  • I thought all four phone drivers had good evidence of interactive communication. I thought the first two drivers who were just warned, showed the best evidence of interactive communication, yet the other two got prosecuted. The taxi driver's details are here because I think he tried to warn the first driver, but perhaps he was only beeping to get the queue moving? If you do that to a police officer, I suspect it's considered to be an offence, although it clearly isn't when it's just me, a nobody. If it was just to get the queue moving, then I'd suggest not bothering because it won't speed up your journey at all, it's just impatience. I reckon Mikey Locks Ltd driver was also on the phone, given his WhatsApp gap, but I can only catch one driver at a time.

    The way you use the Muslim greeting is pretty presumptive, I guess feeling like an outsider in the UK probably makes you want to amplify the feeling of belonging to others.     That was nice of that taxi driver to try to warn the driver in front, IF that is what he was doing. However, I suspect he was beeping because the van in front of her was still stationary long after the queue had begun moving again. I suspect that guy was on his phone too.

    It would appear that there is clear inconsistency with the interpretation of mobile phone usage whilst in charge of a vehicle, Mikey. Not sure why but the judicial system is difficult to comprehend sometimes!!! Keep up the fight!!! 👍👍👍

    The Met went through a busy phase last year and were understaffed. So a lot of what got submitted just wasn’t handled properly.
    This year already there’s been a lot of action, and I’ve several court hearings to go to where motorists have denied offences, although the evidence clearly shows otherwise.
    Whilst they’re entitled to a court hearing, it’s a huge waste of time for everyone involved.
    A system whereby the police could just share the evidence beforehand, or the key money shots, would be much better. You can’t deny being on the phone when you’ve a photo of you being on the phone alongside the NIP you’ve just earned.
    Then once in court, 3 magistrates, a legal advisor, a recorder, a prosecutor - that’s 6 people minimum to even cement a prosecution.
    The whole lot needs reform and overhaul.

    Hang on a Cotton Picking Minute. Not enough evidence. You have a video of the action / screen. The driver agrees she does it when in traffic stationary. She clearly knew she shouldn’t really be doing it. If you haven’t, Which I’m sure you have already, Id challenge the decision. In the scheme of things Mikey. I hope she will have as a mature driver learns that valuable lesson.

      This was back under the old mobile phone laws where interactive communication had to be proved. It would be way to late now, you only have 14 days from the offence to serve the NIP.

    I wonder how much of the decision to prosecute was based on the day of week and/or time of day that a given complaint was dealt with. Also, how much comes down to which officer was dealing with it... More than anybody should find acceptable would be my guess.

      Yes they are given fines but often when stopped for other reasons, get caught a few times and DVLA revoke the plate for good.

    Hi Mikey, I'm simply astonished the police did not apply fixed penalty notice although the driver admitted her guilt. I would be inclined to appeal the case by sending the MET a successful video fine from your many archives with the one you sent and let them argue why a warning message was issued.

    May I suggest you place a POL (polarizer) filter on your camera. It should cut down that mirror effect you get on glass.....

    I reviewed some footage taken off my dashcam from two days ago. Whilst driving at the time, it was clear the driver of a van heading towards me was reading his phone and not watching the road ahead. But unfortunately, I could only see his phone when his side window was level with mine.
    Reviewing the footage yesterday, I could see the driver looking down but his phone was never visible to my dashcam. Really annoying.
    I don't think the Lancashire Police would entertain a prosecution, so I'll save the footage for TH-cam when I get around to it.

    Best to report clips same day as you got it. Takes about a week now to get an email from the met that they are taking action on the people I report and there's a 14 day period between where the incident occurs and when the letter has to get to the persons house

    One way to fix the problem of cellphones being used while driving would be to have to have the phone in your cars glovebox. If then pulled over would get heavy fine if not in glovebox!

    I was crossing a road junction the other day and there was a van driver sat there with his phone right in front of his face, not even paying any attention to what was going on. There was a car in front that was waiting to pull out. Someone could have crossed assuming it was safe and then the van driver could have pulled forward without even looking
    I wished I'd filmed him now because I doubt it was the first time he's done it, and I doubt it will be the last. I'm sure his employers wouldn't have taken it lightly

    I have spoken a police officer and told me at lest the particular officer they prefer to send out warning letters because it save public money.
    But I my self feel that the response depends on the officer dealing with the case we all see things different to every body else.

    one day i was cycling with my son on my bike and i noticed a car infron not driving straight, kept swerving near the curb in front, when i cought up with her she was on her phone, i told her to stop using her phone and what she did was spit at me, fortunately her spit was off target and spat in her own car....lol

    I think the car behind beeped because the van was sat not moving, world ain't revolving around you and your "fame" (although the beep before was questionable, but could have been unrelated)
    I do think you'd have been better having a check what the van driver was up, not getting the plates of the cab behind who was probably not beeping to warn her.

      That wasn't necessarily illegal *at that time.* But the law has been amended since then, and the current legislation can deem as little as activating the screen to read the time (for example) as "using" the phone - unless it is in a holder.

    Two Motor cyclists gone past on the other side of the road into ongoing traffic at the beginning of your video and yet again not noted or pursued... then more and more...and nothing done about them...hmmm - you are right to catch the drivers but please be fair and catch the reg nos. of the bikes

    It's ironic, they invent the mobile phone then invent a law that stops the use of it whilst you're stationary in your car. Seems ok if you're cycling though, breaking every law in the highway code. Perhaps you'd serve your fellow man better by walking along these traffic jams with advice instead of collecting car numbers to clog up the courts.

      The idea that anyone anywhere could video you any time takes all the fun out of anti-social driving. The sense of paranoia really eats away at you.
      3rd party video reporting has exploded across the UK. In London in 2022 almost 15,000 such prosecutions were started. There are LOTS of people videoing and reporting bad driving.

    the mobile phone law needs to be relaxed when held uup by traffic and not moving.. engine running is a bs reason to not use phone.. not all laws make sense

      Stationary phone drivers are still dangerous for many reasons:
      1) Should a child or shorter person cross in front of them they wouldn't even see them, and would likely then move off, running them over. Notice how WFN364 (google for videos) drives forwards whilst looking at his phone? This is common behaviour from phone drivers. Here's an example someone else caught where the driver almost takes out a pedestrian at a crossing:

      2) They are entirely unaware of filtering cyclists and motorcyclists. These drivers are often slow to react when the queue starts moving, and then when someone behind them beeps they drop the phone and hastily move off without even looking.
      3) If you imagine these people only use their phones when queuing at the traffic lights, that's terribly naïve. The gardener in LM63BTZ was on the phone whilst driving along, and quite likely had been doing it for some considerable part of his journey. These phone users are constantly using their phones, but it's just much easier to catch them when they're in the queue.
      4) Phone distraction lasts for a good time after you put the phone away. Even if you're only using the phone in each traffic queue at each junction (which is highly unlikely), then you're constantly topping up your mental distraction and are basically as disabled as a drunk driver.
      5) Phone driving is worse than drink driving for distraction rates, and that's why it's part of the #Fatal4 behaviours that police target heavily.
      6) Here's a police officer telling you that he has been on the scene for 3 fatal RTCs involving drivers who were stationary whilst using their phones, and then moved off and caused a collision: twitter.com/markandcharlie/status/1604073330751197184?s=20&t=uj8sgu7spu4cTyDqqqds2g
      7) People who knowingly break minor driving law will likely also break more serious laws. Strong policing of minor traffic offences has a strong effect on reducing collisions resulting in killed and seriously injured people. It's good to police these phone drivers.
      I'm really not interested in this nonsense of "it's not dangerous when stationary, because it clearly is and it's clearly still very appropriate to catch these drivers.

      No, these prosecutions cost more than the fines and costs they bring in. Prosecuting bad drivers is a cost to society. And yes, longer answers are copy/pasterino because ain't nobody got time to type the same facts out to ignorant people each time.

      No, it isn't. Cyclists may ride on the road even if there is a cycle lane, and you still have to share nicely with them.
