      I wish she’d been less patient.
      After one month with no progress alarm bells should have been going off. After two months ,maximum, if he can’t show you SOMETHING, you’ve been put on the back burner and should get your retainer back. He’s not drafting a custom mansion, after all.
      The truth is, in the year plus that she waited on this guy, the renovation plan could have been drawn up , permits pulled ( if it had been legal), and the reno work completed.
      Get recommendations from friends, neighbors and coworkers. Word of mouth is the best way to find a good architect and builder.

    This guy’s license should be taken away. My husband is an Architect and he said the very first thing you do is find out the codes and ordinances of the project. He is absolutely lying when he says it’s just the nature of the business. What a crook!

    He should not only have checked the zoning BEFORE, he drew anything, he should have KNOWN he had to check it.

      I suspect he initially put the project on the back burner, then when pressed by the plaintiff to get something done, handed it off to an inexperienced and/or incompetent co-worker who he didn't properly supervise. Still on him as the architect.

    I hired a guy like him. A very good lesson. The first appointment he missed because his sheep was sick - yes, that's what he said - should have alerted me. A horrible person.

    What is worrisome is that even when he loses, he still thinks that he did a good job and deserved to keep her deposit. His attitude is 'we'll find out by trial and error', but his job is to know beforehand...

    I dont think if I was the plaintiff I would of waited so long when they say, "we're working on it" with no results..3 months max. Then the to have his "assistant" work on it after a year?? Ha! At least assistant was responsive. Glad she got her $$ back.

    As the plaintiff was explaining her situation and what she wanted, the first thing I thought to myself was okay you need to go to zoning and make sure that that can be done there. I'm not even an architect or anything and my puny little brain comprehended that that's the first thing that you need to do.

      That's why you hire somebody that should know what the hell they're doing. An architect and or Builder should know the codes and if they don't they should find out to tell their customer and make changes to plans

      As the daughter of a carpenter that owned his own construction company, I have to respectfully disagree.
      The onus is on whatever trades person you hire to know/investigate the zoning bylaws in the case of building or remodeling, an electrician needs to understand codes etc.
      Only if the professional tells you that the onus is on you, and only if you are NOT paying them to have that knowledge, is that on the homeowner.

    He really needed to look before he leaped. Someone of his qualification should have known that there was an illegal extension and exactly what he had to work with. As JM pointed out he took 18 months to finally inform the plaintiff. There should be a non refundable fee for doing all the checks and then after that comes the deposit for the work.
    He could have saved himself a lot of embarrassment by admitting his mistake and just giving back that money. If non refundable meant you can keep money even with gross incompetence then it would be a scammers paradise.

    “Non-refundable” should only apply to gift cards, not contracts like this. People slap that onto all contracts and think that it’s above the law.

    From the intro, I couldn't see how not getting the project approved could be considered a total failure on the architect's part, but after hearing what the rejection was based on, I can see how that would have been a show-stopper if it had been caught where it should have been caught, right in the beginning. This mistake seems to border on malpractice.

    It's called Errors and Omissions insurance and most states require that you have this liability insurance as an engineering or architectural design contractor. If she sues this policy (which he may have) she may be able to recover a whole lost more than the design fees.

      Actually she made complete sense. She was saying that if something is not refundable, but something happens, like an act of god or whatever they say, then it can be refundable. Harvey said this boat could go into the Pacific ocean and she was trying to say.. then yeah .. she would get her refund.

    “Non refundable” doesn’t mean, “I keep all deposits.” It means, that once the trade is completed, then the parties keep what they got. He failed to deliver on his promise, so she was entitled to her money back.

    I cannot believe the defendant bothered showing up!
    If I am paying a trades person to know the zoning, codes etc., they need to have that knowledge. My dad owned his own construction firm for all my years prior to his passing, often building homes from the foundation up, it was on dad to know that information.
    Only if the homeowner is told they have to investigate that information, and are not paying for the tradespersons knowledge, do they gather the information themselves.

    It took 18 months to discover that a non-rentable 395 sq. ft studio apartment could be blue-printed! Who wants to spend $$$ creating an apartment that cannot be rented? Answer: NOBODY! Pay the lady back!

    Non refundable only applies when the customer cancels, not the seller/worker. If it applied in all circumstances a scammer could make quite a nice living without doing any work at all simply by accepting non refundable deposits/retainers then canceling

    Even somebody who knows almost nothing about architecture knows enough that you check building codes before drawing something up for someone.     For him to say he drew it out. She said you didn't check the zoning. He said but I don't know that until I draw it. That should be your first stop. Check the zoning measurements, etc and then draw it based on that.

    The defendant is living in his own little dream world. If he was so on it, as he says, then how come nothing was done on the plans until the plaintiff contacted another worker in the firm? It was only then that things got to moving, and even then, it was all worthless. Yes, there was a contract that said the retainer was non-refundable, but the judge's ruling implies that his firm did not live up to their side of the agreement, so that essentially voided the contract.

    As an Architect, the judge had NO IDEA what it takes to get all the facts from the Towns.. The client had an Illegal Addition! this was wrong, this should have gone to a professional Arbitration Board, No a Judge who has no Idea what we have to do, before even getting to a design!

    My dad has been self employed as an architect for nearly 20 years. He always checks the zoning before he starts a project. That's just common sense.

    Judge is so impatient and doesn't want to understand how illegal extension can be just hidden from zoning documents. Time -18 months is a bit excessive but how can architect control that he can't see in the documents?? 😮 Also on a binding contract where it says non refundable how that can be reversed if city doesn't allow the architect to proceed with permits.

    I think the architect made two mistakes. First, he dilly-dallied, then, when pressed by the plaintiff to get something done, handed the project off to "a co-worker" of unknown experience and competence who botched the job, possibly because he or she wasn't being properly supervised by the architect -- his bad, and second, refused to refund at least part of the retainer. Had he returned a significant portion of the retainer, he might have been allowed to keep some.

    The point is ANSWER MY QUESTION! Classic! Your job is worthless. His arrogance is astonishing- he thinks he did a good job. I would NEVER work with this guy. I would know from the start though. I would also make sure the retainer was refundable- or pay after he starts work. Not giving him a dime first unless I had no other choice.

    this ma did not do his due diligence, you do not have to draw a building to look up the requirements.
