This video shows exactly why that implementing that would be a bit tricky. Where's the second screen going to be put? Are we forced to play with them split screen on the TV or Switch screen? Would there be no bottom screen? How would they make it work without it? Or would we be forced to use a third party switch accessory to make it play vertical? Which the switch isn't designed to do. I mean the worst that can really happen is getting your specific switch hardware banned. Nintendo doesn't ban accounts but if you had a switch with pirated games, they'd probably ban your specific switch. If you're just using homebrew apps and emulators you should be fine. If you have a gen 1 switch, there's almost no reason not to mod it. It's easy and takes advantage of a hardware exploit that Nintendo can never patch. If you want to use an oled switch like in this video, you need to hardware mod it which is safe if you pay someone to do it. I'm an electrical engineer and I still donked up the first oled switch I tried it on. Would recommend just paying someone to do it. I don't see much advantage to waiting until the end of the consoles lifespan though. With the potential of switch 2 being backwards compatible as well, I don't see the switch being taken offline any time soon.
I've been using my hacked switch for 4 years and it isn't banned and works fine, it runs on emunand with the serial numbers wiped off when I use any modded software. I think older consoles that don't require hardware mods are not expensive so it might be worth a look.
It's surprising how little can go wrong actually and there is tons of support and guides on how to set it up. You basically create something called an Emunand which is basically another interatiom of your switch software inside your switch, so it's like 2 in one, the other side of your switch remains unmodded and can use online, and the Emunand is modded and has DNS blocking in place which blocks all Nintendo servers and links, so even if you accidentally opened the eShop on your modded side, you can't even access it. It's quite interesting and works very well, I highly recommend it.

I know one particular Zelda game where you need to flip the screen to do a particular task in game
I'm all for original games on original systems myself, but that's just since I have every Pokemon game since gen 4. This certainly does beat getting scalped if you don't have the original game cart tho, and it saves you from accidentally getting a bootleg

Dude! This is better than emulating DS games on a Surface tablet
i have something very similar to this for my legion go. i got a 3d printed flip grip and playing ds games on it is dope
I wish for Nintendo to approve this idea of how emulating a DS & 3DS game options in NSO when Switch 2 release and also this generation of Switch too.
