract but they can't take the effort to write up a signed check. When called out on it they always say I learned my lesson.
It's obvious he runs his "business" by the seat of his pants so I'd say it's much more likely he offered a discount for cash to avoid tax.

As a general contractor for swimming pools, some of my "works of art" were my bid forms, contracts & change orders!
State of Washington requires no experience to be a licensed and bonded contractor. How do I know? Cause I was one but I’m actually a lawyer. I got my contractor’s license by paying a $250 fee and then getting insurance for about $300. I saved thousands on material while doing an extension on my house there.

@@rmp7400 There is more than one path to God, and righteousness is uncoupled from man-made religions or titles. To act virtuously is to do good, and honesty and fairness are virtuous and good. Intelligence in and of itself is not good - there are a lot of wicked but intelligent people. But, intelligence discerns and is therefore a vehicle with which one can achieve goodness. Judy uses hers to do good. We're all imperfect, Judy included, but I think most anyone would agree she's good, and at the least a lot more full of goodness than a lot of the lying scoundrels that she deals with. Absolutely none of this has anything to do with being a devout Christian and everything go do with being good. Some Christians are charlatans. If by devout Christian you mean one who is not a charlatan and who does good, it's still a subset of that which is good.

That’s what I thought! Whenever people try to answer that it was almost finished, she says it’s a yes or no answer. Well, this guy answered no, that it wasn’t complete, but then went on to explain that that line item was almost finished. I think she got this one wrong!
That's the reason I complete tasks by the line item. If it's not 100% complete, they'll avoid payout and it does not matter what labor or material went in to it.
He should've brought the receipts of material purchased for the mud and drywall. He would've gotten paid for the amount of work he did. But the way he explained himself seemed like he didn't do much work at all.
Yes, I don't like judges deciding things like that which they don't understand. But they think because they went to law school and passed the bar exam they're smarter than the rest of us. There are things you have to be in the field to understand.

I was a gardener. I did a quote for hedge trimming and luckily wrote what side of the garden she said to cut as well as the height to be six foot and she said she wanted more done but I had the quot3 on paper! It saved me a lot of trouble!

If she had claimed that she paid 1000 bucks cash to the contractor, also without any proof, he would end up having to pay her back 175 bucks in that case....rediculous that it all came down to her word without proof and not his explanation that hecwasnt allowed to explain....namely that if the customer chucks you off site just before you finish the job, that shouldnt mean that you dont get paid anything for your work because it was not fully finished!

The guy calls an estimate a contract. It is not. Then he thinks an estimate for materials is proof of what he is owed for materials. It is not. Now he knows why the extra hassel of a proper contract and keeping his own written accounts is worth doing.

Back when I was young and dumb I built a 12X12 deck for a nice old retired lady. She paid for materiels up front and I agreed to be paid for labor when the job was finished. The deck passed inspection, and she stiffed me on the labor, which was $1200 back in 1982. I had no written contract, so I was screwed. Never made that mistake again. Always got payment as the job progressed, as outlined in the written contract.

I was so excited that a contractor actually was the plaintiff for once because those guys usually don’t like suing people, but once he said that he didn’t have a contract I couldn’t take him seriously so I’m not even finishing this episode. Absolutely ridiculous. 🤷♀️

I heard a plumber say people will wait till you're 90 percent done then say I'm going up town to pay some bills. Never come back until plumber has to leave. Leave the bill on table and they throw it away.

The list/cost of materials makes ZERO sense. He doesn't have to show a bill for them. He is doing it based on specific job(s)contract and NOT T&M. What if he got the materials for free? Does that mean he gives them away for free? Judy screwed this one up BADLY.

Why would you begin a general contracting job without preparing a contract and getting it signed? Also, get all the work and change orders signed and notorized by the person requesting the work.
