Yep! A landlord kept my elderly Moms deposit bc he said that he thought I would be living there too. Married husband with kids and a home. Basically, I am my Mom's assistant, bc she cannot read, or write. He knew this going in. He thought he was going to take advantage of my mother and he quickly realized that wasn't going down.
Tenant was absolutely right to get her deposit back. Some landlords love to promise clean and decent spaces, and then benefit from your hard work when you clean and make it decent.
Brand new fresh ink receipt, no crease or crumple. I'm a receipt hoarder and I would never have a receipt that pristine other than during the 30 seconds when it was handed over to me.
It's not "nuts". If they made the landlord lose a month's worth of potential rent then absolutely the landlord has the right to keep at least *some* of the money. In addition, although the landlady in this case did not pay for any reparations or re-installments, and thus had her counterclaim dismissed, generally, any altercation done to the house would have given the landlord the right to receive money for damages.

Let us say you want to move out today, often your contract permits you to terminate your contract after three months of official termination. The one wanting to leave immediately. The landlord wanting the monthly rent from whoever. Lastly the new person looking for an apartment and getting recommended by you. However if, before you move out your landlord notices major damages you caused, or if you fail to pay rent, he is entitled to keeping the amount it costs to fix the financial imbalance.
Never trust landlords when they make a deal with you to do free labor.. you'll improve their property with your efforts, and to thank you they'll increase your rent. Happened to me.
Many of them will put the rent up anyway even when you do nothing to the place. Usually after 2 or 3 years the rent goes up, because everything is going up.
Not every landlord is bad, but if you're making agreements to do work for them, get it in writing. It's a red flag if they don't want this as it covers all parties. I'm a landlord and have long-term, excellent tenants in a property. The gentleman was made redundant and took a few weeks to find a job, so they were struggling to make the rent payment that was due while he was unemployed. They let me know in advance and so I popped round and had a chat. They could give me half, so I suggested that they do a few repairs around the house, using the half rent they had for supplies and the labour would top it up to a full month's rent, so that they wouldn't be in debt. It helped them and me (as I needed to get the work done and, this way, it could be done at a time convenient for them, to a standard they were happy with). A win-win for all, but it was reliant on trust and us both keeping to our word. So I wrote up a little, basic contract, stating that I would accept completion of these works (to a decent standard) in lieu of rent for that particular month. That document made sure that we all kept our word and stopped anyone worrying that they were going to get screwed. Always get everything in writing!
The landlord does not HAVE to have the carpet in good condition to rent it out. She rented it AS IS to the tenant and gave the tenant permission to tear it up.
The landlord was charging her $100 more for rent she put down $1600 ($800 deposit + $800 monthly rent). Then moved someone else in at a $700/mo in May 😡 JJ seen the con in the landlord; and the plaintiff (I hope) learned a lesson.
That's the thing. I don't believe any of it was for rent. I believe it was a deposit to fix the floor. She was going to have to pay the first month's rent once she was able to move-in, in May. I believe the plaintiff. The landlord didn't want to use the sixteen to follow through with updating the floor.
A security deposit is to ensure that you have some money to clean the place up if a tenant leaves it a mess. It’s typically not to make money off of a tenant that changes their mind.
You are…misguided. In most places, it’s to cover any monetary damages caused by a tenant. If a landlord is given a deposit and takes the property off the market and then the tenant doesn’t move in, causing the landlord to suffer the monetary damage of loss of rent, the deposit stays with the landlord.

I took my mom a senior citizen to look at an apartment after she decided she no longer wanted to live in her house. It wasn’t clean but the manager told us it would be before the move in date. Those people did nothing and I had to clean the refrigerator just so my mom could have somewhere to put her food. Some of these people are lazy af.
