How to succeed at a Mandatory Settlement Conference [MSC]

    In this episode of Litigation Whiteboard, Attorney Steve discusses the "MSC" or mandatory settlement conference, what it is and how best to succeed.
    The main thing to know is that settlement cannot be forced upon you and you have the right to walk after a good-faith effort at trying to resolve your dispute.
    It's also important to know if you need to submit a mandatory settlement conference statement or legal brief Check with the judge's rules.
    Make sure you are on time and prepared to go to the right courthouse. If you have evidence or case law, bring that with you.

    Mr. Vondran; I cannot thank you enough for all your videos. Im a pro se Plaintiff against a City in Ohio for having demolished my planned retirement home without Due Process etc etc ( 34 count complaint) No frivolous .nonsense, no fishing, all real-supported-undisputable evidence. Since i cannot afford an atty; 20-$30 k retainer fees; seeking 1.5 M in light of the hundreds of homes demolished without a single due Process procedures.;.. im forced do it all myself. now certain to be annihilated for failure to know court rules & procedures.
    ive already won the initial case where the city tried to collect demolition costs;( ie failure to provide right to appeal.). the District Court has not dismissed my complaint as my grounds are strong and evidenced and supported. Its been your vidoes that helped to get the information and and answers to questions . I cannot thank you enough.... we tried to find an atty who would take over the case on contingency since we already have most everything evidenced and filed, now 4 months in to that case we are still alive and well.
    sadly we have yet to get any interests from attys. Neverthe less we remain in play on our own and we did it with the help of your videos. thank you again 100 times over; respectfully john j. york Pa. jan 9,2020

      @@attorneysteve intelligence is irrelevant. Admissible facts matter. You know. Tort claim v. 2 attorney defendants elder fraud. Survived 2 mtd and a sj. Haven't had a litigator, but bringing one on finally. Your videos helped so much. When I'm discussing with my (attorney) sister I always say we'll, according to 'the attorney Steve litigation white board ' in your voice. I'll let you know when I cash my check. 💪⭐👊

    At my settlement conference, the judge said "I am sorry to say that I don't see any way to settle and I don't want to say what they offered. So, I have to end the settlement". The cops said they will settle with the cost of the litigation for false arrest and put in jail without due process. Many lawyers said I have no case because I did not get shot!!

    It is all about whom has the better leverage and in my opinion a maximized leverage comes from a powerful narrative in the media. Such as #BLACKLIVESMATTER, #METOO, and #LGBTQ. The party with the leverage sets the terms of any negation or settlement.

    I am so grateful for your video. I have a settlement conference on September 16 at 8:30, do I have to bring my proposal document to the court that same day, or I have to bring it to the court a week before the conference date.

      Best I can say is some cases settle and some don't. I am not sure there are any official stats on this and it depends on the facts of each case and reasonableness of the parties, and sometimes it depends on how good the mediator is, (many times I would say). So sorry I could not provide a figure. Thanks for your comments! Steve

I want to utilize every opportunity to present my facts on record and show lack of defense. I'm just interested in your opinion. Or even about opening statements.

    Question, what if the defense want to offer a settlement before the mediation date, the deposition was already done a week before, and now before the mediation date the defense sent a offer that is good only for 30 days..does this mean much of anything? Thank you

      I had the PLAINTIFF'S lawyer give me a agreed payoff of NOTHING. The plaintiff is guilty! They want me to sign over my house of $580k that was in my name for 36 years and pay their lawyer fees. My greedy sister and my poor mom who is being forced to sue me. Sad. Sister got a Devil Lawyer. Tomorrow is MSC. Doing it on ZOOM.

    In the trial do I have the right to talk to the judge myself ?because my attorney has been doing all the talking

      I would ask your attorney for specific advice. If my client wanted to talk to the judge, I would ask what the question is, and I would try to raise the issue in Court. That's just me. There may be things he or she does not want to raise. SV

    My lawyer told us that if we could not square up our bill before our MSC that we were going to do it Per Pro. Not sure what to do.

    If your jury verdict is more than the the insurance limit amount are you still entitled to the jurys verdict amount especially if the defendants insurance company keeps low balling you

      My case is going into the MSC. I will not settle for less than a certain amount. This will not cover all medical oost. If I take this to a trial can the jury raise the amount I am requesting?

    Any money says you were a coach...I’m going pro se v. exhusband, who is an atty. 30 years married and he rigged it so im now indigent at 67. Your videos are outstanding. Lastly, look into a clip on microphone, wireless instead of the deodorant can. Love to mitts too.

      If you can't get an attorney to listen, you don't have a case. Or, you can't explain it, or you're not credible.
