    It's a shame so many women abuse these shields just to alienate father's, they're essential to women going through genuine threats of domestic abuse and being stolen by scorned mother's.

      non molestation orders dont impact child proceedings as a 3rd party can do handovers on the mothers behalf or go via the school to drop off and pick ups as long ad the father has not been abusive to the children and had proven to meet the child welfare, safeguards and is not neglectful

      It’s a shame so many woman are abused and require such laws to protect them.
      This order is not handed out freely and without any evidence that it is needed.

      @@lubabmohammad9164They can be absolutely handed out without evidence. A non-molestation order can be granted purely based upon allegations of abusive conduct. Just so you’re aware.

    There is no greater molestation than obtaining a non-molestation order on false pretenses, except of course for the molestation that occurs when emotional developmental stages of a child are vampirized by an over-needy parent, empowered to monopolize the dependency of that child ( now entirely obstructed from communication with its other parent by an NMO). Such isolation and dependency gives the child no defense against undue influence leveraging a loyalty bind out of the child. This is easily achieved by manipulating alarming disinformation about the forced-to-be absent parent. Such 'disclosures' are intentionally not age appropriate and lead to a cross-generational coalition or allegiance against the absent parent. This risks stalling the child's emotional development, steering it into a simplistic dichotomy of 'all good' and 'all bad'. What appears an especially close bond, perhaps made so by shared experience of appalling domestic abuse, is just as likely to be a parent who denies their child any right to boundaries. Both possibilities must always be considered.

    Hello. I asked non-molestation order for my ex-partner, which was my future husband. I was in relationships with him 10 years in real life. My ex-partner wrote a lot of lies don't have non-molestation order. He wrote like I steal his money, used him for money and I had like other victims. My ex-partner family started abuse me and asked me to go to sleep outside or go to other country, while I'm from Ukraine and my city is bombing everyday. My ex-partner cyber stalking me, his daughter hates a lot of years for no reason, I saw his family how they stalking me in real life, make a fake gossips about me. My ex is boss and owner of businesses. He blackmail me a lot, try to control my life. I asked order. Why people act like this?

    Just received one of these supporting my partner in her ignition abuse I raised with the child services. Can't believe these orders are used like this and clearly abused. Sombody should stop them being abused as they are.

      I think the correct response is to provide legal aid to both parents should one party have aid and specifically to respond do these orders.

    I’ve applied for mine today. What on Earth happens if he is issued an Ex party one? He is a mastermind of playing the victim so he will play it to the book. It’s so worrying. He’s a covert narcissist.

    Please explain why The Family Law Act has been updated to include FGM but not social media. Stopping my ex following me on social media platforms such as TikTok. Why also is there no facility to question an applicant who contacts the Respondent and even asks them to “call me back.”

    I really need advice, my partner has a non mol out on me but she keeps contacting me and I think she's trying to trap me and get me arrested, how do I provide evidence and what happens at the first hearing? Do I give evidence?

      I’m a victim of abuse. My wife hurt me and my child and didn’t let me call the police.
      Then after I decided to be sober. She called the police and said I drink

    We should also understand that the first minute of this video announced each case is different and Unique.
    It’s not against fathers, circumstances may be seen by the court as quite the opposite. #Unique

    Thank you somuch for your help, if local court not co operating or not transfer my case to high court. what can i do? can i straitaway apply to high court & explain the situation in submission statement? or position statement? My ex breached injunction & undertakings before. court not take any action. Is that power of arrest need to be attached as a warning notice underneath the final order? Please let me know? I have been to magistrate court before not family court.

    Recent incident/ harrasment .. how recent should it be?
    My husband gave me persistent death threats honour based from abroad he had ILR could return anytime
    I was so confused by lawyers that since he is not in country u cannot get a non mol also it has to be as recent as within 3 -10 days .
    Even his behaviour was very aggressive I was stuck on two points
    Recent threat
    Abroad issue
    Plz specify this
    The lawyers fleeced me but confused me to a degree where there abuse bc worse than my husbands I felt like jumping in the river

    I dissagree with this video specially when she describes sending a birthday card, for that to take place it would of had to be proven that the father has been harmful to the child in a significant way, ie cause emotional and or physical harm supported by cafcass/social services and/or medical professionals in which after a fact finding hearing there would be a non molestation order against father that covers both the mother and child, if its a matter of the mother complaining about concerns by the father a court would not stop a fatger raising concerns anymore than stopping a mother raising concerns if the child resided with the father as the childs safeguards are paramount.
    To create that kind of obstriction could lead to situations like that of the birmingham child murdered by her mother (whilst the father wasnt raising concerns as he was absent, had he of been and a non mol prevented him raising concerns it would obstruct the child getting intervention)
    Its also important to know that civil non molestations orders do not impact criminal records unless you breach the order as its intended to be preventative meassures vs criminal court non molestation orders carry criminal charges and are punitive and thus a criminal record
    My advise is agree to the woman her non mol as it shows maturity, shows your not like minded to behave the way she seeks protecting from, stick to the order and no not breach it.
    In short
    A bullet proof vest is only useful if someone is trying to shoot you, otherwise it becomes pointless
    Yes it may offer peace of mind, but thats then edging on the person applying for the order having mental health issues (where the respondent has not behaved as alledged, if they have then there is reasonable grounds for a non mol to be applied)
    Note that civil non mols are granted much more frequently than criminal non molestation orders because civil courts have a much lower burden of truth vs the criminal court

      I totally agree with you. My ex who was the abuser was supported and advised by local council after believing her lies to get a non mol order against me whilst we were still living in the same marital home. I know very well I was not the abuser and not and abusive person but a father who cares and loved his children. My ex in order to get me arrested called the police that I was harassing her when she saw me taking up my phone to call my mum. The police came in , My self and then 10 years old son were shocked. The police did not ask any questions but falsely arrested me and took me to their station. My phone was searched and NO evidence was found of me videoing my ex as she allegedly said. I was released with charged. She applied to court for domestic abuse, prohibited steps order. I had to leave my children and home to clear my name and to avoid further allegations that would have given me a criminal record as the police were not helpful to me. I had a very good barrister and a wonderful Judge who consolidated the non mol. Order in a fact finding hearing where my ex was exposed in the presence of the local council as both the children service and my ex had no evidence against me of any abuse of my ex and children. I have joint custody of my children thanks to a wise Judge and my barrister. The legal cost of over £10,000 at the end was nothing compared to victory over the children services, my ex and the police and having my children.

    My childs dad sent her a birthday card with his last name on instead of hers. He responded to the query about this abusively. Then took over 1 year and three separate court hearings regarding the cao to spontaneously say that "he didnt know that he had done that, it was auto fill" 😅😂 - we hadnt even included it in the scotts schedule, so it was clearly playing on his mind as a loose end.
