I will say, the killing of Charlie Emily was probably not First Degree:
The Midnight Motorist Minigame happens canonically before Charlie's death so it's clear to say that at that time, Willaim was drunk and was mentally unable to formulate a plan to kill Charlie, and it's been stated in the MatPat Lore video that this was more likely a thought of the moment, a way of making Henry pay for what his robotics did to William's child, so he couldnt have planned this before hand.
This would most likely fall under consideration of Second Degree Murder where the Person does not planned to kill before the act but felt like taking the life of the victim; William's selfish ways plus his grief towards his dead Son and the ammount of achohol in his body caused this crime which would intent a large emotional reaction that would give him the intent to kill Charlie, securing the 2nd Degree Murder instead of 1st.
Now, his sentence for the crime: We dont know where the location is in the US Charlie was murdered in, but we know the first location was opened in Salado, Texas so it wouldnt be unfair to assume the crime happened in Texas, wether in the first location or not; The federal Sentence in Texas for 2nd Degree Murder would be between 2 to 20 years in state prison and a fine of 10.000 Dollars at minimum, due to the victim of the crime being a child, it wouldnt be unlikely to assume this would get him the maximum sentence.
Meaning instead of getting charged with 1st Degree Murder and being getting a life sentence, For the death of Charlie Emily, William would be charged with 2nd Degree Murder and he would get 20 years in state jail and a fine of 10.000 Dollars.

I have to wonder, in a court of law, what would they consider Afton’s crime when he tore apart the possessed animatronics?
I mean, it’s not like it matters too much seeing as he would already have multiple life sentences on top of a death sentence (depending on which state punishes him) but just for the sake of argument, what would it be considered?
On one hand, you could argue it’s murder, since the spirits are essentially living in the machines.
On the other hand, you could make an argument that the spirits are no longer alive, and instead destroying their vessels is more like desecrating a grave or final resting spot.
Either way, could see someone making a good legal argument for either outcome, on top of the fact that he broke into Henry’s private property to destroy the machines.

    • @melaniescribbles
      @melaniescribbles 3 หลายเดือนก่อน +1

Honestly, I'm European and I might be interpreting US laws a little funny, but cops in general would be unlikely believe the spirit story, so a court would probably would only look at the property damage to the animatronics in that case. And since the spirits can barely utilize the animatronic's voice box to talk (we see in the first game that they can really only make creepy noises from time to time), I can't exactly picture them properly testifying in court at all on this. So William would be likely to get a vandalism charge for it, and given how much the animatronics are worth; it's probably classed as a felony (I looked it up; any damage done worth under 1000 dollars would be considered a misdemeanor in court, but an animatronic would DEFINITELY be more expensive than that to both build and maintain). I'm not sure how the sentence exactly works in the state that crime takes place in, so I'll leave figuring out the final sentence for that charge to the actual Americans.

If we're charging William for the company's manslaughter of Phone Guy, we also should charge him with concealing multiple felonies. Phone Guy warns us on the very first night that if you disappear during your shift, the company will file a missing person's report within 90 days, or after the carpets have been changed and the floors and walls are properly bleached. If that's not bad enough, the warranties they make you agree to prior to signing up can't possibly be legal either. Add some more lawsuits to the tally.

For example, the BC 666 ST boss, where your comunit is hacked and is playing a jukebox, if you failed to fix it, Springtrap while jump on you and stab both your eyes with knives damaging your vision (its a story block because if it didn't happen Goalius will still lose his sight but by the infected dark speakerman) second is in Immora while having a conversation with Davoth wife there were supposed to be 5 Imps and a Prowler but there wasn't there are instead 6 Tyrants (a Tyrant is made by a victim who was mutilated on the arm and leg before death) and finally Afton during his boss fight confessed the murder of an entire Orphange while killing Goalius Sister Silver which caused Goalius to overheat so by doing the math he gets 7 mutilation a mass murder and a Regicide charge (no Silver isn't Royalty but sense shes Goalius sister whi is Royalty i believe that it counts)

Considering William Afton's sentence is of 1 death + 22 life + 92 years + removal of bunker + $141M fine in the games, and considering the games lore, we can reduce his life sentence with what has happened to him:
    Springlock failure: -1 death.
The springlock would remove him his death sentence because he died biologically meaning that he has died and we can remove him the death sentence. So -1 death here so far.
Getting burned in FNAF 3: -1 life.
The fire in FNAF 3 could be considered that it was lethal to kill anyone, therefore William died again, and dying means that you end a life sentence. So -1 death -1 life here so far.
Getting burned in Pizzeria Simulator: -1 life.
The fire in PS totally destroyed him and he went to Hell after, so that means he died again. And since he died again, he just finished another life sentence. So -1 death -2 life here so far.
Getting burned in SB: -1 life.
Same here as FNAF 3 and 6. William Afton died again burned getting destroyed again, and dying means finishing a life sentence. So -1 death -3 life here so far.
And those are all the times he has died in the games, therefore his sentence for his crimes in the games is reduced and now it is: 19 life + 92 years + removal of the bunker + $141M fine.
As William Afton is an immortal person, he can complete this life sentence. He just needs to stop doing crimes, die another 19 times, wait 92 years after all these deaths, get his bunker removed and pay the $141M which I don't how he'll get the money considering that he has lost everything lol.

    Here we go:
-As another comment states, the underground bunker is used in some capacity as an actual rental service for the animatronics. There's a chance he got permits as he also has employees at this location, though 2 disappear and nobody comes looking so it's very hard to say conclusively.
-While its hard to be sure who is directly at fault for the strength and safety of the animatronics jaws, we can at least include a criminal negligence charge on top of the murder for the baby's killing of elizabeth. As her father, he had an obligation to be sure his daughter was safe and making an animatronic for killing that she could access endangered her life. I consider the negligence of leaving a dangerous object around a child a separate charge from the murder charge.
-Springtraps jumpscare in FNaF 3 isn't a canon event. Furthermore, he would have no way to actually kill the security guard as he is immortal. Though perhaps he would simply trap michael and set him on fire?
-Speaking of fire, the FNaF 3 fire is not believed to be caused by William. The common theory is that michael afton set the place on fire to kill springtrap, but springtrap escaped.
-Springtraps fnaf 6 salvage minigame jumpscare is also not canon. But when it does occur, the nightguard does not die. The animatronic escapes into the pizzeria after presumably attacking the guard non fatally. [Also the guard is still immortal.] This should be assault. HOWEVER, springtrap has a seperate jumpscare that "can" occur in the office that ends in a proper game over, so that could be considered murder if we assume springtrap deliberately sets michael on fire after knocking him out. [In FNAF 6 specifically, the most likely scenario of a game over is the animatronic attacks michael then leaves the pizzeria, meaning henry's trap has failed and the spirits cannot be put to rest.]
-New lore suggests that burntrap is not the original william afton, but a mimicking AI replicating his identity and MO. As such, william should lose any charges related to glitchtrap or burntrap as his soul is canonically trapped in hell during these events.
-For FNaF 1 jumpscare, michael afton is forcibly shoved into a freddy suit. He would survive this but his body would likely be forever trapped and also quite mutilated, practically combined with the suit like springtrap. We'll call this Mutilation as far as charges go, though such a charge is highly unusual on a corporate level. it may simply fall under corporate negligence with a harsher penalty. FNaF 2 jumpscare, jeremy would die of course. But he is already counted in the bite of 87 death as he is commonly accepted as the victim.
And finally, the movie is it's own timeline so merging the crimes into one raplist wouldn't be accurate as we'd be doubling up on murder charges for children he killed in both timelines.

Allow me to add a few more to this list: if we're under the assumption that Glitchtrap is in fact William Afton and not the Mimic1 program, then his crimes as Glitchtrap stretch far beyond just what happened to Vanny and Jeremy.
    1. Since you're counting Vanny's crimes as Afton's, that would mean that Patient 46 (Gregory) would fall under this category too as he was the one who gave Afton control of the Glamrocks, making Afton responsible for almost every crime the Glamrocks end up committing over the events of Security Breach and all the deaths they caused as a result of Gregory's tampering, giving him more second degree murder charges for the 3 therapists that were killed by the Glamrocks.
    2. Since you skipped over FNAF AR, in the unused emails for the game, it was revealed that Vanny hacked all of the Fazbear Funtime Service animatronics and turned them aggressive while also getting all of the employees killed by giving Glitchtrap control over their circuit boards, and while it isn't specified just how many people worked at the Funtime Service, there are a total of 7 known employees that worked at the service during the time of Vanny's infiltration, which would give him 7 more first degree murder charges for each of them.

It might be kidnapping because of the digital transfer, depending on if she stays there for life or not.
5:47 Also, you could argue, depending on the State of the bodies, that these two commited suicide by themselves without any involvment from the animatronics, but making it corporate manslaughter is fair.

I feel like the FNaF movie deaths (the ones by the animatronics) wouldn’t count, since technically, the people were trespassing on HIS property, and they also destroyed some of it, as well as breaking and entering. The animatronics were simply protecting the pizzeria.

  • @JFTArchive
    @JFTArchive 5 หลายเดือนก่อน +1

I wouldn't charge him with Arson in FNAF 3 as the motive behind it doesn’t make sense. We know Afton enjoys killing people (considering hes done it over a dozen times) and during FNAF 3, Fazbear's Fright is only a week from opening with him being able to freely roam around it. Seems like a perfect murder ground for him to take advantage of, and also him burning down the place and potentially killing himself in process just doesn't add up with his character since Afton is shown time and time again to have intense self preservation instincts. One of his man goals in this franchise is trying to achieve immortality due to his innate fear of death.
In FNAF 6 during the salvage minigames, when you get jumpscared, the animatronics don't kill you, it seems you just knocked out since the game doesnt end and you continue as normal, with the downside being the animatronics are now loose in the restaurant. So the charge should most likely be "Attempted Murder" if anything, or at least an first degreee assult charge.
You missed a crucial part about the bunker, its a was revealed in one of the novels it served as an underground testing facility where Afton not only stored his Funtime Murder Robots, but specifically, he took children he kidnapped and experimented on them with hallucinogenic gas, while keeping them trapped in fake testing chambers designed to look like a house (the rooms in FNAF 4). I don't know what kinds of charges all of that falls under, but its definitely not a light one.
