संविधान में आरक्षण पर किसी लिमिट का जिक्र नहीं है. सुप्रीम कोर्ट के दो फैसलों से आरक्षण पर 50 प्रतिशत की लिमिट लग गई. अब केंद्र सरकार ने EWS को 10% आरक्षण देकर केंद्र सरकार की नौकरियों और शिक्षा संस्थानों में कुल आरक्षण 59.5% कर दिया है. ऐसे में कई राज्य सरकारें भी आरक्षण की लिमिट बढ़ाना चाहती हैं. सवाल उठता है कि केंद्र सरकार राज्य सरकारों के नए आरक्षण कानूनों के मामलों में कौन सा पक्ष लेगी. इस बारे में बता रहे हैं संविधान विशेषज्ञ वकील नितिन मेश्राम. #EWS #Reservation #DilipMandal

Yes all merit people will leave the country for education and jobs. It is not about caste it is about talent. The only reservation that must exist is EWS.
You don't understand. The moment the caste divide is over the likes of him won't have food in their plates.
They feed on division and claim they are fighting caste divisions. Thry have more harm to SC ST then the upper caste.
So what will India get ,if all jobs will be given to so called forward caste ?? पहले भी इन्होंने काल्पनिक धर्म ग्रंथ के आधार पर , 100% शिक्षा सत्ता और बिजनेस पर कब्जा किया था ,उसका निष्कर्ष क्या रहा ?? 1000 साल को गुलामी , भारत की मूल श्रमण संस्कृति को तहस नहस किया गया , देश में 90% लोग हजार साल तक अशिक्षित हुए । और देश में पाखंड इतना चरम पर छा गया ,की लोगो ने अपने दिमाग से सोचना बंद कर दिया ,बस भगवान भगवान को माला जपते रहे , आज भी जप रहे है ।देश में एक भी आविष्कार नही हुआ पिछले हजार साल में । और देश के टुकड़े होते चले गए । ऐसे निक्कम्मे लोग ,जिनको इतनी सुविधा के बाद भी आज ro रहे है की उनने कुछ खास टैलेंट है ,परंतु किसी कारण से उन्हे मौका नहीं मिल रहा तो ,पहले ये तो बताए को उन्होंने इन हजार साल में क्या किया ,जब बो 100% रिजर्वेशन लेके बैठे थे। और आज क्या कर रहे है ,जब 50% सीटो पर कब्जा करके बैठे है ?? अगर बाकी 50% निक्कामे है तो बाकी so called 50% के किसने हाथ पकड़ रखे है ,प्राइवेट सेक्टर में किसने हाथ पकड़ रखे है ?? क्यू नही तुम लोग कुछ कर पाते हो ?? या फिर तुम्हारी दिक्कत सबसे बड़ी यही है ,की सारी मलाई बस तुम ही खाओ ,और बाली लोग बेरोजगार गरीब ही बने रहे ?? इतने निक्कम्मी लोग इस धरती पर कही और है क्या ?? अमेरिका में भी yo tum log reservation लेके ही जाते हो ?? बो भी blacks का हक मारके ?? बहा भी blcaks को रिजर्वेशन है लेकिन whites aur black dono hi कई सारी डिस्कवरी करते है , लेकिन कोई व्हाइट ये नही कहता की उन्हे बो आगे इसलिए नही बढ़ पाए ,क्युकी blacks के कुछ अधिकार सुरक्षित है।

I must say something about this guest. He is a man who fought a case for a guy, and i will not hesitate in saying a Muslim guy, who raped a 4 year girl and murdered her. Although, I am of the view that lawyers are the arbitrators in the court without any particular disposition, but this guy felt proud about it. The courts accepted the gruesome crime and victims were asking for death penalty. But, after listing out in elaborate details the gruesome crime, the court settled for a life sentence, I think. This lawyer said on Twitter - "live your life xxxxx ( I don't exactly remember the name of the devil incarnate) ". Such is the moral compass of this vile person.

It's nothing new ! In Tamil Nadu, Haryana, Chhatisgarh and recently in Karnataka, the 50% limit has already been breached ! The way in which this Reservation Policy is implemented and being used by our political parties for their gains, is the sole reason why 80% of SCs are unemployed and poor, the reason that even after 75 yrs of Independence, more than 65% of STs don't have basic healthcare facilities ! In OBCs too, barring dominant castes like Jats, Yadavs, Kurmis etc other 100s of castes in OBCs are still under represented in Central Govt Jobs and other Grade-B jobs . Peope Like Dilip Mandal should talk about these issues and raising genuine problems of deprived sections instead of raising useless issues like BCCI's selection process and breaking the social fabric of our society. चलो मान लिया की 80% SC ,75 साल बाद भी unemployed है । लेकिन पहले बात क्या 75 साल बाद भी अभी तक reservation क्या पूरा लागू हुआ है और नही हुआ तो इसके पीछे कारण कौन है ?? किसकी सरकारें रही है ?? और अगर लागू हुआ है तो देश के सेंट्रल यूनिवर्सिटीज में 90% शिक्षक कुछ खास वर्गो से क्यू है ?? कम से कम 49.5% तो आरक्षित वर्ग का होना ही चाहिए था ¿?? और नही है तो इसका मतलब ,कौन है जो इनका असली हक आज भी गैर संवैधानिक तरीके से खा रहा है ?? दूसरी बात रिजर्वेशन तो आजादी के समय से है , जिसमे भी OBC का तो अभी कुछ सालो से है , और सिर्फ 2% jobs में है, और इनकी।संख्या देश में लगभग 80% है । लेकिन एक तरफ सवर्ण समाज जो पिछले हजार साल से पूर देश का 100 % आरक्षण और संसाधन पर कब्जा करके बैठा है खा रहा है ,देश के लाखो मंदिरों के थ्रू लूट रहा है , जिसको आबादी मात्रा 10 से 12% है , उसने भी 10% आरक्षण ले लिया , साला इतना निक्कम्मा कोई केसे हो सकता है को हजारों साल फ्री को मलाई खाने के बाद भी पूरा का पूरा समाज ही unemployed rah जाए। क्युकी जिस तरह से 10% आबादी को गरीब सुदामा 10% दिया गया ,उससे तो यही लगता है की , ये अभी 100% unemployed है ?? केसे?? इसलिए तो कही देश का बंटाधार नही हो रहा है ,की देश में इतनी fissaddi, nalayak कौम है ,जिसने देश की मुख्य positions पर कब्जा कर रखा है ?? और यही लोग बाकी समाज के लोगो।को।उपर नही उठने देते है

डॉ बी आर अम्बेडकर जी ने 30 नवम्बर 1948 को संविधान निर्मात्री सभा में प्रारूप समिति के अध्यक्ष के रूप में आरक्षण के अनुच्छेद 16(4) के उद्द्येश्य को समझाते हुए कहा था कि कुल पदों में से अधिसंख्य पदों को आरक्षित करना समता सिद्धांत के विपरीत होगा। डॉ आंबेडकर के शब्दों में: "Supposing, for instance, we were to concede in full the demand of those communities who have not been sofar employed in the public services to the fullest extent,what would really happen is, we shall be completely destroying the first proposition upon which we are all agreed, namely, that there shall be an equality of opportunity. Let me give an illustration. Supposing, for instance, reservations were made for a community or a collection of communities, the total of which came to something like 70 per cent. of the total posts under the। State and only 30 per cent. are retained as the unreserved.Could anybody say that the reservation of 30 per cent. as open to general competition would be satisfactory from the point of view of giving effect to the first principle,namely, that there shall be equality of opportunity? It cannot be in my judgment. Therefore the seats to be reserved, if the reservation is to be consistent with sub-clause (1) of Article 10, must be confined to a minority of seats. It is then only that the first principle could find its place in the Constitution and effective in operation." सर्वोच्च न्यायालय ने आरक्षण हेतु 50 प्रतिशत की सीमा निर्धारित करने का आधार डॉ आंबेडकर की इसी व्याख्या को माना था। किन्तु समय के साथ व्याख्याओं को बदलना सुधार और प्रगति के नए मार्ग खोल सकता है।

Majority of us tend to forget that this issue of reservations is just for the extremely small govt sector jobs on offer vis a vis the total available jobs in the nation. Also that is getting smaller due to disinvestment of PSUs. For eg. Air India jobs have no reservation quotas from now on.

The reservation itself was supposed to be a 'temporary' one for TEN years. But has got extended everytime.
Sad that upward castes are being discriminated against for 5 decades. people are getting admission in half the marks.
That limit was for political reservation that is extended every 10 years.
But educational reservation also is not for unlimited times...constitution doesn't say caste based reservation will stay forever@@SharkCoach
