    This guy is hilarious! He gives his name without being asked and then says: "you have my name so now you're in breach of GDPR". He is the equivalent of a shop owner putting an item in the pocket of a customer and then saying: "you are shoplifting".

    He didn’t quite know how to get out of the situation he wished he had never got himself into.If only he had taken a deep breath and listened to your explanation first.He had made his mind up before he confronted you that he was going to impose his perceived authority to stop you filming.Always best to listen first and not make assumptions. 👍

      "Common courtesy" is the same as "Common sense". There is no such thing. The clever-arse mouthpiece who put so much store in safety training would know that Trainers do their best to train the perception of "common sense" out of the equation. It is a notion that ,say, your Granny tells you -"use your common sense" - to attempt to coerce you into her way of thinking because she doesn't have the intellectual wherewithal to give you proper guidance.

    Surely if you own a company you should know what data protection laws are for and when they apply and actually know they don't apply to members of the public who choose to film from public land. Great work PJ

    As a health and safety professional myself, that was so embarrassing to watch. No concept or understanding of GDPR regulations and mentions pedestrian/mobile plant segregation and safety while walking around a busy yard with no hi vis on! Prat

    I wish people would research GDPR (both the UK and EU versions of it) - they'd soon realise it doesn't stand up to individuals/public. Only corporations have a duty to follow it. The amount of people that make themselves look so stupid is growing.

Surely a slippage could so easily occur but then I suppose their thinking is that a hard hat would be useless in such circumstance. Would love to see an official H&S audit taken place there, maybe that's why they are acting a bit, shall we say, sketchy. 🤣

    The lorry with the German number plates "EL-SB856" is from district of Emsland, which is the state of Lower Saxony and borders The Netherlands immediately to the west of it. But this may not be the case now since one can renew their plates in any other district or "laender" anywhere in Germany.
    Fun fact: I am a US Citizen living in Landkreis (District of) Esslingen, but I carry "S-" plates since I like to show off my old VW with Stuttgart plates. :-)

    They always say "Oh, the guys aren't comfortable with you filming them". The truth is that is perfectly reasonable BUT it is the fucking employers responsibilty to ensure that their employees can work comfortably - not yours. Off the top of my head, there's trees, curtains, big fucking hedges and solid opaque doors/fences that would solve their problem but they've not put these features in place to prevent their photons escaping and blame you for that.

    I watch these for the psychology , this is a great example too, someone in full control of everyone inside a premises, completely falls apart with the realisation that they have no power as soon as they step outside of it.
    The sensible thing to do is accept it and go back inside but their ego often stops them, they then proceed to go through a range of different angles in order to get control but fail each time and each attempt makes them look more and more like a crying baby...... He's in the street telling a random stranger to get on the pavement 😅

    Bad attitude = bad publicity. The companies that have interacted well with you generally get lots of positive comments, the word spreads amongst others and then subsequently business gets better. This is exactly the opposite of what happened here.

    PJ, just for your info, journalism isn't limited by GDPR regulations where publishing legitimately contributes to wider public debate. Auditing would be classified as meaningful debate of our personal freedoms. You are free to film and publish from a public location as you are a private citizen journalist and you are not directly monetising any personal data generated. Faces are classified under GDPR but not in journalistic contexts. Vehicle registrations are not covered by GDPR as there is no identifiable personal info involved.

      media platforms wouldn't recognise auditing as journalism so blanking names is good practice but then again Mr. H&S would have to provide evidence to any platform that they are said person and proof their name is as published (anyone could throw out any name). Parts of GDPR apply to individuals who release more than one identifier of a person so blanking the reg. would be advisable but then again any claimant claiming this or that would have to provide proof that their actual name is attached to a particular reg. Lastly number plates are public info but any other identifier attached to an individual calls up GDPR = blank a reg if you catch someone's likeness, or blank a face if you want to capture the reg and capture the driver (but then again they may not be the owner) if you publish the image

      If a person willingly gives there personal information to a complete stranger when not asked for, legally they have given that freely.
      In a court a judge would ask, if you did not want personal information released, then why did you give it to a complete stranger sir ???

    I'd say call the police or Trading Standards for that overloaded VW flatbed that rolled in at the start of the video. It looked like a rear axle overload at least. Is there a repeater display for that weighbridge. It would be interesting to know what it weighed. The guy you spoke to first, seemed like a gent, that knob that came out with all the GDPR bollox, what a complete and utter, monumental bell end.

    The last time I worked in the UK the construction site had to have turnstile entry for pedestrians, dedicated walkways, no use of hand phones off a dedicated walkway. Yet my job was to inspect piling part of which was to photograph progress, during the companies induction course I was issued with a company I Phone, I did ask for an ordinary digital camera but was told the I Phone was the modern way forward. Well on site security told me to stop using a phone in the work area, I did tell them it was being used as a camera and continued using it as such. By the end of the week I had a fist full of "Parking Tickets" and was asked to attend the project office. I explained all that happened and new signage went up allowing I Phone use as a camera, which was a shame because 30 mins after leaving the office with a fully charged battery it would be flat after receiving 500 or so emails that had nothing to do with me. I stuck it for three month's and then went back to Asia where it's a lot more sawitnessed
    Now in your video I didn't see any dedicated walkways, the safety guy wasn't wearing a Hi Vi yet walked through the same gateway as trucks and other vehicles use, the skip truck reversed with a banksman. The German pick up crew were wandering around near the excavator, the work area was not fenced off. There seams to be no coordination on which types off work site have to comply with what rules.     What an absolute clown that tool is! LaS need to restrain him to the back office as he's an embarrassment to the company.
    Doesn't want his details known but proceeds to shout them at the camera. Thinks he's the safety police in a public space and can boss members of the public about, even appears to be trying to gets 'hands on' to force movement at one point. Don't tell him Google has uploaded multiple images of the business online, he might cry!
    The first bloke needs a pay rise for being cool about it and approaching members of the public in a professional manner.

    Now he has made these claims he is liable for section 2 of the Fraud Act 2006, Fraud by false representation, first with GDPR, then with H&S and finally with vicarious liability which means now you can bring a civil claim against him personally, then use vicarious liability and bring a second claim against the company under "Vicarious Liability", yes it works both ways.

      "pedestrians have right of way" is not true, everyone has the right of way on public paths and roads, what you are confusing is the priority here. PJ is dead right about health and safety, so apply that to the road and, we all have a responsibility to be safe for ourselves and others, to prevent crashes and injury, even if we have the 'priority'! Remember the “must/must not.” “should/should not” or “do/do not” as well. What is new last month is:
      The hierarchy of road users
      Pedestrians.
      Cyclists.
      Horse Riders.
      Motorcyclists.
      Cars/taxis.
      Vans/minibusses.
      Large passenger vehicles or courier vehicles like buses and HGVs.

Scrap yards are not very well known for following the rules.. when you can compare it to a construction site ie: gloves /glasses /boots /clean hi vis/hearing protection...

    With regards to Health & Safety he should only be worried if you went onto private property. I cannot understand why he was so worried as where you were standing if you slipped or tripped on the pavement you will have a possible claim against the council or who ever is suppose to maintain it.

    When I learned to drive a forklift, I was taught to tilt the tines back, it makes the load more stable and stops them from digging in on inclines, no one seems to do this in pj's vids.

      No crime in capturing the data regardless if its given willingly or not . you can not trespass the eyes nor the ears . unless the data is used for nefarious purposes to commit a crime . so recording alone is not reasonable grounds to accuse somebody of a criminal act .
