He came to one of the final days of trial ready to testify, but the prosecution needed another 2 weeks for prep, and they decided with all the lies and reasonable doubt they didn't need it. Let’s clear some things up:
1. Tory’s defense team DID try to call the driver to stand, the DA objected because they were not ready to cross him and wanted to delay the trial
2. The driver testimony would have made a huge difference as it provides context to Shawn Kelly’s chaotic testimony, proves Meg’s “dance b dance” story is false, and proves Kelsey had motive and intent

2. Who goes to jail for someone else’s crime and immediately calls the actual criminal to apologize for something he said he didn’t do?
3. During that phone call, Tory says, “I would’ve never done that if I wasn’t drunk… She’s probably never going to talk to me again.” Such statements are more indicative of a serious situation like a shooting, not a sex-related incident.

Attorney here.. it doesn't matter. The "lie" shows the character of said person. This is the exact same reason when permitted, what you said in an interrogation can be used against you in a trial as well. That's not under oath either, but if you say one thing during an interrogation and then change your story on stand under the oath, it gives any attorney with common sense the ability to use that in their favor for their client before the jury.
