The defendants would have won the case, had he not signed an agreement to refund the plaintiff. It is a simple case. Unless the defendant did withheld information from the plaintiff then plaintiff would have had a case. Defendant sent someone to verify the land, took video and agreed to purchase the land.

I think this is a case of Mai Angwa (Original owners of the land) customary law which was bycotted when payments of N2m was made. The seller was at fault here for not settling percentage to the Mai Angwa who were aware of change of ownership. As for the buyer he still has the right of ownership for the land as soon as he pays the balance. Unfortunately, he's not interested as bodies were buried. I don't blame him. No one wants to buy a land where bodies will be exhumed.

In as much as I like this Magistrate but sometimes she tends to overlook the legal issues involved but rely only on reasonings and logic
She has already been blaming the plaintiff to pay the balance of the purchase price so that the defendant can settle the chief in the community to exhume the corpse they intentionally and maliciously buried on another persons land,, what kind of stupid culture is that,,
Your honour,,,my opinion,,,it's not a culture,,,it's just a deliberate attempt from the chief in the community to extort and get his own share of the purchase money,,, am a little bit disappointed that your honour could embrace and encourage such barbaric and repugnant culture that is repugnant to natural Justice,equity and good conscience,,,, I realised that your honour is trying to mediate and settle d dispute as fast as possible but u also need to be very very careful your honour,,not untill the plaintiff said they both signed contract of sale and there was a clause in there that says that,,in case of encumbrance on the land, the seller shall return the deposit back to the buyer,,,,this should be the ratio in deciding the matter except the parties now decides further in the court to vary this contract of sale,,
Again the court ruled that the original document be released to d seller so as to enable him to sell the land to third party to be able to refund the deposit of 2m ,,,,, who did u your honour think will buy a land with corpses on??? Another scenario,,if the original document is released to the buyer,,,,, what about he sells the land and run away with the money he collected from the new buyer without paying the deposit of 2m to d plaintiff?? What will plaintiff hold on to??? People can not be trusted no matter how influential and wealthy they presented themselves to court,,
This is a very technical issues of law that only reasoning or logic can not solve but law,,,, if there is a contract of sale between them and the contract was frustrated at the expense of the defendant,,,then the plaintiff is entitled to refund ,,,, that is the law,,,,it is d defendant duty to have done the needful with their local chief so as to avoid any encumbrance on the land,,,,, another scenario,,,,,,,what of,,if the plaintiff immediately he paid the first instalment quickly fenced the land round and put a gigantic gate there,, will the chief destroy the gate and force his way on the land to bury corpse there ?????? ,
