Hi, you need the employers to sponsor you for that visa. If you prefer to apply for PR after a sponsor visa you have to go through the 494 pathway which is longer but gives you access to visa 191 which is independent.

With your explanation i realise that when my 2 years is completed and i am able to initiate a 186 application, my 482 visa will have been expired and the processing time for 186 will take time as well. Inorder to remain in the country and continue working for my current employer while i wait on my 186 visa application, do i need to get the company to reapply for a 482 visa again so i am continuously working in australia and not return back to my country?? It is really important to discuss 186TRT sponsoring with your employer at the beginning g your 482 journey. Migration Agents can talk to employers and explain in details how the following step works. It is important to do it first because if you see any potential obstacle you could apply for a 494 (if requirements are met) which lead to a 191 and doesn't require any business involvement. I would recommend to involve a RMA to explain all details to the employer to avoid confusion which could lead to negative outcomes.
The issue with the current 482 visa under the Temporary Residence Transition (TRT) stream for short-term occupations is that employers keep extending employees' 482 visas rather than granting them TRT approval. Employers avoid approving TRT because, once approved, the employee gains the flexibility to leave. This is a significant issue. Do you think the new SID will prevent this kind of exploitation?
This is a very interesting point that certainly deserves a great discussion. However, we must not forget that employers are in no way obliged nor compelled to support PR for their 482 nominees. Certainly it is the sensible thing to do and - on a human level - the right thing to do in my opinion. Afterall, the 482 visa holder would have dedicated at least 2 years of their working life to the business. Yet, support for PR is not an obligation and employers can choose not to proceed. The 494SESR visa already “frees” employers from the obligation and allows employees to independently proceed to PR through visa 191. We don’t know yet what the pathway after SID will be. Hopefully, DHA will have the interests of all parties in mind when ruling.

@@GreenWingsMigration No, it was not “unpaid leave” I had 20 days of annual leave that I had acquired on a previous year working for the company but under the postgraduate visa 485. Then my sponsonsorship got approved and in all duration of the sponsor I will have spent more than 8 weeks in holidays or “paid leave”. Can I still apply without issues to the 186 TS?
@@vifi2280 As long as you have payslips to prove that you have always been paid during the 24month period, no issue. The problem comes when you go on unpaid leaves and therefore you will miss some payslips. Enjoy your holidays!
Hi Eleonora, I plan to apply for a 186 direct entry visa from a 482 instead of the transition one because I will have worked full-time with my employer for three years. Are the requirements the same, plus the need for a skills assessment? I also took some unpaid leave during this period. Thank you!
Many people choose to apply 186DE over 186TRT, however it is important to meet all criteria, which include: - being qualified in your occupation have at least 36 months of skilled experience on full time basis (or pro rata part time) have obtained a positive skills assessment by the relevant authority English, Health and Character criteria stay the same. Hi! Change of position within the same company requires a new nomination to be lodged and a new visa to be requested. It will effectively require 24 additional months to be worked, as if a new visa with a new business was acquired

Thank you! No you can’t. the only experience that you can count towards the 186trt transition is paid work experience accrued while working with an active 482tss visa. need to renew the 482 requires more time to achieve the 24 months

your processing time seems slightly out of expected timeframe. However, if the nomination has been approved, make sure that the visa is also decision ready. You want to try avoiding an RFI so the process does not delay further.

Hello Eleonora, Just a quick one: I finally got a full-time job offer for a Residential Support Officer, after a long search. The organisation has 482 sponsorship available, but they said I have to work with them for at least 12 months before they can sponsor me. My current visa duration is no longer up to 12 months, so they said they could still sponsor me for the 482 visa, before the end date of my current visa. Now the question is: Would I be eligible for the 482 sponsorship visa with them since obviously my work experience with them wouldn't be up to 12 months? I learned that prior work experience for the 482 sponsorship is 12 months, effective November 2024. However, I've been working as a Disability Support Worker in Australia for over 5 years in total (Permanent part-time staff for over 2 years with two organisations). @@raphaelumite3134 hi your work experience doesn’t have to be with the employer who sponsors you but has to be in the filed/occupation you’re seeking sponsorship. This will be determined by a skill assessment. I suggest you get in touch with your migration agent to make sure you’re within the timeframe of your current visa and don’t risk to find yourself in a situation where the visa is expiring and you haven’t started the process for sponsorship 482
@@GreenWingsMigration I just checked ACWA for the skill assessment. It turns out I may not require skill assessment since my Certificate IV in Disability was obtained here in Australia. I am also in the process of completing a Diploma of Community Services (Case Management).
Do you mean every income statement related to us completing a full financial year of work, or do you mean sponsorship year? Because if we start working on the 482 at some point during the financial year, the full salary won't show at the end of the financial year income statement no? Is it better to provide an income statement for the first and second sponsorship years so we can show the full salary was paid each time? Or is that not possible?
The income statements are in the ATO profile, and there is one for each employer. If the sponsored work is partial during a financial year, then ideally there will be a partial income statement + a complete income statement + another partial income statement. These, along with the payslips, allow us to calculate whether the person was paid correctly and if they worked the appropriate number of weeks.Hope this answer your questions :)

If the claimed experience of 7 years is as a Civil Eng drafter, then the chances of obtaining either a 482 or 186 are very high, provided you have an employer willing to sponsor you. On the contrary, if you have been working 7 years in construction, but only recently completed the Advanced Diploma for Civil Eng Drafting, then neither option will be feasible. 482tss currently requires 24 months of experience and 186DE requires 36 months. if you will eventually get sponsored but later the employer will let you go, then you will need to find a new sponsor that will take your 482TSS Visa under their responsibility.

Only if extremely incidental and supported by genuine evidence that the overseas trip was work related. Remote work as digital nomads does not count for example.
@@GreenWingsMigration thanks a lot for your response. Actually in my contract norma Place of work is mentioned Adelaide but also mentioned that company can send me to other locations as well. And in my 482 visa conditions it is mentioned that I have to do Approved work only. Now my company operates in multiple countries and for supporting other locations, I would be required to do that. Should I get anything more added in my contract (as its still in finalization stage - although my visa 482 is just approved) for future precaution? To transition to PR through a TRT application, you need to have been employed for two years in the same position. Under policy, the DHA considers the “same position” only work that has been done for the same business in the same location. Only three exceptions are currently considered: the two companies you have worked for are associated entities the business changes because of an internal restructuring you were initially sponsored by an overseas business sponsor and later by the Australian business sponsor connected to the original sponsor Outside of this current framework, nothing is certain.
Oh btw the process doesnt end after you apply 186trt It takes 14 MONTHS to get approval after you applied if your employer NOT in regional and have specific occupations in health or education sector😅😅 check global processing times before you decide

you need to spend 24 months with the same business sponsor in order to access 186trt benefits. if you don’t have enough time remaining on your visa, you are likely to have to renew your current 482 and achieve the 24 months requirement

It depends which visa you want to apply for and what occupations you're looking for. There are some skilled level 4-5 occupations that requie at least one year of relevant experience which may substitute the formal qualifications being AQF Certificate II or III. In some instances relevant experience and/or on-the-job training may be required in addition to the formal qualification.

You should discuss this with your employer as some companies let you use the holidays of the following year in the previous one, but it's important you keep getting paid.

You need 24 months of work for the same company. if you transferred your original nomination and later on applied for a new visa, the first transition date counts.

Upon reaching the 2 years with them, you might lodge a TRT application if the employer supports it. It is in their right to not lodge until more time has passed. When they nominated you, they paid for 3 years of SAF Levy. They could rightfully want to take full advantage of the whole investment.

You should check which DAMA agreement your employer has sponsored you under. All DAMAs have different requirement but generally is 3 years. we did a full video about DAMA, check our channel :)

It is really important to discuss 186TRT sponsoring with your employer at the beginning g your 482 journey. Migration Agents can talk to employers and explain in details how the following step works. It is important to do it first because if you see any potential obstacle you could apply for a 494 (if requirements are met) which lead to a 191 and doesn't require any business involvement. I would recommend to involve a RMA to explain all details to the employer to avoid confusion which could lead to negative outcomes.
The issue with the current 482 visa under the Temporary Residence Transition (TRT) stream for short-term occupations is that employers keep extending employees' 482 visas rather than granting them TRT approval. Employers avoid approving TRT because, once approved, the employee gains the flexibility to leave.
This is a significant issue. Do you think the new SID will prevent this kind of exploitation?
This is a very interesting point that certainly deserves a great discussion. However, we must not forget that employers are in no way obliged nor compelled to support PR for their 482 nominees. Certainly it is the sensible thing to do and - on a human level - the right thing to do in my opinion. Afterall, the 482 visa holder would have dedicated at least 2 years of their working life to the business. Yet, support for PR is not an obligation and employers can choose not to proceed. The 494SESR visa already “frees” employers from the obligation and allows employees to independently proceed to PR through visa 191. We don’t know yet what the pathway after SID will be. Hopefully, DHA will have the interests of all parties in mind when ruling.

No, it was not “unpaid leave”
I had 20 days of annual leave that I had acquired on a previous year working for the company but under the postgraduate visa 485. Then my sponsonsorship got approved and in all duration of the sponsor I will have spent more than 8 weeks in holidays or “paid leave”.

Many people choose to apply 186DE over 186TRT, however it is important to meet all criteria, which include:
- being qualified in your occupation
have at least 36 months of skilled experience on full time basis (or pro rata part time)
have obtained a positive skills assessment by the relevant authority

Hi! Change of position within the same company requires a new nomination to be lodged and a new visa to be requested. It will effectively require 24 additional months to be worked, as if a new visa with a new business was acquired

No you can’t. the only experience that you can count towards the 186trt transition is paid work experience accrued while working with an active 482tss visa. need to renew the 482 requires more time to achieve the 24 months

Hello Eleonora, Just a quick one: I finally got a full-time job offer for a Residential Support Officer, after a long search. The organisation has 482 sponsorship available, but they said I have to work with them for at least 12 months before they can sponsor me. My current visa duration is no longer up to 12 months, so they said they could still sponsor me for the 482 visa, before the end date of my current visa.
Now the question is: Would I be eligible for the 482 sponsorship visa with them since obviously my work experience with them wouldn't be up to 12 months? I learned that prior work experience for the 482 sponsorship is 12 months, effective November 2024. However, I've been working as a Disability Support Worker in Australia for over 5 years in total (Permanent part-time staff for over 2 years with two organisations).

This will be determined by a skill assessment. I suggest you get in touch with your migration agent to make sure you’re within the timeframe of your current visa and don’t risk to find yourself in a situation where the visa is expiring and you haven’t started the process for sponsorship 482

Do you mean every income statement related to us completing a full financial year of work, or do you mean sponsorship year?
Because if we start working on the 482 at some point during the financial year, the full salary won't show at the end of the financial year income statement no?
Is it better to provide an income statement for the first and second sponsorship years so we can show the full salary was paid each time? Or is that not possible?
The income statements are in the ATO profile, and there is one for each employer. If the sponsored work is partial during a financial year, then ideally there will be a partial income statement + a complete income statement + another partial income statement. These, along with the payslips, allow us to calculate whether the person was paid correctly and if they worked the appropriate number of weeks.Hope this answer your questions :)

If the claimed experience of 7 years is as a Civil Eng drafter, then the chances of obtaining either a 482 or 186 are very high, provided you have an employer willing to sponsor you. On the contrary, if you have been working 7 years in construction, but only recently completed the Advanced Diploma for Civil Eng Drafting, then neither option will be feasible. 482tss currently requires 24 months of experience and 186DE requires 36 months.
if you will eventually get sponsored but later the employer will let you go, then you will need to find a new sponsor that will take your 482TSS Visa under their responsibility.

Only if extremely incidental and supported by genuine evidence that the overseas trip was work related. Remote work as digital nomads does not count for example.

And in my 482 visa conditions it is mentioned that I have to do Approved work only. Now my company operates in multiple countries and for supporting other locations, I would be required to do that. Should I get anything more added in my contract (as its still in finalization stage - although my visa 482 is just approved) for future precaution? Can you also specify what kind of evidence could work in this case.

It is never compulsory for the employer to nominate people for their PR. It is a very important and sensitive topic that must be discussed with the employer before starting

To transition to PR through a TRT application, you need to have been employed for two years in the same position. Under policy, the DHA considers the “same position” only work that has been done for the same business in the same location. Only three exceptions are currently considered:
the two companies you have worked for are associated entities
the business changes because of an internal restructuring
you were initially sponsored by an overseas business sponsor and later by the Australian business sponsor connected to the original sponsor
Outside of this current framework, nothing is certain.

It depends which visa you want to apply for and what occupations you're looking for. There are some skilled level 4-5 occupations that requie at least one year of relevant experience which may substitute the formal qualifications being AQF Certificate II or III. You should discuss this with your employer as some companies let you use the holidays of the following year in the previous one, but it's important you keep getting paid.

Upon reaching the 2 years with them, you might lodge a TRT application if the employer supports it. It is in their right to not lodge until more time has passed. When they nominated you, they paid for 3 years of SAF Levy. They could rightfully want to take full advantage of the whole investment.
