No the problem will arise during granting maintenance to wife in same sex marriage. And who shall be considered as wife in same sex marriage. For example if 2 girls get married and down the line some dispute arises between them and one of the girl assigned wife files for maintenance. It would not preclude the other girl assigned as husband from not filing counter application for maintenance. And it will create great confusion in the judiciary deciding those kinds of applications.

No the problem will arise during granting maintenance to wife in same sex marriage. And who shall be considered as wife in same sex marriage. For example if 2 girls get married and down the line some dispute arises between them and one of the girl assigned wife files for maintenance. It would not preclude the other girl assigned as husband from not filing counter application for maintenance. And it will create great confusion in the judiciary deciding those kinds of applications.

India is going back to its roots..emerging from decades of useless regressive laws..to being more inclusive and compassionate towards all beings who inhabit its lands..to ensure justice and equality to everybody regardless of their religion, caste, belief systems, or even sexual orientation...!
If it is the question of benefit then the government should give social benefit to everyone. When it comes to inheritance, it can be passed on under a will, there is no need to legalise same-sex marriage. It seems SCCJ DY Chadrachud, instead of being impartial and hearing the arguments from both sides, was making a case for same-sex marriage.
That probably is because the SG has come up with utter nonsense arguments under ignorance of the subject..to which a rebuttal was necessary then and there..which the CJI promptly does..you see.
@@rahuln917 You have a point, does this mean that the SC Chief Justice wants to impose his own will and ideas on the people of India and force them to accept them? And social, cultural and religious practices do not matter because they are outdated which is not true. SC Chief Justice's ideas are based on perhaps his Western education and culture which are foreign to the majority of people in India. The law should make ens to all the lay people of India and not only to the CJ of the SC.
@@takahapana557 If you have observed the proceedings very carefully, it is obvious that the CJI having tons of experience on judicial matters, a learned man, is not trying to impose his will rather he is discussing the matter based on what follows from the basic foundation on which our constitution is built to which the Sg has also agreed in the ending part as you see. Fundamental rights must be equal to all and it is independent of will of the majority of people.
Also note that this issue is specific to the people of this group then how will it affect the majority people? You talk about the social cultural and religious practices, then I ask you, how legalizing same sex marriage affect all these? will you explain?
We know how, practice of triple talaaq which was morally wrong but socially acceptable by majority of the people of that specific community was abolished...we also know how practices of child marriage which was so widely accepted was abolished by bringing laws for it...what would have happened if we went with the so called "majority" lay people of India as you call it, while taking decisions on such practices? We would have been stuck in those regressive practices forever and never progressed on moral and ethical fronts. We need to move on and have an open and accommodating mindset about everything now. The majority people are simply opposing this because there is not much awareness about the sufferings of LGBTQ people. The stigma they have to face, the burden of forced marriages, and a whole lot of other issues they face in daily life for no mistake of theirs, nobody chooses to have such a life!
@@rahuln917 I have observed the proceedings and have also looked at the same-sex marriage approved by the US Supreme Court although there were dissenting judgements also. My take is that SC CJ DY Chadrachud tends to be inclined towards same-sex marriage. He should see what the majority of the Indian population wants as he cannot legislate for a few because it will not be accepted by society and rightly so.
@@takahapana557 the fundamental rights of a minority can not be dictated by the majority, that defeats the purpose of fundamental rights in the first place.

If same-sex marriage is legalized, society/people should take matters in their hands and protest violently against it.
Like when laws to abolish the age old traditional of "sati" and "child marriage" was removed?..Like when people killed socrates for propogating truth? Like they sentenced galileo to lifetime imprisonment for saying that earth revolves around the sun?..If Society protests against this issue then it is essentially protesting against itself..it will only be the failure of its own moral code, because in the end, an individual makes the society
