Hi Oscar, USCIS received my I-485 on May 21st of this year. I was told it would take between 4 to 6 months. Does that sound realistic? The status in the visa bulletin is Current.
Well, I cannot say that the I-140 (EB-1A) regular processing time has improved in 2023. My case has been in USCIS since January 2022, and the regular processing time increased from about 18 months to 23.5 months since then:)
Yes, that's possible. It seems EB1A has a longer wait time than others . The processing time shown in the website is conservative (defined as 80% completion) but the median processing time for I-140 is aggressive because it includes all green card categories and some have very short times .
hi Oscar! this is great info. I have a question, I am going to purchase your documents, but I wanted to know if you knew if it is still possible to travel into the US on b1/b2 visa (As a tourist) once I submit the petition and apply for the EB1A or O1, or do I need to stay in Mexico (my home country) while the petition waits to get approved (or denied)?
Hi! That is a nonimmigrant visa so you could face issues. That being said if you have the visa already, chances are they will let you in but it's not guaranteed. If possible, avoid travel , if not, consult with a lawyer
Hello Oscar, thank you for making this video. Do you have a video or more information about employment authorization/work permit and Permission to travel (Advance Parole)? If an applicant filled 140 NIW with I485 and received an approval notice, does he need to file forms for a work permit and travel permission? or USCIS will process them automatically?
I am not sure if you are asking about EB1 specifically. If you are , you can download my adjustment of status package which includes these two additional interim benefits eb1greencard.info/dowloads/
If you want a free resource, you can watch this video I made for EB2 NIW, but the process for AOS is the same basically for both categories th-cam.com/video/OTKlopGf3D8/w-d-xo.html
@@jamesmac6102 Ok, I asked because this video is about EB-1A. Then, you can download the Adjustment of status package for EB2 NIW here eb2niw.info/download-my-eb-2-application/ and the video I referred to is for NIW
Hi Oscar, Thanks for such a lot of effort you put for helping others. I really appreciate it. My NIW-EB2 got approved but I figured it out I had a good chance for EB1A too. Now, I am thinking to bypass the waiting time of NIW-EB2, file another petition for EBA1. Because for EB1A, the backlog is much shorter, almost current! Do you think it is a good idea? If the second petition got denied, does it affect my NIW-EB2 approved case? I appreciate your help and advice.
Hi, thanks for your words and congrats on your approval. Both applications are totally independent . If you need resources for EB1A check out eb1greencard.info including my online course . Good luck
