    As a layman, Juniors and seniors that think they smart must learn from you. There are lawyers that can question and Succeed and there are lawyers that's on the payroll......? Affidavits, only one answer "facts" not fraud.

    Family Court Australia accepts theories and assumptions even stated as theories and assumptions, and does not penalise for perjury siting too many cases to prosecute! Why it’s accepted and understood that so many lies are told that investigating them all would take too long and also treat those lies as facts is mind boggling to me.

    Hi, Mr, I'm wondering whether an affidavit is governed under the evidence act 1950? I notice that section 2 mention affidavit however I'm having trouble understanding the section. I hope that you could enlighten me on this. tq

      You are right! The section suggests that the Rules of Evidence in the Evidence Act do not apply to affidavits. So hearsay evidence is accepted in affidavits. But taken too far, this interpretation will bring about injustice. We are thinking of doing more on affidavits-subject to availability of time-so keep your eyes peeled!

      GK you have expertly explained about an 'affidavit ' and how and when it is applied.Thank you, But away from it ,another is a political venture being initiated by some MPS or Politicians, that is the talk of a 'Hybrid ' Parliament.What does it mean,is it a psychological or political manoeuvre openly done to distract Parliament proper,where political support by votes of influence practised or adapted is subject to further questioning ?Am I partly correct or wrong?, Please GKtv advise me and others for a wider understanding of such a move.tq Sir.

    Affidavit filed in court by plantiff... Can plantiff once again defend themselves we have filed false facts in affidavit which is filed in court

    Sir can the SC mandated income affidavit format (for CRPc125A) be altered such as removing the questionnaires and Declaration paragraph enable to suit one owns narrative? Can this be prosecuted for perjury and lying for giving false affidavit?

      I apologise. I am unable to answer this question because it is fact and jurisdiction sensitive.
      The answer I give can go in several directions depending on what was said or what was removed and what the state of statutory provisions are in your state/country.
      I suggest you seek a lawyer familiar with this area of law in your town or jurisdiction.
