    You need to request his video footage. It will show him adding the speeding to the ticket after you asked him to explain the ticket. They have to release the footage to you, or your lawyer. Hold jackass accountable and make a huge video of it.

    1. Officer clearly was targeting, and that's evident from the comment about the Huntington Beach address.
    2. He willfully ignored his duties and tried to threaten more repercussions on you.
    3. The desk sergeant is definitely trying to avoid any situation regarding the muffler, because I've never heard that your vehicle must be complaint with California state laws even though it is registered elsewhere.
    4. It is clearly evident the desk sergeant is attempting to take or place on the officer torres zero accountability in the situation, regardless of the professionalism he showed.

    I wanted to dial 911 to ask for a supervisor on site because clearly this officer does not know how to communicate with human beings. I would not have signed s***n until his supervisor explained the ticket. Your car has not done anything wrong as long as you have a license, your car is legally registered and you have insurance. when he walked up he said something about your loud exhaust he never said anything about speeding and that's what he's trying to cite you for. He is a deceitful person I would take it to court because I guarantee you will get off

      Here’s the problem. The officer was correct, he wasn’t bullying. If you refuse to sign acknowledging that the ticket was received, you are holding up their duties. It wasn’t bullying.
      Police officers are not lawyers or involved with the court systems. They can’t argue the merits or validity of a penal code on the side of the road. That’s what the court system is there for.
      Damon handled it properly in the end, but should have just signed acknowledging the receipt of the ticket from the beginning. Then you fight the validity of it through the court system/file a complaint, which he ultimately ended up doing.

      As there’s two sides to every story before that supervisor’s eyes Damon is just a stranger where Torres is his officer so he won’t jump into conclusion before hearing Torres story and possibly look over the cam footage. He’s being respectful and helping Damon out as much as he can while still protecting his officer as he should. Just like you would wait to talk to your employee and in some level protect him. I don’t think the supervisor was doing anything wrong just watching out for his own. Now, after reviewing the footage I hope he would take some actions again Torres because he was clearly in the wrong and extremely i professional. Police officers are there to serve and protect not be an asshole

    I'm impressed. You're very well spoken. You explained this incident calmly and completely accurate. As a US citizen. I definitely believe he retaliated against you. Sliding that speeding onto the ticket was extremely sneaky and unethical. Especially after he stated. "Loud Exhaust". He did so you would loose in front of a judge. Speeding with a loud exhaust!       I grew up in Costa Mesa and Newport Beach. Cops there are the worst, law means nothing to them, they make it up on the spot. When I was 17 years old I walked out of my house and a cop stopped and accused me of being a run away, I was standing in my front yard. No amount of explaining to him that I lived there was enough for him, he was sure that I was a run away, and actually arrested me and took me to jail. I won't even enter either of the cities any longer. I spend my money elsewhere.

    I could definitely be wrong about this because I'm no police officer, but I'm pretty sure that even if you're visiting from just another state you don't have to abide by the states laws if you aren't a resident. I live in Oregon and I've driven to California many times and even driven across the country and as far as I'm aware you only have to go by the state laws of where the vehicle is registered. Same as Oregon. We use plates front and rear but if your car is registered somewhere that only requires rear plates you're only required to have rear plates. I drove from Oregon to Georgia with zero issues with a car that had no cats and modified exhaust.

      Being the car was imported to and purchased in Canada it doesn't meet US saftey and emissions standards.
      However, US law allow it in the country for temporary tourism.

    He was trying to pass off a speeding ticket after he’d stated he pulled you for exhaust and then realized the Canada/US situation. He even said it very quietly before he walked away and added some verbiage to that ticket. He either went back and added the ‘visual estimation’ part or the exhaust part but he left to add something to it for sure. He was being questioned, asked to explain, and he understood at that point he fucked up… needed to cover his ass.

    The loud exhaust code (27150a) only applies to vehicles subject to registration. Your vehicle is not subject to registration because it is already registered in Canada and is owned/driven by a Canadian citizen visiting California as a tourist. He knows it will not stick in court, which is why he added the speeding citation.

    Wow is all I can say .. First off let me say that I’m a recently retired Deputy Sheriff from a large Northern California county . The way you handled yourself by being calm , respectful and polite during the entire traffic stop was really commendable and I’m glad to see we still have respectful citizens as yourself in this chaotic times that we currently live in. The Officer’s actions to me were definitely retaliatory in nature In my opinion because of the evidence you submitted ( prior video 2019).
    You also verbally articulated the
    entire situation to the on duty
    Sergeant at the police station as well. The actions of this Officer were questionable no doubt but the part that really got me a little upset was when he stated to his partner that you were starting to obstruct or that you were obstructing. Basically what he was about to do was arrest you for PC 148 ( delaying/ obstructing a Peace Officer in the performance of his duties) because you were not signing the citation fast enough for him . Even though he refused to explain it to you.
    Enough of my comment / rant , great video sir 👍🏼

      Police are not owed respect just because they are police. Like everyone, they else have to earn respect by being professional, calm, and respectful. Officer's seem to have the grandiose idea that because they wear a uniform of authority, they can approach citizens as if they are criminals. It is becoming rare that an officer is polite and respectful to their target. What we are seeing on video and from personal experience with a simple traffic violation is the officers are brusk, demanding, suspicious, rude, and disrespectful on their first encounter. Then they fail to identify themselves and refuse to answer questions. They act like HOW DARE you ask me anything. LEOs feel entitled to poor behavior and it shows. Immediate escalation of the most minor events is the next step. LEOs have to learn to be respectful if they want to be treated respectfully. Then comes the COPsplaining. End Qualified Immunity.

    wow.... I never thought this level of emotional repression(reaction in the 2019 video) was possible. He doesn't even cover it up. The officer needs immediate therapeutic rehabilitation and taken off duty. It's wonderful that you are exposing these issues so that this officer has the opportunity to evolve (or not). It's such a shame that members of the public have to be subjected to this level of abuse. As a healer it is clear to me that this officer has a huge self esteem problem and should not be doing the job he is doing. He is like a walking time bomb.

    That supervisor is completely incorrect and probably lied about the judge and that Vegas Car. There isn’t even a process in place to get your vehicle modified at the border that would facilitate such a thing. bottom line is if a vehicle is visiting from another state or country and it is legal where it is registered. It’s legal to drive in California as long as it’s not there over certain amount of time.

      I'm not going to say he shouldn't be able to do the job but this obviously comes down to supervision and training and if the officer can't be trained or can't follow policy or supervision then that would suggest maybe he's not cut out for that department but they did just pass the law this year about having to explain tickets before requiring signature and having to explain the reason for the stop before requesting the driver's license let's see how many cops follow that law

    I doubt California law says "For vehicles registered in California, the following rules apply...blah, blah, blah... Vehicles registered out of state or country have no such restrictions."
    That's like telling a cop "Yes I have a firearm and that is illegal in this state but I'm a tourist and Concealed Carry is legal in my state"
    Canadian police often issue drivers from the US and Canada tickets for driving in the HOV lane with no passengers in the car. US drivers say "I'm being ticketed for driving with no passengers in my car in the What??????" 😀

But if people actually filed complaints every time a cop did something wrong they wouldn't have time to laugh and at some point they'd start to take their work more seriously as they would become tired and bored of all these complaints. And if that doesn't work then there are still people above cops, some governor or whatever, I'm not 100% sure how it is in US since I'm european but my point is that if people won't do anything then nothing is gonna change

      Compared to how most people communicate, this person is explaining the situation pretty well.
      And you are free to disagree, but I don't think the complaint is frivolous. The cop did not communicate very well with the driver. That is definitely unprofessional.
      Then in retaliation for asking reasonable questions the cop wrote an additional citation. If you don't think that's unprofessional, I would have to recommend that you not think.

    Ie: in your scenario your Lamborghini would be exempt from California laws because you are Canadian. Just as long as the vehicle in question meets the laws within the laws of your Provence.       Unfortunately, fleecing the public is not a crime. Since the judge is complicit, and gets paid from the same entity, it's never going to come to light without an expensive investigation. A lawyer would have to work the case pro bono.
