    Dr. E. Michael Harrington is a professor in music copyright and intellectual property matters. He has lectured at many law schools, organizations, and music conferences throughout North America, including Harvard Law, George Washington University Law, Hollywood Bar Association, Texas Bar, Minnesota Bar, Houston Law Center, Brooklyn Law, BC Law, Loyola Law, NYU, McGill, Eastman, Emory, the Experience Music Project, Future of Music Coalition, Pop Montreal, and others. Michael has worked as a consultant and expert witness in hundreds of music copyright matters including efforts to return "We Shall Overcome" and "This Land Is Your Land" to the public domain, and has worked with director Steven Spielberg, producer Mark Burnett, the Dixie Chicks, Steve Perry, Busta Rhymes, Samsung, Keith Urban, HBO, T-Pain, T.     This video was extremely helpful!!
    So when you do the copyright application for your song can you go ahead and release the song same day or same week or do you have to give it time or wait?? I’m really new to all this music copyrights and stuff. Also what other legal things should I take care of before releasing a song or album (copyright, registering song)?? I have no idea what I’m doing so anything helps!

      Once you write the song it's copyrighted. Apply for copyrights is protecting you in the event of a legal battle, it's documented proof that the works is yours.

    I thought copyright lasted either 120 years since creation or 95 years after publication (whichever ends first). Yet now it’s 70 years after the death of the author.
    It used to be 75 years after publication but that was changed in the 1990s to 95 years after publication.
    Now it’s 70 years after the author’s death which is likely even longer than 95 years after publication.
    It seems that every time we are getting close to have new stuff in the public domain they change the copyright laws to keep it out of the public domain.
    And I think the 70 years after the death of the author is actually a lot more messy than 95 years after publication.
    What if there are multiple creators? Do we need to wait for every child actor to be dead for 70 years until a movie enters the public domain?
    Why not keep it simple and go by publication date?
    99,99 % of creators don’t need to worry about outliving their copyright if we go by 95 years after publication.
    So what’s the use of this change?
    Star Wars would have started to enter the public domain in 2073 with the whole of pre Disney content (the EU) being in the public domain by the year 2111.
    And who even is considered the creator of content belonging to a franchise like Star Trek or Star Wars. I mean Gene Roddenberry has been dead for more than 30 years but I don’t think TNG will be in the public domain in 2060 since it continued even after Roddenberry died.
    And George Lucas had very little to do with the EU content of Star Wars. So how many people need to be dead for 70 years for something like the Dark Forces/Jedi Knight series to enter the public domain?
    It’s just so confusing now.

    Can you submit an audio recording when copyrighting a music composition or does it have to be transcribed into sheet music? (Note: I'm not talking about copyrighting a sound recording, I want to copyright the underlying musical composition. I would like to own the copyright for both the music composition and the sound recording, me being the author of both, but if I were to only copyright the music composition, are you allowed to use a sound recording to do that, or does it have to be transcribed into sheet music?)

    I Have a question: If I produce and record the backing tracks myself do I need a copyright license to sell it? As far as I know of copyright I wouldn't be using the lyrics nor the melody, but would create my own arrangement as a backing track of other artist's music, in this case I think I wouldn't need a license, am I right?

    If I put on a live show and wanted to play a song by an artist after the show was over (as people are leaving) what is the ruling on that?
    Not performing the song or using in the show, just simply playing it as the crowd is dismissed.

    Can I use a melody sound from a song played by me using a different instrument and release it in a song on iTunes with out permission? Not using the actual song but making the sound with my own instrument. Hope I’m explaining my self. Thanks.

    I would suppose it would be a good thing to register your songs in the copyright office of the U.S. (or whatever you call it), in case someone happens to steal your work, your recording. Then you can claim, that is mine, it is already registered! Am I right?

      Correct. Technically, your work is protected from the moment you create but, in practice, that doesn't mean much of anything, especially in the US. At the same time, if your song is mostly just sitting on your hard drive and not making any money, copyrighting isn't necessarily a priority (costs money to copyright, so if your song's not out in the world trying to make money, what's the point?). I'd wait 'til I have a batch of a dozen or more songs and then register them in bulk (cost is the same, regardless of how many songs you register).

      Yes copyright your material if you plan on taking it publicly to protect yourself from people trying to steal it.

      Yes, whoever owns the rights to the song you're covering is entitled to whatever money you make from it. You can cover a song, but technically you're supposed to get permission from the copyright holder to do so although it's not enforced unless you're making money off the song then they can make a stink about it.

    I have a question that I wonder if someone can answer for me. When I send a song to get it copyrighted, can I send a very bare back bone demo of it (acoustic guitar and 1 simple vocal track)? If so, after it is approved can I go back in and actually record it professionally with a full band, vocal harmonies, lead guitar solo’s etc and still have it be protected? I just don’t want to put in all the potential money and effort to get my song professionally produced and recorded BEFOREHAND but then have the song get rejected by the copyright organization because it happened to be too similar to another song

      I have several lyrics and nothing else copyrighted, so yes you can and should copyright your demos.

    I am beginner producer and i see some people gives acapella for example for free (royalty free copyright)
    So how is that work?
    I am just curious about that
    For example if someone stole those royalty free acapella how the owner will take his right?

      I think the artist needs to first form the music into an actual tangible item (mp3,records) for there to be any legal action taken. I'm sure this was said in the video as well.
