    Question: you said that affidavits are considered hearsay and inadmissible at trial. How was Roe v Wade allowed to proceed based on the affidavit of an anonymous plaintiff (Norma McCorvey, aka Jane Roe) who never physically testified in court? Not only that, but make it all the way to SCOTUS? Furthermore, why did the courts accept an affidavit from two attorneys (Weddington and Coffee) representing an anonymous client that they drafted and notarized themselves? Is it ethical/legal for an attorney to notarize their own documents?

      Excellent question. I don’t know the specifics of that case, which I believe may have come out of Texas. My knowledge is only as to Tennessee state courts.

    In the recent election court cases Giuliani says that he has about 100 affidavits. Where people are saying in the affidavits I saw people cheat this way or that way. Can an affidavit still be submitted even if the people who made a sworn statement would be willing to testify in lcourt also?

      Affidavits are often submitted to the court for one reason or another, but if a case comes to a trial, an affidavit is inadmissible hearsay evidence.

      @@attorneyknoxville thanks, I guess I just don't understand how it could be considered hearsay when it's from a witness who has signed a sworn statement. They're not hearing it from someone else it's from the direct source. So if that's the case then, wouldn't the court compel the witness to testify in court then , that would make sense considering that what they're saying is true and should have a chance to come forth to produce Justice, if someone has witnessed a crime

      @@tjmns I would guess that they would have no way to cross examine the witness and their statements. It still a statement outside of the courts.
