This is an open and shut case, IMO. The plaintiff signed an invoice in which she agreed to pay $800 for the work. She only paid $56. She still owes $744, end of story. Just because the plaintiff ran her card for the wrong amount during the first payment is irrelevant. Now, if she signed an invoice in which she agreed to only pay $56...then they called back later saying, "We messed up, the invoice was supposed to say $800" then I would say they're shit outta luck. But thats not what happened.

listening to this case made me remember a time i went out to a restaurant to pick up some dinner. when the cashier took my card and swiped it, she then made a mistake and put in the wrong amount, somehow entering in something like $240 instead of $40. she realized she goofed up, and you could tell in her eyes that she felt really horrible about it, but I just laughed and said it's not a problem. she then made a call to her boss, but she was able to cancel that transaction, and she then said that my dinner would be on her since she made a mistake. i said, "nope, no way, you caught the mistake immediately and fixed it. i'm not going to make the business take it out on you since you made a mistake. shit happens. please charge me." she then charged me again, properly this time, and all was well with the world.
In most instances that wouldn't happen you are very fortunate but as we know in society 90 percent of the time banks and big corporations hardly correct the wrong they do to individuals It's only ever not okay to do it to big companies or restaurants and banks but if you dare do it one time you are everything under the sun

She ran my card but typed in $20 instead of $220 ($20 tip), so what that did was authorize $200 on my credit card but the money didn't transfer because she typed in the wrong amount. I didn't know how long it would take for the money to either transfer or release on my end. 7 days later, it was released. Now I didn't know this woman and could have kept the money, buy why would I do such a horrible thing as deprive someone of their hard earned money? That would makenme a horrible person. I drove right over and paid her. She started crying and saying thank you. Just seeing that made me happy to be a decent person.

As I understand it, the original estimate and work has suspension work (strut replacement) which is extremely costly, even on cheap cars. Not only did the fake invoice make no relation to that, but the idea that someone wouldn't check the charged amount is beyond me. Have some personal accountability, say "My bad" and go make it right. Non-chains, personal owned businesses can't handle giving free struts to someone.
I work retail and one day one of our associates put in the wrong amount on our POS system that a customer owed, we called the customer the next day to let him know he was undercharged and he came back to the store and payed the remaining balance. I live in Canada, need I say more!

I hate to say it, but my own parents would do things similar to this. If they notice a cashier giving too much change back or forgetting to ring up an item, they will say nothing about it to the cashier. They will later rationalise it by saying "Well, that was the amount the cashier asked for; that's what I paid her." A terrible example to set for their own children.

As I understand it, the original estimate and work has suspension work (strut replacement) which is extremely costly, even on cheap cars. Not only did the fake invoice make no relation to that, but the idea that someone wouldn't check the charged amount is beyond me.
Have some personal accountability, say "My bad" and go make it right. Non-chains, personal owned businesses can't handle giving free struts to someone.

I work retail and one day one of our associates put in the wrong amount on our POS system that a customer owed, we called the customer the next day to let him know he was undercharged and he came back to the store and payed the remaining balance. I live in Canada, need I say more!
