I haven't played Palword because I didn't care about it, but if Nintendo is trying to kill off all other monster games, then I will support Palword. I am tired of greedy old people.
No, every other one has his UNIQUE mechanics, like trapping with a card, recruit them or even hatching them. Palworld is just straight Pokémon but with weapons, all other games are sorprisely safe, even more beacause most of them are "friends" with nintendo, like capcom, bandai-namco, atlus, etc. Even indie games doesn't seems to have much problems by they own

cuz as far as im aware palworld was also using their own meshes on their pals and passing them off as "original designs" even though it was BLARINGLY obvious they weren't

@pftheswaglord I think very few border on being kind of rip offs. The others feel inspired by certain pokemon which isn't really bad since many pokemon are inspired off real world things, plus palworld has plenty of original designs as well. But them trying to patent a mechanic that pocket pair did before them in their first game is absurd.

Nintendo/Pokemon doesn't really give a sh!te about palworlds existence, their true target is Sony who is nintendo's biggest enemy. when palworld made a partnership with sony for being on the playstation consoles, nintendo saw that as sony threatening them. after the partnership with sony, palword gained an immense amount of traction and sony plans to double down on becoming the competition to pokemon. palworld is in a very grey area due to international copyright law between usa and japan, but a couple of the patents nintendo is trying to use, were filed after palworld's creation and the rest of them target the entire capture-mon genre(which last i check with videogame law, that doesn't hold up because you can't use mechanics as a reason to sue. if companies could, videogames wouldn't survive)...if nintendo loses this court case, sony could buy those patents or get them as compensation. the real fight here is sony vs nintendo, but this is a very complicated court case that many lawyers do not see nintendo winning
They better bloody not get control over those patents if that's the case; as much as Nintendo's being pieces of shit over this, I trust them with this more than the company that isn't afraid to sell your data because you refuse to play on their console.

Considering sun and moon exists where they have their own version of shadow the hedgehog and the entire game and the anime is based off of Yokai watch which itself is more based off of Pokémon than an actual rip off I don’t think they have a chance if the judge bringing that up in court. How fitting would it be if even if they won, the judge decided that to pay for their crimes of copying, they were forced to sell off all the human models from the Sun moon and the ultra games to level five. Would it happen? probably not. If this was to happen with a lose access to several popular Pokémon characters like red and blue. yes they appear in the battle tree. would it be karma at its finest? absolutely. needless to say, im on palworlds side.
what it really was that pokemon had a game like palworld in the works, but wanted to milk 30 more remakes before we even get to see it. now that palworld came out and beat them to it, they got mad and wanna sue them and shut them down, so they can continue not giving us what we want for another 20 years...
Land, air, and water mounting system they'd have to compete against Final Fantasy, Kingdom Hearts, Dragon Quest...there's so many games where Pokemon should be sued for using land,air, and water mounting systems. Monster capture has been around since Dragon Quest Monsters, and the mechanic of using objects to capture was used in Monster Rancher and several other games. The reason why the target is on Pocket Pair's back is because Palworld actually threatens competition and challenges the publisher's pride, showing them that it's not ok to leave a half finished product and showing them that quality is still preferred over quality. It's a matter of an overabundance of pride, something that will hurt consumers more than anything, but with the legacy of the company, would have been understandable and well placed if their work ethic matched what it did when they established their place in the industry.
What's Next?? Nintendo is going to go after movie companies for using the same feature/ride thing in certain fantasy/science fiction films simply due to video game patents also affecting television shows and movies featuring those inventions in entertainment??? Can't wait for many films prior to pokemon being under scrutiny because it features a human riding a creature to get to and from certain destinations.
When Nintendo says "investigate", being a video game company whose job is to make video games and not investigate, do they mean like they time they gangstalked that guy who made some emulator?

From my (extremely basic) understanding, patents exist as to force variety and innovation in the gaming industry so in a perfect version of this case, a human should be able to see that Nintendo's goal is to stop any competition from being able to create any game at all similar to Pokemon as to stop themselves from having to innovate, the complete opposite of what a patent should be used for, so said human should side with Palworld on this lawsuit. of course I don't know anything about law so I couldn't tell you what will happen just what I hope would happen.

They will fail. we know what they will use as patents: Battleing creatures Mounting Creatures Catching creatures here's the thing: they are all updates to a parent patent filed in 2021. But those game mechanics were uses and even invented by pocketpair in their 2020 game; Craftopia. And Japan has laws against corruption, especially in court and business. So Palworld is in the clear.

Why would we have to say goodbye to monster hunter? The games operate very differently. Same with Yugioh and various other titles named here. I think a lot of the reason in addition to what was stated above is that the designs from palworld can be a bit too close to those from pokemon. Like some of the Pals look like they could be direct evolutions of existing mons. I don't like what pokemon is doing at ALL but I would be lying if I didn't see someone of the early pals and wonder if there was a pokemon spin off game I hadn't heard of.

I wonder if Nintendo would have gone this route if the Pals were different enough from the Pokes? I mean Digimon, Nexomon, Monster Rancher and many more "Pokemon likes" exist - some with the gameplay and story structure even more closely resembling a traditional pokemon game than Palworld. But they never went after those? One can argue that Palworld is making money but so did Digimon and Monster Rancher back in their days? Oh Also - I agree 100% that Nintendo and Gamefreak need the competition. Palworld is necessary - and Im glad it came out. I work as a 3D rigger for Games and 3D Animation. Part of my job entails looking closely at model asset topology (how they are constructed) so I can rig them for animators. I've had a look at the several models side by side. They obviously are no longer 1:1 copies with simple texture or color swaps - but holy hell is it so easy to take an existing model, spend 20 mins - a few hours to tweak the geometry/topology into a different shape - slap a different texture onto it and wham "original new character", no copy rights broken. What I don't support is blatant asset ripping off. Unfortunately unless you have experience/training in building 3D models - a normal person wouldn't understand how a models Topology plays into all this. Anyone can make a box, a sphere or a cylinder. Anyone can make a 3D model of an eel or a dog - HOWEVER. even two objects of the same shape and size are always likely to have different topologies. Topology referes to the amount of vertices (points), edges and edge loops (lines) and their placement on a 3D model. for simple shapes - like say a box with no general subdivision - 2 modellers can obviously model a box from scratch and come up with the exact same topologies by coincidence because a simple cube will always have 12 edges, 6 sides, and 8 vertices. But a complex model like a horse, or a human - two different 3D artists, modeling a complex shape from the ground up - and having their topologies match by above 80 % is ludicrous. It's like being able to randomly guess the exact combination on a 12 number lock. Palworld models - differ in shape and look enough for them to circumvent copy right restrictions legally. But having multiple models, each individually be an 80% topological match is a major red flag. That said - do I think Nintendo is doing the right thing here? No - going after them via patent is obviously just legal manoeuvring around the fact that they cant get them on Copy Right infringement. Do I believe Palworld needs to get sued. Yes - but not in the manner that Nintendo is doing it. Do I believe Palworld needs to get shut down - NO, them being around is good for competition and frankly what the industry needs.
Its plain and simple. Nintendo posted that early remark cause everyone wouldn't leave them the hell alone. It put Palworld on their radar, but Palworld filled a unique niche they couldn't/wouldn't fill, so they planned on ignoring it. It wasn't going to truly compete with Pokemon, and many people would surely abandon it, being that it was and still is, in reality an incomplete game. There was also nothing that could be latched onto, thus they risked the biscuit and went with the last resort lawsuit, the Patent Infringement Lawsuit. So What changed, that Nintendo is out for blood? Pocketpair signed a deal with Sony and Aniplex If anyone knows anything, its that Sony and Nintendo loathe each other, and Nintendo is the king of pettiness, and seeing this happening, nah, gloves come off. There may be actually no patent infringement that Nintendo can sue for, but they will take this risk if it means the further downfall of it's competitor.
As much as I'm a long serving Nintendo/Pokémon fan, but this is really getting out of hand, i will NOT Tolerate Nintendo's disgusting bullying tactics on small indie gaming companies like Pocketpair and Palworld and I admit that I enjoyed playing Palworld on my PS5 and I truly respect pocketpair for what they've delivered was a amazing refreshing game for what Nintendo, the Pokémon company and game freak failed to do. They need to focus on making Pokémon games better and it's good to face competition.
Oh, right. They forced WayForward to do as they're told and keep creative freedom to a minimum. Supposedly, all the female COs were supposed to be closer to the female designs seen in Shantae, but Nintendo immediately shot down the idea. Saw one talking about this, that even Japan's patent law says you can't patent something if there's already a prior art. And even though the original patent does precede Palworld by 2 years, it does not precede PocketPair's other game of Craftopia, which uses the exact same mechanic and that one came out 2 years before Nintendo's patent. Not to mention I imagine World of Warcraft would like to have something to say about the mechanics Nintendo is claiming no one else can use. In which case, can you imagine Nintendo's reaction if not only does Sony act on behalf of their partnership agreement but also Microsoft on behalf of Activision Blizzard for WoW using all three of those mechanics and doing it first?
How did they get the patent then? It's like how seemingly no one can agree on if Crunchyroll did a crime or if it was legal because there are at least three diffrent stances going around the net.
@@lpfan4491 Um, they filed for it? Courts are not this all-knowing benevolent entity. They're people just like everyone else and I highly doubt that a patent clerk, even a japanese one, would be the person that would be all that versed into every aspect of every video game. The most they probably did was do a quick internal search to see if that mechanic was already patented, saw it hadn't been, then just assumed that the ones filing the patent had done their own due diligence and slapped down their stamp of approval. This is done all the time and not just by Nintendo. It's only if it gets challenged and brought up to a judge for adjudication that it's determined whether or not the patent is valid or either too overbroad or not something that can be patented in this situation. And then that only happens if the person being sued over it has the money necessary to fight the legal battle. Because if you have a ton of money to spare and you're able to effectively bankrupt your competition through legal fees, then even if you lose the lawsuit, you still win in the end since Japan doesn't award legal fees.

You can call Palworld being a pokemon rip off all you want, but suing them while ignoring the other pokemon rip offs really shows that they see Palworld as a threat, especially when they clearly couldn't sue over the monsters design(which hilariously is what most people who side with Nintendo think its the reason), so Nintendo went after pocket pair with gameplay patents that other games was already using. Also whats more hilarious is that Craftopia another game made by pocket pair is clearly a Zelda botw rip off was already using these same capture monster mechanic(but Nintendo completely ignores it ).
It may still be the reason is the thing. One of the bigger theories is that they just want an entry point to get Palworld searched for more issues and patents are the only thing they are confident they could win without bigger trouble.

History-Wise: Nintendo & Sony have been at "War' with each-other since the early 1990s when Nintendo & Sony teamed up to make a new peripheral for the SNES, a CD drive! The day after Sony announced it, Nintendo changed plans and changed to partnering with Phillips, announcing it to the world! Nintendo pulled out of this deal too... which lead to the Philips CD-i, and the peripheral that Sony was working on evolved in to the Playstation 1. Sony came to PocketPair and started backing them, wanting something to rival with Nintendo's 'Crown Jewel', some think that this is unjustified, but Sony's still pissed all the way back to the corporate betrayal of 1991... Japanese Corpos do not forget, and rarely forgive... Sony wants Palworld games, TV series, Merch... heck, if you look online you can see conventions with plush suits and the like... So, Sony stabbed back at Nintendo for Nintendo being jerks, and now Nintendo is going hard in the paint to shut Sony down.

Nintendo can rot right alongside its tired and dated franchise. They update the visuals, and throw in a one-generation sparkly new mechanic, but at the end of the day, every pokemon game is basically the same as the last. This lawsuit should be even more embarrassing for them, since Palworld isn't even in the same genre of games. Its not a turn-based RPG. Its not 'pokemon with guns'. Its a survival game, that has monsters you can capture and use. And pokemon didn't even invent the concept of having a fighting monster in an object. I don't remember the series name, but a 1970s era live-action show in Japan had a character with kaiju released from objects he carried, to fight the monster of the day. So that patent alone should be thrown out as a stolen idea. And flying mounts in video games date back at least to the 1980s arcade game, Joust.
They update the visuals? Scarlet and Violet looks worse than X and Y... and that generation was on an older platform. They've gotten lackluster and lazy, so much so that they don't even wanna let anyone use all of the Pokemon roster since Sw&Sh

I saw a video like this recently, and apparently, it's a counter to playstation company, i forget the name, getting palworld as a game for the playstation. It's not about being a pokemon clone but more of stopping a rival big game company from getting a game like pokemon that possibly could have sequels. Gonna look through watch history to find the content creator that mentioned this. (Edit: It's the channel named moon channel.)
Imagine FromSoft suing othet companies for making a Souls clone. Only Nintendo could be so petty to stop competition and being the monopoly in the genre.

PKM ☀️ and 🌙 took a lot of inspiration from Yo-kai watch. Rotom Dex= Whisper (both annoying ghosts that give info and have a black line between their eyes), Z-ring=Yo-kai watch, Z- crystal= Yo-kai medal, even PKM started dancing after.
Some of the Pals REALLY look similar to Pokémon, but as someone pointed out to me they come from the same yokai legendary creatures of Japan Pokémon used so it's inevitable. Really the closest thing directly ripped off is the pal sphere but that's hardly grounds to sue a game out of existence. There's no direct reference of Pokémon creatures/characters/setting.
the issue is its a PATENT lawsuit, no copyright issues at all involved in the lawsuit. And all of the patents in question are dated AFTER palworlds launch, this year. EDIT: also one of their previous games: Craftopia, has these mechanics from back in 2020 before Legends: Arceus even.
The relatively tiny amount Nintendo is suing Pocket Pair for is intentional. They want to make it more appealing to Pocket Pair in the hopes they settle. Because if they do settle, it can be seen as admission of guilt, which would set a precedent that allows them to continue doing this in the future for any potential competitors with the courts siding with them by default.
This is likely to backfire for Nintendo. Bandai has been watching them for decades now. Even if PocketPair settles, Bandai will pounce on Nintendo for the decades of Stolen IPs and Mechanics.
It just seems like Nintendo got tired of people not hating them enough So they are trying to cripple game development instead to see if people can hate them more then they do already.

The pokemon company is butt hurt because the pokemon games are getting lamer and lamer. Yeah, it's this reason why I couldn't watch the anime and movies like I used to with Gens 1 and 2. It's been the same SFW 3+ type of franchise for 20+ years now, forgetting about their mature audience in favor of families and children (even Michael Eisner felt the same way towards the Walt Disney Company back in the mid 1980s).
You forgot to mention that older patent to which they linked the new patent is old enough to use against palworld but their other game craftopia was using the same mechanics before nintendo applied for that older patent. It isnt even legal to patent well known and widely used things in japan but they did it anyway. This patent shouldn't even exist.
Patents must go or they're going to ruin game development in every country they have them. Crushing any would be developer under lawfare to the point only one thing could free their creativity again.
Two of the patents they're trying to sue for were filed two years after the same mechanics appeared in Craftopia, another game Pocket Pair made. They should never have been possible in the first place, and that's why this lawsuit is being looked at like a bunk scaretactic with a very low settlement. They want them to just accept the settlement and all of their conditions out of fear.
worst part is if after 20 year if you dont trademark or patent something it become free for the market. so nintendo isnt even aloud to patent anything because its bin over 20 years since the concepts have bin used(making them fair use anyways)

@@selc978 patents expire after 20 years, your window to patent something expires 1 year after you publish the "invention". but that's not relevant here because the patents contain a specific implementation, not a vague concept. concepts can't be patented, you have to detail a specific implementation of a concept and get only protection for that specific implementation.
Some simple investigation shows the parent patents are from 2021, Craftopia (PocketPair) released in 2020. Japanese patent law states prior art must be considered prior to allowing the patent. Whoever allowed the patent did not do enough for due-diligence, or knew and didn't care. This suit will fall flat on it's face, Nintendo knows this, they are hoping these patents get nuked into public domain so they cannot be counter sued. I think this, as all future Pokémon games will have this 3d ball tossing mechanic, all prior Pokémon games you use the ball from your inventory and the game animates the action, no tossing mechanic used.

In addition to shutting the game down, I imagine the cheap asking price is twofold: 1 They're saying "Take the money and run!" I think Nintendo is trying to goad PocketPair into trying to just run with the money. A sort of appeal to greed, if you will. Yeah, I actually don't think that makes too much sense. They could have gone for much easier targets to "legitimize their patents" and if they get Palworld searched, then I doubt they could get them on anything that is not actually legit(Just like how this patent case is technically legit by the way japan operates, as far as anyone knows). Make this a primary carching mechanic and Nintendo would not be able to touch pocket pair anymore because launching and throwing are two different things and therefore sont infringe on there patent copyright
i think launchers are still covered in the patent due to them being effectively an aid in throwing. but using melee attacks(think aloy's hacking spear in horizon zero dawn), or traps that are deployed nearby a pal(think ghostbusters) would likely bypass the patent.

As much as I despise the big N these days (I haven't bought a Nintendo console since my GameCubes... plural. Thanks, optical media), there's no denying that Palworld was little more than a cash grab catering to the lowest common denominator of dissatisfied Pokémon fans. AI generated or not, most of the hype around Palworld seems to be from the controversy; at least that's all the conversation I've heard about it. If it was actually a fun game, don't you think people would actually talk about the gameplay, instead of the game only in the context of how it relates to Pokémon? To me, Palworld was nothing more than, "Oh, you like Pokémon? Well how about this?", in much the same way Nintendo was like, "Oh, you like Minecraft? How about BotW and TotK?" Ark will very likely not be taken down. It's different from pokemon, which is the IP they're trying to protect. If it is taken down, there will be even more outrage than for palword since the game is hardly similar.
I agree with this! Even if other monster franchises are on Nintendo consoles, Pokèmon would still bully them in existence. No monster franchise will be safe if Pokèmon wins the lawsuit.
They knew Game Freak couldn't make a game as good, so rather than lose money on their cash cow, they tried to scare them with the court case, since that worked for other studios. They did not expect them to call their bluff and fight them in court. Now Nintendo has to see this through.
Palworld showed the world the actual numbers that Pokemon should have. New Pokemon games are not selling well at all, but the raw sales numbers don't show that. They have at least tripled the amount of fans they had in the 90s but the sales don't reflect that. It gets eviden't when games like Pokemon GO and Palworld released.
If Pokèmon wins the lawsuit, we would never see Digimon, Monster Rancher, Yu-Gi-Oh, Neopets, Palworld, Yo-Kai Watch, Bakugan, Monster Hunter, Monsuno, Nexomon, Chaotic, Monster Crown, Cassette Beasts, Monster Sanctuary, TemTem, Moshi Monsters or other monster franchises again because our only option would be Pokèmon.

For the patents, as info: The patents were registered 2 months after Palworld got introduced officially. So unofficially Palworld was earlier introduced, and I think Nintendo noticed this too. It's still scummy of Nintendo.

Because a ton of these creatures exist in folklore all over the world.

The funniest part of this patent lawsuit is that most of the patents made by Pokémon were only made AFTER palworld was released and are NOT unique in any sense of the way. Riding mounts is an issue in multiple games and throwing a ball to engage combat or any action would be an issue in dragon quest and MANY another games. So overall in the technicality of this lawsuit, if pocket pair collects the proper evidence this lawsuit can be completely nullified through providing evidence that their patents are completely bogus “unique features” to only their games.
you missed the part of the video explaining that the patents have a 2021 parent patent. they updated some non-binding expanations and comentary, this gave the patents a new number but retained the start and end dated from the original patent.
4:58 the problem with the parent patent thing is the parent was for Legends of Arceus which was in 2021. The mechanics used in Palworld were brought over from their earlier game Craftopia which released in 2020. A year before the parent patent which should, by patent law, mean that it is unable to be patented. I really hope Palworld does not settle and wins. This would set a precedence what would destroy indie games and severely limit what games could ever be made in the future, Oh you have a cool game idea, well mechanics for shadows is patented so you can't have that, cars are patented so no to that. oh you want it to be similar to minecraft... patented. Uses a gun? patented.. You will get nothing new, just same regurgitated crap from the same studios.

Nintendo/Pokemon doesn't really give a sh!te about palworlds existence, their true target is Sony who is nintendo's biggest enemy. when palworld made a partnership with sony for being on the playstation consoles, nintendo saw that as sony threatening them. after the partnership with sony, palword gained an immense amount of traction and sony plans to double down on becoming the competition to pokemon. palworld is in a very grey area due to international copyright law between usa and japan, but a couple of the patents nintendo is trying to use, were filed after palworld's creation and the rest of them target the entire capture-mon genre(which last i check with videogame law, that doesn't hold up because you can't use mechanics as a reason to sue. if companies could, videogames wouldn't survive)...if nintendo loses this court case, sony could buy those patents or get them as compensation. the real fight here is sony vs nintendo, but this is a very complicated court case that many lawyers do not see nintendo winning

Considering sun and moon exists where they have their own version of shadow the hedgehog and the entire game and the anime is based off of Yokai watch which itself is more based off of Pokémon than an actual rip off I don’t think they have a chance if the judge bringing that up in court. How fitting would it be if even if they won, the judge decided that to pay for their crimes of copying, they were forced to sell off all the human models from the Sun moon and the ultra games to level five. what it really was that pokemon had a game like palworld in the works, but wanted to milk 30 more remakes before we even get to see it. now that palworld came out and beat them to it, they got mad and wanna sue them and shut them down, so they can continue not giving us what we want for another 20 years...
Land, air, and water mounting system they'd have to compete against Final Fantasy, Kingdom Hearts, Dragon Quest...there's so many games where Pokemon should be sued for using land,air, and water mounting systems. Monster capture has been around since Dragon Quest Monsters, and the mechanic of using objects to capture was used in Monster Rancher and several other games. The reason why the target is on Pocket Pair's back is because Palworld actually threatens competition and challenges the publisher's pride, showing them that it's not ok to leave a half finished product and showing them that quality is still preferred over quality. It's a matter of an overabundance of pride, something that will hurt consumers more than anything, but with the legacy of the company, would have been understandable and well placed if their work ethic matched what it did when they established their place in the industry.
What's Next?? Nintendo is going to go after movie companies for using the same feature/ride thing in certain fantasy/science fiction films simply due to video game patents also affecting television shows and movies featuring those inventions in entertainment??? Can't wait for many films prior to pokemon being under scrutiny because it features a human riding a creature to get to and from certain destinations.

From my (extremely basic) understanding, patents exist as to force variety and innovation in the gaming industry so in a perfect version of this case, a human should be able to see that Nintendo's goal is to stop any competition from being able to create any game at all similar to Pokemon as to stop themselves from having to innovate, the complete opposite of what a patent should be used for, so said human should side with Palworld on this lawsuit. of course I don't know anything about law so I couldn't tell you what will happen just what I hope would happen.

Why would we have to say goodbye to monster hunter? The games operate very differently. Same with Yugioh and various other titles named here. I think a lot of the reason in addition to what was stated above is that the designs from palworld can be a bit too close to those from pokemon. Like some of the Pals look like they could be direct evolutions of existing mons. I don't like what pokemon is doing at ALL but I would be lying if I didn't see someone of the early pals and wonder if there was a pokemon spin off game I hadn't heard of.

I mean Digimon, Nexomon, Monster Rancher and many more "Pokemon likes" exist - some with the gameplay and story structure even more closely resembling a traditional pokemon game than Palworld. But they never went after those? One can argue that Palworld is making money but so did Digimon and Monster Rancher back in their days?

I work as a 3D rigger for Games and 3D Animation. Part of my job entails looking closely at model asset topology (how they are constructed) so I can rig them for animators. I've had a look at the several models side by side. They obviously are no longer 1:1 copies with simple texture or color swaps - but holy hell is it so easy to take an existing model, spend 20 mins - a few hours to tweak the geometry/topology into a different shape - slap a different texture onto it and wham "original new character", no copy rights broken.
What I don't support is blatant asset ripping off. Unfortunately unless you have experience/training in building 3D models - a normal person wouldn't understand how a models Topology plays into all this. Anyone can make a box, a sphere or a cylinder. Anyone can make a 3D model of an eel or a dog - HOWEVER. even two objects of the same shape and size are always likely to have different topologies. Topology referes to the amount of vertices (points), edges and edge loops (lines) and their placement on a 3D model. for simple shapes - like say a box with no general subdivision - 2 modellers can obviously model a box from scratch and come up with the exact same topologies by coincidence because a simple cube will always have 12 edges, 6 sides, and 8 vertices. But a complex model like a horse, or a human - two different 3D artists, modeling a complex shape from the ground up - and having their topologies match by above 80 % is ludicrous. It's like being able to randomly guess the exact combination on a 12 number lock. Palworld models - differ in shape and look enough for them to circumvent copy right restrictions legally. But having multiple models, each individually be an 80% topological match is a major red flag.
That said - do I think Nintendo is doing the right thing here? No - going after them via patent is obviously just legal manoeuvring around the fact that they cant get them on Copy Right infringement. Do I believe Palworld needs to get sued. Yes - but not in the manner that Nintendo is doing it. Do I believe Palworld needs to get shut down - NO, them being around is good for competition and frankly what the industry needs.
Its plain and simple. Nintendo posted that early remark cause everyone wouldn't leave them the hell alone. It put Palworld on their radar, but Palworld filled a unique niche they couldn't/wouldn't fill, so they planned on ignoring it. It wasn't going to truly compete with Pokemon, and many people would surely abandon it, being that it was and still is, in reality an incomplete game. There was also nothing that could be latched onto, thus they risked the biscuit and went with the last resort lawsuit, the Patent Infringement Lawsuit.

Saw one talking about this, that even Japan's patent law says you can't patent something if there's already a prior art. And even though the original patent does precede Palworld by 2 years, it does not precede PocketPair's other game of Craftopia, which uses the exact same mechanic and that one came out 2 years before Nintendo's patent. Not to mention I imagine World of Warcraft would like to have something to say about the mechanics Nintendo is claiming no one else can use. In which case, can you imagine Nintendo's reaction if not only does Sony act on behalf of their partnership agreement but also Microsoft on behalf of Activision Blizzard for WoW using all three of those mechanics and doing it first?
How did they get the patent then? It's like how seemingly no one can agree on if Crunchyroll did a crime or if it was legal because there are at least three diffrent stances going around the net.

@@lpfan4491 Um, they filed for it? Courts are not this all-knowing benevolent entity. They're people just like everyone else and I highly doubt that a patent clerk, even a japanese one, would be the person that would be all that versed into every aspect of every video game. The most they probably did was do a quick internal search to see if that mechanic was already patented, saw it hadn't been, then just assumed that the ones filing the patent had done their own due diligence and slapped down their stamp of approval.
This is done all the time and not just by Nintendo. It's only if it gets challenged and brought up to a judge for adjudication that it's determined whether or not the patent is valid or either too overbroad or not something that can be patented in this situation. And then that only happens if the person being sued over it has the money necessary to fight the legal battle. Because if you have a ton of money to spare and you're able to effectively bankrupt your competition through legal fees, then even if you lose the lawsuit, you still win in the end since Japan doesn't award legal fees.

Nintendo can rot right alongside its tired and dated franchise. They update the visuals, and throw in a one-generation sparkly new mechanic, but at the end of the day, every pokemon game is basically the same as the last.
This lawsuit should be even more embarrassing for them, since Palworld isn't even in the same genre of games. Its not a turn-based RPG. Its not 'pokemon with guns'. Its a survival game, that has monsters you can capture and use.
And pokemon didn't even invent the concept of having a fighting monster in an object. I don't remember the series name, but a 1970s era live-action show in Japan had a character with kaiju released from objects he carried, to fight the monster of the day. So that patent alone should be thrown out as a stolen idea.
And flying mounts in video games date back at least to the 1980s arcade game, Joust.
They update the visuals? Scarlet and Violet looks worse than X and Y... and that generation was on an older platform. They've gotten lackluster and lazy, so much so that they don't even wanna let anyone use all of the Pokemon roster since Sw&Sh

I saw a video like this recently, and apparently, it's a counter to playstation company, i forget the name, getting palworld as a game for the playstation. It's not about being a pokemon clone but more of stopping a rival big game company from getting a game like pokemon that possibly could have sequels. Some of the Pals REALLY look similar to Pokémon, but as someone pointed out to me they come from the same yokai legendary creatures of Japan Pokémon used so it's inevitable. Really the closest thing directly ripped off is the pal sphere but that's hardly grounds to sue a game out of existence. There's no direct reference of Pokémon creatures/characters/setting.
the issue is its a PATENT lawsuit, no copyright issues at all involved in the lawsuit. And all of the patents in question are dated AFTER palworlds launch, this year. EDIT: also one of their previous games: Craftopia, has these mechanics from back in 2020 before Legends: Arceus even.

The relatively tiny amount Nintendo is suing Pocket Pair for is intentional. They want to make it more appealing to Pocket Pair in the hopes they settle.
Because if they do settle, it can be seen as admission of guilt, which would set a precedent that allows them to continue doing this in the future for any potential competitors with the courts siding with them by default.
This is likely to backfire for Nintendo.
Bandai has been watching them for decades now.
Even if PocketPair settles, Bandai will pounce on Nintendo for the decades of Stolen IPs and Mechanics.

You forgot to mention that older patent to which they linked the new patent is old enough to use against palworld but their other game craftopia was using the same mechanics before nintendo applied for that older patent.

Two of the patents they're trying to sue for were filed two years after the same mechanics appeared in Craftopia, another game Pocket Pair made. They should never have been possible in the first place, and that's why this lawsuit is being looked at like a bunk scaretactic with a very low settlement. They want them to just accept the settlement and all of their conditions out of fear.

Digimon Rearise 2018 and Pokemon, Terastilization 202? Crystal Onix doesn't count it's in the anime not game and it's basically a regional variant.
Some simple investigation shows the parent patents are from 2021, Craftopia (PocketPair) released in 2020. Japanese patent law states prior art must be considered prior to allowing the patent. Whoever allowed the patent did not do enough for due-diligence, or knew and didn't care. This suit will fall flat on it's face, Nintendo knows this, they are hoping these patents get nuked into public domain so they cannot be counter sued. I think this, as all future Pokémon games will have this 3d ball tossing mechanic, all prior Pokémon games you use the ball from your inventory and the game animates the action, no tossing mechanic used.

Yeah, I actually don't think that makes too much sense. They could have gone for much easier targets to "legitimize their patents" and if they get Palworld searched, then I doubt they could get them on anything that is not actually legit(Just like how this patent case is technically legit by the way japan operates, as far as anyone knows). They can't just say "look, they ripped us off!" and point towards something that has no relationship to what they own.

I wouldn't put it past any company trying to make an example of competition to lure them in with small fines and then wallop them with the newly set precedent. As far as Japan operates, rich + old = "you must respect by default." Nintendo is also basically considered a (if not THE) crown jewel of Japan. The culture basically says "If Nintendo accuses, they're to be considered right until proven absolutely otherwise." If that sounds crazy, it's because it is. That's Japan, though.
As a result, they CAN say "look they ripped us off!" The patents they're suing over are child patents that were filed AFTER Palworld released. Child patents are an insane concept that lets you redefine an older patent. The ONLY upside is that the child patents expire with the parent patent (TWENTY YEARS after it was filed). The MASSIVE, EASILY ABUSE-ABLE DOWNSIDE is the retroactive suing Nintendo is doing. They said, as Fleekaziod put it, "Uh, actually, what I meant by that previous patent was THAT RIGHT THERE; MAKING MILLIONS OF DOLLARS!!"
The question I'm asking isn't "Can PocketPair win the suit?" My question is "Is there a limit in Japanese courts on the 'You must blindly respect and bow to the old & rich.' mentality?" If then answer is "yes," THEN my question becomes "By how much?" If the courts are fair, PocketPair have more than a good shot, if not they're screwed. This is also ignoring the BS "bleed their bank accounts dry until they can't fight the lawsuit anymore" tactic. Nintendo wants a monopoly on creature collectors, if it gets expensive it's still worth it for them.

I'll admit that I'm not the most well-versed in Japan's culture or patent law, but the above is basically what I've been hearing from people who at least claim to be. HOWEVER, even in the best case scenario, where Nintendo is in the right across the board, Nintendo doing this is a direct threat to gaming as a whole. If this is allowed, ANY company can make such claims against potential competition, legitimate or otherwise. Personally, I don't think it's even close to that scenario. I think my original assertion is on point.

Palworld should then abandon throwing object to catch pals and focus on another catching mechanics that exist in paleorld. Launching. When youre further in the game you unlock a palsphere launcher, which is basically a missile launcher that shoots pal spheres at greater speed and length. Make this a primary carching mechanic and Nintendo would not be able to touch pocket pair anymore because launching and throwing are two different things and therefore sont infringe on there patent copyright
i think launchers are still covered in the patent due to them being effectively an aid in throwing.
but using melee attacks(think aloy's hacking spear in horizon zero dawn), or traps that are deployed nearby a pal(think ghostbusters) would likely bypass the patent.

As much as I despise the big N these days (I haven't bought a Nintendo console since my GameCubes... plural. Thanks, optical media), there's no denying that Palworld was little more than a cash grab catering to the lowest common denominator of dissatisfied Pokémon fans. AI generated or not, most of the hype around Palworld seems to be from the controversy; at least that's all the conversation I've heard about it. If it was actually a fun game, don't you think people would actually talk about the gameplay, instead of the game only in the context of how it relates to Pokémon?
To me, Palworld was nothing more than, "Oh, you like Pokémon? Well how about this?", in much the same way Nintendo was like, "Oh, you like Minecraft? How about BotW and TotK?" I don't believe Nintendo is in the legal right (that doesn't mean I think they'll lose), but these kinds of controversies tend to dominate the conversation, and aren't helping the gaming community.

I agree with this! Even if other monster franchises are on Nintendo consoles, Pokèmon would still bully them in existence. No monster franchise will be safe if Pokèmon wins the lawsuit.
They knew Game Freak couldn't make a game as good, so rather than lose money on their cash cow, they tried to scare them with the court case, since that worked for other studios. They did not expect them to call their bluff and fight them in court.

As i said in a different video Nintendo has a patent monopoly. Pretty much every game that exists Nintendo can sue.
Palworld showed the world the actual numbers that Pokemon should have. New Pokemon games are not selling well at all, but the raw sales numbers don't show that. They have at least tripled the amount of fans they had in the 90s but the sales don't reflect that. It gets eviden't when games like Pokemon GO and Palworld released.
If this happens I will never buy or support any Nintendo products ever again. I encourage everyone to do the same.

People also need to address that technically if they win this; they aren't going to quit. They will try to take on any future game created with aspects of their IPs which mind you have also a ton of mechanics borrowed from other games out there. Pokemon is oddly similar to Dragon Quest, not just in mechanics but also in designs. And what next are they going to see religious iconography too. Because a ton of these creatures exist in folklore all over the world.

The funniest part of this patent lawsuit is that most of the patents made by Pokémon were only made AFTER palworld was released and are NOT unique in any sense of the way. Riding mounts is an issue in multiple games and throwing a ball to engage combat or any action would be an issue in dragon quest and MANY another games. So overall in the technicality of this lawsuit, if pocket pair collects the proper evidence this lawsuit can be completely nullified through providing evidence that their patents are completely bogus “unique features” to only their games.
you missed the part of the video explaining that the patents have a 2021 parent patent.
they updated some non-binding expanations and comentary, this gave the patents a new number but retained the start and end dated from the original patent.

4:58 the problem with the parent patent thing is the parent was for Legends of Arceus which was in 2021. The mechanics used in Palworld were brought over from their earlier game Craftopia which released in 2020. A year before the parent patent which should, by patent law, mean that it is unable to be patented. I really hope Palworld does not settle and wins. This would set a precedence what would destroy indie games and severely limit what games could ever be made in the future, Oh you have a cool game idea, well mechanics for shadows is patented so you can't have that, cars are patented so no to that. oh you want it to be similar to minecraft... patented. Uses a gun? patented.. You will get nothing new, just same regurgitated crap from the same studios.
Also Nintendo's patents in this particular instance are vague and stupid. They are basically claiming that they own the rights to 3rd person adventure RPGs in general regardless of whether they are creature catchers or not. If Microsoft or Blizzard wanted to, they could literally tell Nintendo to get rid of those patents and they'd have to capitulate.
