    A rich guy from the Toronto area was on trial for murder. He had paid his attorney almost a million dollars but still ended up getting found guilty. So, there was joke passed around local criminal defense lawyers going something like 'Had he hired me, I could've lost that case for him for half a mil'.

    I told people an appeal is not the same as a new trial. You can’t argue facts of the case in the appeals…you can only appeal that something faulty technical stuff that the judge, attorney or jury did. Then an appellate judge see the person’s rights were violated only then can an appellate judge say he needs a new trial…then he can present new facts or argue the old facts again

    • @jas1565
      @jas1565 ปีที่แล้ว +8

      To add to that, the errors would also have to be extreme enough where IF those errors were not committed, the results of the case would have been different. For instance, the appellate court can find errors were made but they did not change the outcome of the case.

      I agree. This guy is a hack. A divorce attorney has no right nor expertise consulting on assault, immigration and firearm charges. I know two attorneys who dragged him about some incorrect and slanderous bs that he was supporting from one of those messy gossip TH-camrs. They succinctly laid out the facts and why he and that person was wrong. He got all wussy and egotistic then blocked them. He tried to claim that it was YT removing comments despite that both lawyers had entertainment, copyright, libel and slander and computer software backgrounds. TLA definitely wouldn’t hold up going against mainstream and well seasoned attorneys (Fox, CNN, Baez, Geragos, Allred, Crump).

    if Tory wasn't the shooter, his best strategy would be to testify and identify the shooter at the close of the defense's case. he got on the phone in jail and apologized for the shooting, which is the very reason he couldn't take the stand. all the old "we must stick together 'cause the man wanna keep us down" is some sucker stuff. blk identity is a darwin award.

      @@willmurphy-hg5hv logic speaks a clear language to a rational mind. black identity is an illogical state of mind, not a physical trait relating back to Africa nor ppl who "look like" the notorious "paper bag test." so-called black americans share more dna markers with so-called white americans than they do with native africans. that is, if any of your ancestors were enslaved, you're partly white. so, the survival of the fittest claims are non-starters.
      ignorance is another darwin award. neanderthals stuck together against the homo sapiens - aka "the man" - and still got destroyed, because they were irrational and irreligious. in 2020, blm marched and raised millions in outrage for a half dozen lives that mattered while interacting with cops; meanwhile 10,000 lives that did not matter were taken in senseless gang violence. meg pretended like tory didn't shoot her because she was at the precinct worried about the impact it would have upon the rhetorical movement about black lives. then later, tory invoked his skin color to seek sympathy for losing the trial where meg's credibility had been impugned. darwin salutes yous and appreciates your advocacy; Murphy's Law will prevail. yall gone stick together and keep each other down and then comment to reveal that you don't even see you're doing it to yourself. or was it jay z's fault like your dad said? Maybe he shot her or didnt but there was alot of conflicting evidence. He was not convicted for shooting megan. He was convicted on wrecklessly firing a gun that he wasnt supposed to have. The witness the defense called said he was watching and saw a flash come from the short girls direction and that the short guy got out of the car and took the gun and fired it in the air. Saying that right their made him guilty of the charges. That is why the father was upset because they didnt think he would say Torey shot the gun in the air. The defense was trying to set it up as Torey only had gun residue because he was near someone shooting the gun but wasn't the one who was shooting it. Also they didnt test Kelsey for gun residue at the scene but they did for Torey. They tested her later and they both had gun residue on them. They were also able to find kelseys fingerprint on the magazine of the gun. The witness messed up the defense plan of trying say that Torey pretty much took the gun from Kelsey while she was shooting at Megan and thats how he got the residue on him meaning he never fired the gun and the worst charge wasnt applicable.

If you please guilty you have 6 chances at an appeal. But like I said if you're taking a plea deal that's going to send you to prison for decades anyways you go to trial.
