  • This episode of Litigation Fundamentals focuses on the preliminary stages of a lawsuit after it has been properly commenced, also known as the Rule 26(f) conference, which leads to the Rule 16(b) planning conference and order. Henry M. Quillian III reminds the group that the intention of a conference is to summarize facts. Complex factors-including an unusually large number of parties, large claims, greater than normal volume of evidence, multiple use of experts and elaborate discovery of electronic information-can drive the number of depositions or discovery tools. He points out the significance of protection and production of electronic discovery for electronically stored information and the importance of working alongside IT professionals to understand management and extraction of materials across various systems.

    When my case was assigned to federal court, it was assigned to a magistrate and a district court judge. The magistrate oversees all the pre-trial stuff.

    I'm learning all this after the moment...I actually asked for conference from dist. Court by motion, mainly cuz the court has given me NO breaks as to "rules". Like it was dismissed w/o prej. for not showing juris. I submitted why the court has juris. along with better detailed claim & the court won't tell me status of my claim. Won't tell me next step.       @@ryanvanlue7020 I'm on my own. I will submit my motion to reinstate my claim due to documents sent from court via USPS did not reach me in a timely manner if at all. I have requested the court send any correspondence to my email.
